Cooper's estate and they, therefore, ask the Court to grant them an extension of one year from this date within which to file a final settlement of this estate. Cooper, and being heard, and it appeering to the Court that the defendants have all been properly served with Summons, and made parties hereto, and that the personel estate of A. D. Cooper,deceased is insufficient to pay his debts and charges of administration: It is therefore ordered, eadjudved and decreed that the lands dexcribed and Specified for sale in said pe= tition be sold in order to pay so much of said debts and Charges as the personal estate may be insufficient to dis- charge. It is further ordered and decreed that R. B. McLaughlin be, and he is hereby appointed a commissioner to Sell said lands at the Court House door of the respective counties in which the same are located, to the highest bidder at public auction, upon the followings terms to-wit: One-third cash, one third in six months and one third in twelve months time; that lot number one be sold Subject to the dower of Hlecta F. W. Dula, the lands described in the petition, as lying in the town of Wilkesboro, at the price of seven hundred and sixty dollars, to be paid as per terms of sale, and the said price appearing to be just and reasonable, and no advance bids having been filed: It is therefore ordered and decreed that said sale be and it is hereby in all respects confirmed, and upon payment of the purchase money, the administratrix of said estate shall apply a sufficiency of the proceeds there- of to the payment of such debts and charges of administra- tion as the personal estate may have been insufficient to discharge, after first deducting the gosts of this suit. a S If any surplus shall remain after the payment of said debts and charges, the same is to be considered as real estate, and is to be disposed of by the administratrix of said estate among such persons as would have been entitled to the land according to law. It is further ordered that upon the payment of the purchase money and every part thereof, the said R.
