CITY OF BALTIMORE, J Pursuant to the annexed Commission and notice, directing the undersigned Comrissioner to take the deposition of Samuel Rosenthal, to he read in evidence in a suit now pending in the Superior Court of the County of Jredell in the State of North carolina, wherein Strouse & Bros, are Plaintiffs and Wm. Wallace and C.H.Armfield, Assignees of J. Stephany and John Stephany, are Defendants, at my office, Cor. Hopkins Place, German and Liberty Streets in the City of Baltimore end State of vwaryland aforesaid, on the 10th, day of April, A.D.1894, at 4 o*clock, P.M., Samvel Rosenthal being present and representing the Plaintiffs and Deniel Greenbaum, Esq being present as Counsel for the Defendants, I proceeded to examine the said Samuel Rosenthal, who being by me first duly sworn deposes as follows, viz: Examination upon written interrogatories annexed hereto. What is your name, age and place of residence? My neme is Samuel Rosenthal, I am aged 39 years and I reside in Baltimore City, waryland. In what business are you engaged? Clothing. Do you, or not, know John Stephany of Statesville, N.C.? I do. What transaction, if any, had you, or the Plaintiffs, with Stephany on or about Mareh 15th, 1893, and what concersation, if any, was had with Stephany? I sold Mr, Stephany about $900.00 worth of goods, and in the general way inquired of his financial condition, which was * } 2. satisfactory. What effect, if any, had ssid conversation upon you, or plain= tiffs, touching the purchase of goods at that time by Stephany? It warranted me in passing the order and shipping the goods, What conversation, if any, did you have, or the Plaintiffs have, in your presence with Stephany, on or about September 8th, 1895, touching the purchase of goods at that time and what was said by Stephany as to his financial condition? On that occasion, I sold him about $800.00 of goods, after which IY questioned him thoroughly in reference to his financial con= Gition at that time, He assured me that he had never been in better shape; that he never owed so little and had fully $12,000.00 capital above his liabilities, on the strength of this I accepted his notes due September 21, 1893 and October l. 1893 for $460.95 each in settlement of his overdue Spring account, and so well satisfied was I with the statement he made that I shipped his Fall order without any hesitation. I! have known him personally for very many years and had great con= fidence in his integrity for which reason I did not ask him for a written statement. When the first note fell due, he sent @ renewal at 30 days, and offered in extenuation that trade was yery dull, which induced me to comply with his request, In the meantime the second note fell due, maturing October 1. 1893, and eame back unpaid with 4 like explanation anc assurances that remittance would follow shortly. Subsequently the note aue October 21, 1895, which was given in extension of note aue , Sept. 21, 1895, came back unpaid. Note by Commissioner: - Counsel for Defendants objects to 80 much of the foreroing answer as refers to anything written by Stephany in explanation &c., uniess the original letters are produced, Witness here proauces letters dated Sept. 18, 1893, Sept. 21. 1893, Oct. 11.1893, 0c t.27.1893,Nov.1.1893, and Nov, 7. 1893., agg letters in all, 3. which he files as a part of his previous answer, which are marked “Exhib= SR, No.2,2,5,4,5. and 6.” Pleace state anything additional you may know relative to the sale of goods, and said bill was sold? The goods were sold in the regular way at market prices and when our representative went to Statesville shortly after, only a few goods embraced in these two purchases were fourld uneeld, which is a remarkable fact considering that he claimed trade was so dull. Objected to by Counsel for pe endants, as heersay ane argumentative. CROSS-EXAMINATION, By Mr. Greenbaum. Rat tbe Mr. Rosenthal, how much did Mr. Stephany owe you in the Spring of 1893? $921.90, Did not he owe you a balance of about $50.00 or $60.00 in March or. the Spring of 1893 and paid it? I cannot recall without reference to my books. When and where was the statement mede which you testify to, in March, 18937 It occurred in our sales room while I was waiting on him, Who was present? No one besides myself. Was not that the time that you setisfied yourself that you would he safe in selling goods to him? That was lerrely a matter of confidence based on my conversation with him when no figures were quoted at all, but he told me ina general way that he was getting along nicely and was in a pros= perous condition. When he bovght the bill of goods from you, 88 you had become satiefied abovt his financial condition in March, 1893, was it necessary, or is it ueuel to meke inquiry egein about the financial condition of ® purchaser of goods 81x months after 4, in September, 1893? Ordinarily we do not exact statements from customers more than once a year, but where accounts are due and unpaid and new bills contracted, we invarisebly require a statement and if such a statement was declined us, we would unhesitatingly refuse to fill the order, In this case Mr, Stephany owed vs over $900,00 and bought about $800,00 more, and of his own accord offered us a note dve in 10 deys and one at 20 days, due Sept, 21, ana Oct, 1 1893, which we treated practically as cesh, When and where was this statement made in September, 1893? In the office immediately before giving these notes, Who was rresent? It is not usual for tnyone to be present, I usvally attend to such matters myself anc sucn matters are usuelly conducted qutetiy without attracting attention, Did not Mr. Stephany sey to you in September, tires were hara and that he wanted to close his account by notes? He apologized for not having the cash and offered these short notes in payment, whict I accerted. Did he at that time state hie assets ana liabilities?
