That your petitioner is the duly appointed, qualified and acting Executor of the last Will and T estament of Annie Wilfong Goodman, late of Iredell County. end. That among the assets of the estate undevised by the will is one Buick Sedan 1934 Model, which was owned by the testator at her death and which had been stored unused in her garage for several months prior to her death during her protracted illness. 5rd. That the petitioner is informed and believes that for an automobile to be stored and unused will depreciate it and lessen its sale value on account of the fact that the tires are apt to go down, the battery go dead and otherwise depreciate from lack of use. That in addition to the above depreciati on, the petitioner is informed and believes that the Buick Automobile Co., manufacturer of the automobile in question, is about to introduce a new series of models with certain changes and improvements, which would further lessen the value of said automobile, which has not been run but a few months and your petitioner is of the opinion that by reason of said fa cts, it would be advisable to advertise aad sell the said automobile at the earli est possible time in order to conserve the assets of the estate. WHEREFORE, the petitioner prays that the Court will make an order, directing the Executor to sell the said automobile at public auction for cash, after posting a notice of said sale at the court house door for twenty days and publishing a notice thereof once a week for two weeks in some newspaper published in Iredell County. “ Co Attorneys for the Petitioner North Carolina.
