R. nm ;raham, To the Clerk of the Superior Court, of Iredell County :- Your petitioners respectfully show to the Court that H. T. Graham died intested, in Iredell County, during the month of » 28 _» leaving him surviving ‘“_e Amanda 'ills, his wife, and the following children, to-wit: J. W. Grahan, J. R. Graham, T. K. Graham, Jennie Authurs, Hettie Coz ] Sti leather, who are hi nly children and heirs at law, and all of whom are of age Your petitioners further show that the said H. T. Graham during Coverture with the petitioner, Amanda Mills, and at the time of his de.th, was seized in fee sim and possessed of the following real estate, in township, said County, to-wit: Place known as Home North by the lands of J. A. Lippe and Robert Zeizler; on the East ids of Tone Beaver and one, Prantily; on the South by the lands of L. Patterson; and on the West by the lands of T. M. Goodman; and containing 82 a more or less. That in said tract is a tract of 49 x acres, more or less, which t.e said H. T. Graham acquired by descem®; and er One tract of I8 acres purchased from T. M. Goodman; and another tract of - IS acres purchased from Charles Moore. Your petitioners further show that, since the death of E. T. Graham, your petitioners have ween seized and possessec of same; the Amanda Mills by virtue of her rights to have dower in $ the same, and the other heirs at law a@€ tenants in common. That the peti- tioner, Amanda Mills, desires to nave her dower in said lands allotted toher, L ye r y e z a y ‘w i e y e i n 76 8 I that the above named petitioners and heirs at law desire to hola their lands in severalty, and that the interest of said petitioners in said lands are as follows: J. W. Graham 1/6 part tnereof; Jennie Authurs 1/6 part thereof; Hettie Comvs I/6 part thereof; Lula Stikeleather 1/6 part thereof; J. R. Graham 1/s part thereof; T. K. Graham 1/é part there- of. Iredell County. \ Amanda Mills et al. Order to appOint Commissioners, “tee The petitioners in this cause being heard, it is ordered by the Court that L. 0. White, Augustus Johnsor anda J. Lee Deaton be and they are ierecy appointed commissioners, who shall meet on premises described in petition, and after being Guly sworn by the Sheriff or some other person authorized to a minister Oaths, shall allot to said petitioner, Amanda Mills, according to law, a dower in the lands of her late husband, H. T. Graham, wich are described in the petition; and allot to each of saia children and heirs at law one share in severalty therein, and if equal shares cannot be made by Gividing the lands, then the said commissioners are to charge the more valuable dividends with sucn sums of money as they shall judge to be necessary, to be paid to the dividends of inferior Value in order to make an equitable partition.
