Smith Statesville, N. C. Dear lir. Smith: On July 3, 1963 I made a trip to North Cardlina to settle the estate of my late husband, E, E, Grant. I saw Mr. Johnie Ray Hendren, my lawyer, and found out I would have to pay a bill at the funersl home in Harmony that we thought my husband's children had paid several years ago. I also was told that I would have to buy a foot marker for my husband's grave before the estate was settled. There is money there to pay these bills I understand, wut I have never heard of having to buy a foot marker for a grave before an estate could be settled, Is this the law er is someone trying to pull something over me? I heard recently that ay lawyer turned over on my hus~ band's children's side. If this be true, and after these children have treated me the way they have since my husband's death for no reason as I see it, I want nothing to do with that lawyer. lire Hendren told me that he would get you to fill out some papers for me to sign and have you mail them on the following week. As to this date, I have not received those papers and I wonder if you sent them and they are lost or has Mr. Hendren not seen you? I chose the six month period to settle this estate and I'd like to get it settled as I am planning to sell the real estate as soon as possible, I have written to Mr. Hendren put have not heard from him. I have had plenty time to get a reply.(the 6 mos. was up juy 5) Is it necessary for me to make another trip up there to do this work? Grant “q o1 p e q ‘u e s £9 6 1 August 1, 1963 Mrs. Stella C. Grant Route 1 Cades, South Carolina Dear Mrs. Grant: Acknowledgment is made of your letter of July 29th, in regard to the Estate of E. E. Grant. No papers have been filed by Mr. Hendren, your attorney, with me to be mailed to youe As to the payment of funeral expenses, it is mequired that the executrix of an estate pay the fun@ral expenses of the deceased. So far as I know, there is no law that requires the executrix to place a marker at the grave of the deceased, however, it is the policy of the executrix to place such marker, which would be a charge against his estate. When you have had your final accounting prepared, it will be necessary that cancelled checks be presented showing the bills paid. It is possible that this can be done by your attorney after you have signed the final accounting. You should contact your attorney and have him prepare the final accounting for you. You stated in your letter that you have not been able to get your attorney, Mr. Hendren, to prepare this report. The report will be due on January 3, 1964, and if he will not proceed with this, you should employ some other attorney to do this for you. Yours very truly, C. G.
