Uh on or about the 27th day of February 1882,the defene dant Re Se Kennerly, borrowed from one Benjamin F.Frahey of Rowan County NeCethe sum of One thousand dollars,,for which he made and entered into a written obligation to pay the Samé,with interest at the rate of 8 per cent per annum (but interest to be due every six months) on the 27th day of February 1883eAnd this contract ox obligation was Signed by the defendants R.5.-Kennerly and his wife Mary ¥Kenneily and Namey Gray e that it is stated therein that the obliftors are Joint principals,but in fact and in truth the defendant R. 5. Kennerly was the reali pPincipal,thathe negotitated the loan,got the money and used the same for own individual purposes,that the said Naney Gray was not to get any of said money,and never did get any of the same, nor did she ever derive any benefit Lherefrom;but as a kinswoman of the defendant RoS.Kennerly was induced to Sign said note by him asa favor to him,to enable said Kemerly to psocure said money,and in fact as his sucety,with the understandin; and agreement between them that it was said Kennerly’s debt and that he was to pay the same. Il. That at the request and solicitation of the said RS.Kennery ¢ and with the same understanding that she signed the note, the Said Nancy Gray on the same day joined the said Ro S.Kennerly and wife Mary %-Kennerly in making and executing to the said Benjamin ¥. Fraley a mortgage to secue the debt of One thousand dollars,above mentioned in which mortgage is included a tract or parcel of land of 14 aeres, upon which is situated a steam saw mill,grist mill,and cotton gin, the property of the defendant ReS.Kennerly and wife Many enneeenyand also a tract of land of abet one hundred and twenty (hine acres, the individual p.operty o: the said Nancy Gray,and upon which the defene Gants ReSeKennerly and wife Mary had no claim or title whatever. iii. That on or about the 24th day of January 1883, the defendant ReS.Kennerly made and exeeuted to John FeMeLean and Ce.,the defendant D.C.Brawley being one member of said company,a chattel mortgage on the steam engine,saw mill and fixtures,standing and bé ing on the 14 acre traet of land above deseribed,as_the individual proper ty of the defendant RoS.Kennerly and wife Mary %to secure a debt of something over $400.00 as plaintiff is informe ,and although said Steam engineboiler,saw mill and fixtures are attached to the soil and building,and as plsintiff is advised and alleges,a part of the realty and passed to the said Fraley under his mortgage of the 27th Februay 1882,the defendant Brawley alleges that the same is not a past of the realty and did not pass to said Fraley under o. by virtureof his said morigage,but that the same is personalty and that the title thereto passed to said JeFeMcLean & Co by virtue of the said mortgage of the 24th day of January 1883. (2) an and executing the mortgage of the 27th Febimary 1882,and J. We Mauney Esq of Salisbury has sold and assigned the Fraley mortgage lo the defendant D.C.Brawley,Mauney being the administrator of said Fraley,and the defendant Brawley now having contvol of both mortgages the Fraley mortgage and the mortgage to JeFeMeLean & Co,has adverse tised in the *Landmark* and probably otherwise,to sell unde. both mortgages,on Thirsday the 15th day of December 1837,and in saic ade vertisement he proposes to sell the stean engine,smw mill and fixe tures under the mortgage to J.F.MeLean & Cojand plaintiff is infore ned and believes that the defendant intends to sell the tract above deseribed as belonging to the surety Naney Gray first and thereby satisfy and relieve the fourteen acre tract,which belonged to the principals R.S.Kennerly and wife from the lien of the Fraley debt and mortgage,ancd he is then by the consent of the defendant R.S.Kennerly and wife,whom he believes to be in eollusion and sympathy with the defendant Brawley in the arrangement and sale to have his debt see ecured,that plaintiff believing that this was the purpose of the dee fqepes fendant Brawley,has applied to the said Brawley and proposed to pay him the balance due on the Fraley debt and mortgage,which he understands to be the entire principal and intercst since August 1887 if the defendant Brawley would assign the same to him without ree course on Lhe said Bravley,but this the defendant Brawley deelinec LO doe. That the said Benjamin F.Fraley has died since the making a Ve That pleintiff is of the opinion that if the Kennerly prope erty,the fourteen acres above deseribed, together with the steam engine, boiler,sa@w mill and fixtures,coule be sold for a fais and reasonable price,it would pay off and satisfy the Fraley debt mortgage;but if sold under a doubtful title as to the steam engine boile$, saw mill and fixtures,it wovld likely not bring more than or six hundred dollars ,if that muche Vi. That sinée the making and execution of the Frale ote and mort gage, the saic Nancy Gray has died,leaving a last will and testament which has been duly admitted to probate in Iredell County NeCein which she willed and devised to one Ae Ae MeNeelyaliof the lands mentioned and conveyed to Benj. F.Fraley in the morgage of Lhe 27th Febimary 1882,except 50 acres,and the said AeA. McNeely has sold,assigned and conveyed the sane to the plaintiff Re D.Moore,who is now the owner thereof,subject however to the incumbrence of the Frae ley debt and mortgage,as is herein above set fortheThat the defendant Brawley at the time of the execution of the mortgage to JeieMcLean & Co on the 24th day ot January 1883,and at the Lime he became the purchaser of the ley mortgage,knew all the facets herin above set forth as to the making of the Fraley mortgage;knew thal Kennerly got the money from Fraley for his own use,that he was in fact the prine cipal debtor;that Mrs Gray was in fact only his surety,and that her land,the same as above deseribed,was only intended as additional see curity to said Fraley for his said debteThat plaintiif has issued a summa ns against the above named defendants,returnaile to the next term of Iredell Superior Court;that the defendants Res.Kennerly and wife are insolwent,and have no property out of which plaintifff in could be reeimbursed,if the lands mentioned the Fraley mortgage should be sold under said mortgage.
