In one action under the Workmen's Compensation this case was heard before a single commission and a full award made, It was appealed by the defendant from the single commission to the full commission and heard and the judgment in full affirmed. The defendant then appealed to the Appellant Court of the State of New York (this corresponds to our Superior Court) and the made in regard is there. No decision has yet been rendered, The civil action is a claim for wrongful death alleging negligence on the part of the defendant. This is now pending in the trial court of the State of New York and has not yet been heard. Smith Clerk of Superior Court Statesville, North Carolina Re: Estate of Gary Milton Gryder Final Account Dear Mr. Smiths There were no receipts or disbursements in the above estate. The administration was taken out for the purpose of the appointment of an ancilliary administrator in the State of New York for the purpose of bringing action for wrongful death against the employer, the Flat Iron Window Cleaning, 350 Broadway, New York City, and the New York State Insurance Fund of New York City. The New York State Insurance Fund is paying Mrs. Gryder under the Workmen's Compensation laws the amount per week that she is entitled to. There is no limit to the number of weeks in New York State that continues during dependency. At the time of the filing of the suit for the wrong- ful death, the State Insurance Fund had paid Mrs. Gryder, the mother as a dependent and a sister as a dependent over $6,000.00. There was collected in the wrongful death case the sum of $10,000.00, which after the payment of all attorneyst fees and costs for the collection the bdance was turned over to the State Insurance Fund of New York under its right of subrogation, and for this reason there were no funds that came to the administrator in North Carolina. One (1), Bight (8) and Nine (9); when and where C. A. Gryder became the last and highest bidder for Lot No. One(1) at the sum of $275.00;and when and where J. W. C. Houve became the last and highest bidder for said Lot No. Eight (8) at the sum of $175.00; and when and where Mrs. Callie B. Gryder became the last and highest bidder for said Lot No. Nine (9) at the sum of $175.00; and that on said date,said W. J. Gryder Commissioner sold to C. A. Gryder at private sale as heretofore directed by the Court,Lot No Four (4),described in the report of the Commissioners hereinabove referredto,at $40.00 per acre, to-wit;$400.00; and whereas report of said sales was duly made on the 25th day of September ,1950; and whereas no increased bid was made on either of said lots within the time allowed by law; and whereas each of sai@ purchasers has fully complied with the terms of said sale by paying the full purchase price in cash; and whereas it is found by the Court that the price paid for each lot was full,fair,and reasonable: IT IS THEREFORE,ordered,adjudged and decreed by the Court that each of said sales be,and the same are hereby in all respects confirmed,and that the said W. J. Gryder,Commissioner as aforesaid,ex- ecute and deliver to each of said purchasers the lot purchased as here- inabove setforth,conveying title thereto to each of said purchasers, his heirs and assigns,in fee simple. It is further ordered by the Court that said W. J. Gryder,Commissioner,pay the costs of this proceed- ing from the proceeds of the sale of Lots No. Four and Eight (8),and that the remainder of said proceeds of said Lots Four (4) and Eight (8) be paid to C. A. Gryder,Executor of the ill of J. P. Gryder,who shall, after paying the debts of the said J. P. Gryder and the costs of the Administration of his estate,and the legacies setforth in the will of the said J. P. In the matter of the administration of the estate of Emma Cunn, deceased. G, W. Clege, answering the petition of M. L. Gunn, in this matter says:- FPirst:- That he admits that allegation in the first para- graph of said petition that alleres that Emma Gunn, late of Iredell County is dead leaving her surviving, your petitioner, ner husband and Ina Gunn her child as her heir at law. That he also admits that at the time of her death she had real property, which descended to her heirs as to at law, subject to her debts. That, the allegation as to her having \ personal property at the time of her death,he has not sufficient infor- mation to form a belief and therefore denies the same. That the alle- gation in said paragraph as to the said Emma Gunn not owin; anv debts at the time of her death, is not not true and the defendant denies the same. ms sb Second:- nat it is true that the defendant was appointed as administrator of the estate of the said Emma Gunn, by this court on the 18th. of January 1901, and immediately cave notice to eeditors in the Landmark as required by law. Tnat all the rest of said akx paragraph beginning with the first and ending with the word "Gunn", in line seven from the beginning, is not true and is denied. That the remainder of said paragraph, beginning with the word "that" in line four from the bottom is denied upon information and belie?. Third: - That the allegations contained ir the third yara- j graph of said petition are not true and are denied. The defendant, for a further answer to said petition says:- (1) That more than six months had elapsed after the death of the said Emma Gunn, and before the appointment of this defendant by this that this defendant is the Public Administrator for Iredell County; court ;, and that the appointmentof this defendant was in all respects in accordance with law. refular and (2) That KAMEXWOKXXXMMMEXXXXXKXX this defendant has been sued and now nas pending against him on the civil issue docket of the Superior‘ TT 7 of Iredell County a suit brought by Dr.’ J. B. 3. Holmes of Atlanta, Ga. against this defendant as the administrator of the said Erma Gunn, and that this defendant has gone to the expense to employ counsel to defend the said suit; and further that this hd tears has fone to the expense tA PETE to give notice to creditors of the said, all of which are charges against the estate of the said Emma Gunn, deceased, which estate this defendant will have to administer in order to pay said debts and charges.
