I E.SeMillsaps,Administrator of E.J.Hair,deceased, respectfully shows to the Court: 1.That he was duly appointed administrator of the estate of E-JseHair,deceased,by the Clerk of the Superior Court of Iredell County,on the ee day of January,1933,and at once entered upon the administration of said estate. 2-That from the best information and knowledge which he has been able to obtain,the debts outstanding against the said estate amount to $1200.00 or $1500.00. 3.That the personal property of said intestate has been sold and brought the sum of $102.05,and the same has been applied to the cost of administration,and the balance is in the hands of said administrator,there not being a sufficient amount to pay the debts outstanding against said estate,and no preferred claims having been presented to the said administrator. 4.That at the time of the death of the said EeJeHair, on the day of May,1931,he was seized in fee simple of the following lands: All of said lands lying and being in Iredell County, N.Ce,Chambersburg Township,and more particularly described as follows:Ga1ifid beginning at an iron stake on the North side ofHighwayNo.90;thence N.2-1/2 E.41-3/5 poles to an iron stake;thence N.7 EB.34-1/2 poles to a stone;thence N.86 W.45-2/3polestoastone;thence S.10 W.76 poles to a stake at the eastendofconcreteinculvertofHighwayNo.90;thence S.88-1/2 B.40 poles to the beginning,containing 20-1/2 acres,more or less. D £1.Tract of 20-1/2 acres valued at about Lh)L => 2.Tract of 38 acres valued at about $/(co a 20 ’S-Tract of 70 acres valued at about ${Eco 4.Tract of 16 acres valued at about $ZL Oe 9-THat a sale of the lands herein before described are necessary to pay the debts and the charges of administration of said E.J.Hair,deceased. 10.That W.FeHorton is the assignee and holder of a mortgage on the First and Second tracts herein described,being 20-1/2 and $8 acres,which mortgage is a specific and preferred lien on said land and the proceeds from the sale thereof,said mortgage being recorded in book 75,page 421,records of Iredell County.That there is now due on said mortgage about $450.00. ll.That the Federal Land Bank,Columbia,S.C.,is the holder of a mortgage on the third tract herein described,being 70 acres,more or less,which mortgage is a specific and preferred lien on said land,being recorded in book 56,page 24,records of Iredell County.That there is now due on said mortgage about $425.00. 12.That your petitioners Minnie Morton and W.F.Horton Join the administrator in petitioning the Court to order the lands described aforesaid soba:to pay the debts and cost of admininastration of the estate of EeJeHair,the said Minnie esis being an heir of E.J.Hair and entitled to a 1/7 interest in said estate,and also petition the Court for a sale for partition of the lands hereinbefore described;they show to the Court that it is impracticable to divide the interest of the defendants in the 18 acre tract of land,due to the small number of acres that each would get and that it is for the best interest of all parties concerned to have said land sola and the proceeds divided;that after sufficient land is sold to pay the debts and cost of administration of the intestate E.JsHair,that due to the large number of persons entitled thereto and the small number of acres that it would not be practicable to dividem said land,and that it is for the best interest of all parties that said land be sold for partition and the proceeds divided. 13.That as alleged aforesaid after sufficient land is sold to pay the debts,that the remaining lands can not be actually partitioned with out injury to the parties interested,due to the small number of acres that each would get by a division of the same. 14.That a sale of said lands would be more advantageous to all the parties interested than an actual partition thereof. 15.Your petitioners do think that it would be best to sell the 20-1/2 acregz tract,38 acres tract,and the 18 acre tract first and to wait until a latter date,possibly this fall to sell the 70 acre tract,unless it is necessary to sell said tract to pay the debtsandcostofadministration. Wherefore,your petitioners prays 1.That a decree may be made by this Court for the sale of said lands on such terms as the Court may direct. 2.That a Gommissioner be appointed to sell said lands under the direction of this Court. 3.That said Court order that the 20-1/2 acres,38 acres, and 18 acres be first sold,and that the 70 acre tract be sold atthereafter any time/upon further order of the Court . It further appears to the Court that W.F.Horton holds ®mortgage on the first and second tracts of land described in the petition,being 20-1f2 and 38 acres,respectively,and that said hertgace is a prior and preferred lien on said land,and it is ordered that the purchase price of said tracts of land be first applied to the payment of said mortgage, It further appears to the Court that the Federal Land Bank holds a mortgage on the third tract of land described in the petition,being 70 acres,more or less,and Bhat said mortgage is a prior and preferred lien on said land,and it is oredered that the purchase price of said tract of land be first applied to the payment of said mortgage. It further appears to the Court that the following heirs at law of E.J.Hair,deceased,to-wit:Minnie Horton, Vernie Ora Hair,Celia Hair,J.AsHair,Amanda Tucker,JeBe Hair,and G.WeHair,areiitemants in common in the first,second and third tracts of land described in the petition,and that each of said parties own a 1/7 undivided interest in said lands, and that after the payment of the debts of the estate of EeJ. The 64 acre tract of land,home place,was not sold.The Wederal Land Bank,has a mortgage on this tract for ubout $400.00, but did not file a claim,and did not demand it to be sold,and the land being worth ample to take care of it in full this land was not sold,and the assets realized from the sale of the other lands was used to pay other debts.This tract of land is worth and in my opinion will bring 2 or %times as much as the amount of the mortgagee "he administrator has filed an inheritance tax report with the Commissioner of Nevenue,and has included in that report the 64 acre tract of land,valuing it at just what it was assesed for taxes in 1933,to-wit $1671.04.After deducting the debts, ;neluding the $400.00 Federal Land Bank mortgage,court cost of special Proceeding,and cost of administration,a net estate of 1371.04 was left,which goes to the 7 children of *.JeHair,to- wit:Minnie Feilorton,Vernie Cra Hair,Velia Hair,JeAeHair, Amanda Tucker,J-eEeHair,and SeWeHair;each Ghild is entitled to an exemption of $2,000.00,s0 it is easily seen there is no inheritance TAX.
