Hampton, Nancy Jane Jones and “Nore Poston,two of wnom, to-wit: Nora Poston and David A. Hampton are dead; and by his wife Surviving the following chiloren, 7 to-wit Minnie Harpton anda Marsie Crowe, wife of 2nd. Sra. That if the indebtedness of the intestate amounts to much as is claimed by the plaintiff the tract of land sued for and referr ed to in the complaint as conveyed to the defendants Lindon 8B. Hampton and David A, Tampton,woule he entirely insufficient wherewith to indebtedness claimed in the complaint; that as alleged in the oririnal (2) answer, and adopted bv this defendant, the conveyance made to the said defendants in his said answer was made for & consideration furnished by the said defendants,and this defendant is advised and helieves that in equity and good conscience the donations made to the two daughters by the last marriage above referred to should he the first property soucht by the plaintiff from which to derive assets to pay the cebts of the intes- tate if there are such,in exoneration of the property conveyed to the said Lindon B.Hampton and David A.Hampton for a consideration +s afore- said. 4th.
