IV "That Sarah Rand Hanks desires to submit her resignation as executrix of the will of William Franklin Hanks and hereby requests and nominates William W.Hanks of Charlotte,North Carolina to be appointed administrator, d.b.n.with the will annexed of the estate of William Franklin Hanks,deceased." 6.The only action taken by this court with respect to said Paragraph IV of said "Final Report and Resignation"was the following: “Approved -May 14,1959 -C.G.Smith,Clerk of Superior Court" 7.William W.Hanks,a resident of Mecklenburg County, applied for letters of administration of said estate on the 14th day of May,1959,and on said date an order was entered herein purporting to appoint William W.Hanks,Administrator d.b.n.,c.t.a. es =_ =~~ _ ee 3~ “3=rs)=ciy of said estate. And the court upon said findings of fact makes the follow- 8S 6 l CONCLUSIONS OF LAW 1.Paragraph IV of said ''Final Report and Resignation" did not comply with Article 3 of Chapter 36 of the General Statutes of North Carolina with respect to the proceedings prescribed therein for the resignation of an executrix and was insufficient in law to constitute a valid resignation by said Executrix of her duties and trust as such, 2.The approval of this court of said "Final Report and Resignation"was not sufficient in law to authorize said Executrix ans~nn S 3 TI—bo)Soee ss o l to resign or to vacate her said office. 3.Sarah Rand Hanks since the issuance of letters testamentary to her on the 7th day of July,1958,has been the duly appointed,qualified and acting Executrix of the Estate of William Franklin Hanks,deceased,and is still the duly appointed, qualified and acting Executrix of said estate. 4.The purported appointment of William W.Hanks as Administrator d.b.n.,c.t.a.of said estate on the 14th day of May,1959,was null and void and of no effect for the reason that on said date the office of personal representative of said estate was not vacant and the court was without jurisdiction to appoint William W.Hanks to said office. WHEREFORE,it is hereby CONSIDERED,ORDERED,ADJUDGED AND DECREED that Sarah Rand Hanks is now and has been since the 7th day of July,1956,the duly appointed,qualified and acting Executrix of the Fstate of William Franklin Hanks,deceased,and that the said appointment of William W.Hanks,Administrator d.b.n., c.t.a.of said estate was null and void from its inception and said aovointment is hereby vacated, This oth day of January,19600. AS A FURTHER REPLY TO THE PETITION,YOUR RESPONDENT SAYS AND ALLEGES: (1)As a further reply to the petition herein,the respondent, William W.Hanks,administrator d.b.n.,c.t.a of the estate of William Franklin Hanks,deceased,says and alleges that William Frenklin Hanks died testate in Iredell County,a resident of said County,on the 7th day of June,1958,as a result of injuries received by him when an auto-= mobile in which he was riding as a passenger and which belonged to the Weyerhauser Company and was being driven by its agent,servant,and employee,Simmons P.Boyd,who is the petitioner herein,and as the direct and proximate result of the negligence of the said Simmons P. Boyd,acting in the course and scope of his authority and in the furtherance of his duties as the agent,servant,and employee of the Weyerhauser Company in driving said automobile when he carelessly and — _&—~~- ae 3 =—yy=ceea 8S 6 l Page 4 negligently drove said automobile in the nighttime along a narrow street in the City of Statesville at an excessive and unlawful rate of speed without keeping a proper lookout and carelessly and negligently drove said automobile into and against the side of a train which was occupying the Southern Railway crossing at South Mulberry Street in Statesville at the time. (2)That following the death of the aforesaid William Franklin Hanks,his widow,Sarah Rand Hanks,qualified and was duly appointed by the Clerk of the Superior Court of Iredell County as executrix of his said estate,said qualification and appointment taking place on July 1 1958,and thereafter said executrix entered upon and proceeded with the administration of said estate until the 13th day of May,1959,at which time she filed with the Clerk of said Court her written "Final Account and Resignation”as administratrix of said estate,a copy of which is attached hereto marked "Exhibit A"and hereby expressly made a part of this reply. (3)‘hat in her written report and resignation said executrix alleged that all personal property belonging to William Franklin Hanks at the time of his death had been delivered to her pursuant to the terms of the will and the Clerk was further advised at that time that the only asset remaining belonging to the estate was a cause of action for the wrongful death of William Franklin Hanks which existed against the said Simmons P.Boyd and Weyerhauser Timber Company,which your respondent is informed and believes has since changed it name to Weyerhauser Company and that she the said executrix desired to submit her resignation as executrix at that time in order that William W.Hanks of Charlotte, North Carolina,could qualify and receive appointment by said Clerk as administrator d.b.n.,c.t.a.of the estate of William Franklin Hanks for the purpose of prosecuting said cause of action for wrongful death against the said responsible third parties and that said Clerk was fully advised and cognizant of said claim and the necessity for the appointment of an administrator of said estate for the purpose of instituting said wrongful death action and in Paragraph IV of her "Final Report and =)8J _ = 37 =S=Fete= 8S 6 l Page 5 Resignation"said executrix stated that she desired to submit her resignation as executrix and requested and nominated the said William W.Hanks of Charlotte,North Carolina,to be appointed administrator d.b.en.,c.t.a.of said estate and in Paragraph V of said "Final Report and Resignation"it is expressly set out that William Franklin Hanks, Jr.,son and only heir-at-law and the person next entitled to administer said estate,joined in signing said final report and resignation for the purpose of renouncing his right to administer said estate and said William Franklin Hanks,Jr.did join in signing said "Final Report and Resignation"for that purpose. (4)‘That said "Final Report and Resignation"were in all respects valid and effective and were approved and the resignation accepted by the Clerk of Superior Court of Iredell County on the lth day of May, 1959,at which time said resignation became effective in every respect. (5)That on May 14,1959,immediately following the acceptance and approval by the Clerk of the Superior Court of Iredell County of the "Final Report and Resignation"of Sarah Rand Hanks,executrix of said estate,on written application duly made by William W.Hanks to said Clerk of the Superior Court which appears of record in the Office of said Clerk and oath by him as administrator duly made before C.G. Smith,Clerk of the Superior Court of Iredell County,letters of admini- stration were duly issued on said date by the said Clerk of the Superior Court of Iredell County,appointing and empowering the said William W.
