Notice to creditors was duly published in the Statesville Record once a week for six consecutive weeks, commencing with the issue of September 30 1958. ? 2. All debts and claims which were filed with the Executors, or of which they had any knowledge, have been paid in full. 3. Inheritance Tax Report was made to North Carolina Department of ‘tevenue, and the inheritance tax paid in full, 4. The 1954 Chevrolet automobile was sold to Edgar Tuck lazenby, Jr. for $600.00. $300.00 of the sale price is show under Receipts, and the balance of $300.00 was paid by him and divided among the four heirs. 5. The household and kitchen furniture and other personal property devised under Item IV of the Will to the widow, Mrs. Jettie P, Harmon, and then to Vallie Harmon Lazenby and Ruby Harmon Lowe, absolutely and in fee Simple at her death, have been divided among them equally and in accordance with said will. 6. The farming tools and equipment, including the trucks and tractors which were owned at the time of death, have been turned over to Eugene P, Harmon in accordance with Item V of the Will. 7. Mrs. Jettie P. Harmon, widow of A. B, Harmon, died September 8, 1959, and on her death, all rights that she had uncer the Will terminated, 8. Until the death of Mrs. Jettie P, Harmon, Eugene P. Harmon paid the rents on the premises leased by him to her in accordance with the Will and a Contract with A. B, Harmon and wife. 20) $9 = ° Ss - w Since the death of Mrs. Jettie P, Harmon, rents for some three or four months have been divided among the four heirs without going into the Estate, and the heirs and legatees do not raise any question or point in regard to there being any further rent due.. 9. Lowell Eugene Harmon and wife purchased the A. B. Harmon dwelling house and a smal] lot of about an acre of land to go with it, and the purchase price was paid and divided among the four legatees under the Will and devisees under the Will without going into the Estate. 10. All of the real estate which A. B. Harmon owned at the time of his death has been sold and conveyed except a vacant lot on the Western side of U. S. Highway No. 21, lying between the home of Lonnie B, Harmon and the home of Jim Miller, and having a frontage on the highway of 134.5 feet. 1l. The other land was conveyed by three deeds, other than the tract and strip which was conveyed to Lonnie B. Harmon prior to October 30, 1961; with said deeds being to Eugene P, Harmon and wife; one to Lonnie 5, Harmon and wife; and one to Lowell Eugene harmon and wife. Eugene P, Harmon and wife paid in $4,400.00; Lonnie B, Harmon and wife paid in $500.00; and Lowell Eugene Harmon and wife paid $3,500.00; and by agree- ment, this $8,400.00 was paid $4,200.00 to Vallie Harmon Lazenby, and $4,200.00 to Ruby Harmon Lowe, and by agreement of all the heirs, this constituted a div- ision and mutually satisfactory agreement and settlement of the land which has been sold and conveyed. Therefore, only the vacant lot referred to above remains to be sold and divided. 12. The Executors do not make any charge for their services and have not taken any commissions. 13. In the Distribution shown above, Eugene P. Harmon was paid $900.00 while the other three legatees were paid $1,200.00 each. The inheritance sax to the State of North Carolina was paid from the general funds in the Estate; however, the inheritance tax on the property of Hugene P. ‘armon and wife, Mamie Harmon, was $300.00 more than the inheritance tax of each of the other three, and, therefore, the $900.00 check given to Eugene P. Harmon, plus the $300.00 which the estate paid for him over and above the amount that it oaid for each of the others, makes Eugene P.
