At the time of his death J.Alonzo Hart was operating a machine shop on Oakland Avenue under the name of Hart Machine Shop.There was some materials and equipment on hand and some jobs unfinished,and the Executrix completed some jobs, and this is shown in her report.She collected some accounts which were owing,and these are shown in this report. The Will of J.Alonzo Hart devised all of his property,both real and personal,in fee simple and absolutely to his wife,Mrs.Essie C,Hart. A short time prior to his death J.Alonzo Hart paid the funeral expense of Sam L.Hart in the amount of $443.00,and the Estate of J.Alonzo Hart has a claim against the Estate of Sam L,Hart for the same,and this claim,together with all rights and powers thereto,is hereby transferred and assigned without recourse to Mrs,Essie C.Hart. The account of Hart Machine Shop against A.C.Arnold,in the amount of $316.85 balance has not been paid,and the same is hereby transferred and assigned without recourse,together with all rights and powers thereto,to Mrs.Essie C. Hart.All other accounts receivable,notes,rights,interests and property of any and every kind belonging to Hart Machine Shop,are hereby transferred and assigned without recourse to Mrs.Essie C.Hart. The real estate was owned by J.Alonzo Hart and wife,Essie ©.Hart,as an estate by the entirety,and a part of the machinery,tools and equipment at Hart Machine Shop was owned by them as tenants in common. All of the household and kitchen furniture,the 1940 Dodge Sedan,and all other property belonging to J.Alonzo Hart is hereby transferred,assigned and delivered unto lirs.Essie C.Hart. There was United States Government Bonds,Series E,with a maturity value of $375.00,issued in the name of J.Alonzo Hart and Essie C.Hart,or the survivor. Notice to creditors was duly published in the Statesville Daily once a week for six consecutive weeks,commencing with the issue of February 7,1948. Winberry conferred with Mrs.Hart,at her request,in his office several times about various matters arising in the estate,and advised her on several matters; that conferences were held in regard to the sale of the machine shop;that C.Be Winberry got together the information to prepare the inheritance tax return and advised Mrs.Hart that this was being done;that it was the understanding of the attorney that he was employed in this estate,and the Executrix was accepting his services;that about two months ago Mrs.Hart told the attorney that she had never intended to employ him,and it was not her understanding that he was employed,and she seemed to be disturbed that the attorney would charge a fee;when C.B.Winberry learned this,he told lirs,Hart that since that was her understanding he would not charge any fee,but if she wanted him to,he would prepare the final settlement for her;that on July 27,1949,Mrs.Hart called and came to the office of C.B. To my nephew Harry my interest in the farm which we own jointly. To Howard my interest in the lot which we own jointly iy house and lot 301 West Center Ave to be sold and the proceeds given to Barium Springs Orphanage. Also to Harry the real estate where my office and warehouses are located, also trucks,warehouse and office equipment,also 1/3 of my 55%interest in S.A.Hart &Co. All of my personal property I leave to my wife. Any cash that I may have on hand or in banks,including Building and Loan,Bonds,stocks,etc.and all other real estate that I may own I leave in trust,the income thereof to my wife Helen. I ask that Howard act as trustee for this.In case he does not want to serve I ask that his oldest surviving son act as trustee.Neither of them shall be required to furnish bond.In case the income from this is not sufficient for my wife's comfort the trustee shall use whatever of the principal is necessary. At my wife's death the trustee shall convert the real estate and what- ever securities he has into cash and devide between my surviving brothers, sisters,nephews and nieces,share and share alike.
