He shall also return to the clerk, on oath within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42. Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit. He must produce vouchers for all payments. The clerk may examine, on oath, such ac- counting party, or any other person, concerning the receipts, disbursements, or any other matters relating to the estate; and having carefully revised and audited such account, if he approve the same, he must endorse his approval thereon, which shall be deemed prima facie evidence of correctness. Mrs. Maggie A. Lippard, or H. M, Lippard, assignee, held a note secured by deed of trust on three tracts of land, which debt was $2041.32. The land was foreclosed, and brought $1720.00 at the sale, and the Administratrix has paid the balance of this debt in full as shown in this report. All debts that have been filed or that this Administratrix knows of have been paid in full. She does not show Payment of funeral expenses, as the de- ceased died at Grenada, Mississippi, and his employer, Barber Brothers Construction Company, took charge of the body and had it sent here ready for burial. They have written me several times but have not said anything about payment of the funeral expenses, and they told one of the children, who was there at the time of the death, that they were Paying the funeral expenses. The stock, farming emplements, provisions, and all other personal property at the home, which was valued at ¥269.50, was allotted to the widow on her year's allowance, and the deficiency was paid in money. The deceased left real estate which is estimated in value to be $5400.00, but part of it has been foreclosed, and when the real estate and personal property are added together, including the life insurance certificate and certificate against the Bank, it will only make $7545.41. It can be seen, therefore, that after the deductions are made, there would be no inheritance tax. In fact, there would be none anyway, as each of the ten heirs are entitled to an exemption of $2000.00 each, but to comply with the law, the Administratrix has filed a report with the Can- missioner of Revenue. There came to the hands of the Administretrix a certificate from the Hercules Life Insurance Company in addition to the amount they paid in cash in the sum of $37.64, and no dividends have yet been paid on this. There also came into her hands certificate against the Commercial National Bank of Statesville, No. 1082, in the emount of $1322.88, upon which 55% has been paid, and certificate No. 986 against the Commercial National Bank in favor of Joe Rawls Hartsell, a minor, in the amount of $10.26, upon which a dividend of 55% has been paid. The Administra- trix, therefore, does not make this her final settlement, but holds the estate open for the purpose of handline the above matters.
