Hayes, of Iredell County, North Carolina, do hereby revoke all former wills and codicils made by me and do hereby make, publish and declare this my last will and testament in manner and form as follows: Item I I direct my executor hereinafter named to Ray all of my just debts, funeral expenses, and costs of administration and to erect at my grave such monument as he may deem proper. Item ITI I will, devise, and bequeath unto my wife, Eula Myers Hayes, such interest and estate in such property, real and personal, as the law would have given her by way of yearts allowance, distributive share and dower if I had died intestate. And I do hereby give and grant unto my Eaany executor hereinafter named full power and authority to contract with my said wife as to whag money or personal property she shall take as year's allowance and distributive share, and as to what real estate shall be allotted to her as her dower, and to execute as such executor all documents necessary to carry such agreement into effect. But if my said wife and my said executor fail to agree as to such settlement or any part thereof, the same shall be determined as by law provided. In making this provision, I have taken into consideration that I have purchased during my lifetime certain real estate and title to same is held by my wife and me as an estate by the entirety. Item III I direct my executor to sell all the rest and residue of my estate, meaning thereby all of my property of every sort, kind and description both real and personal which remains after all debts and costs of administration have been paid and a prior provision of this Will fully complied with and carried out, either at public or private sale, and upon such terms as in his sole discretion shall be for the best interest of my estate and to divide the proceeds thereof, share and share alike, between my twelve children, namely: "S ) we i ‘s o k e y y 8S 6 l Darwin E. Smith executor of this my last will and testament, and I do hereby give and grant unto said executor full power and authority to sell any property or do any act which he may deem reasonably necessary for the proper administration of my estate. And I do further provide that if my said executor be not living at the time of my death, or decline to serve, or be for any reason unable to act, or die before my estate is fully administered, then and in either of said events and thereafter Flake Hayes and Darwin E. Hayes shall become, be and act as executors of this my last will and testament with all of the duties, powers and authority herein given to the original executor.
