In re: James R, Hill Estate Dear Mr. Smith: The executors of the James R. Hill Estate published notice to creditors in the paper on June 5, 1956, and, therefore, on June 6, 1957, could have filed a final settlement, or at least an annual accounting. Both of the executors live away trom here, and one of them is a very busy doctor. Some several weeks ago, I talked to you about the matter, and as I recall, you made a notation in your file extending the filing until August 30, 1957. At that time, I had not conferred with them about the filing except by letter. A few weeks ago, both of them came here for a short while. In fact, they were here a few hours one afternoon. We went over some of the matters in the estate, but did not complete the full analysis and necessary details to find out entirely just what we could do. I am now working on that phase of it. There are legacies in the will of Mr, James R. Hill amounting to $2,000.00, $1,000.00 being to two of his nieces, and $1,000.00 being to two sisters. We do not have sufficient money in the estate to pay the cost of administration and to pay these legacies. We have two ways, of course, oi getting the money, and that is by the three boys borrowing the money or by selling some Merchants and Farmers Bank Stock. They prefer not to ao either at this time. Within the next few days, I will be able to advise you just how much money they lack. Lawrence has seen the legatees in the will, and they do not need the money at this time and are willing for the payment of the legacies to wait for a reasonable time until the Hill boys can work out the financi- al matters. They have two pieces of property here in Statesville which are renting for a total of $125.00 a month. What they would like to do is wait a few months, and they believe there will be sufficient funds coming in so they can settle the estate, that is, make a final settlement, and not have to borrow any money and not have to sell any of the Merchants and Farmers Bank stock. I hope that you will consider giving them a reasonable extension in this matter. Sometime this week or the first of next week, I should be in a position to tell just how much money they need to close the estate, and if you want to wait until then to make a final decision in the matter, I would be able to approximate the time that it would take to get that amount of money in from the rental property.
