Holcomb, an unmarried widower, died intestate in Iredell County, North Carolina, on September 3,1925, leaving sur- viving the following as his only heirs at law; to-wit, Two brothers, P.AsHolcomb and T.F.Holcomb, five sisters, Vrs. Mary £.Campbell, Vrs. Jane Murphy, Mrs. Rodema Lumley, hrs. Adeline Trivette, and lrs. Nancy. Crater , also the heirs at law of Vrs. Sallie Weatherman, a sister who died prior to the doa th, Of, teh? said John \/.Holcomb leaving surviving the following children;to = wit, H.C.Weatherman, T.D.eatherman, Lillian Ukele, Minnie A. Ring- walt, and Lydia Jordan: that since the death of the seid Sallie Weatherman, to-wit, on or about the day of August,1917, the said Lydia Jordan died leaving the following as her only childr and heirs at law, to - wit, Leile Jordan Teague,Harold Jordan$’Floyd Jordan: that since the death of the said John . (29 That the said John W.Holcomb at the time of his death was seized in fee simple and in the possission of the following describ- ed real estate situated in Iredell County North Carolina; to-wit, FIRST TRACT:= Beginning at a pine, the southeast corner of Lot #1 {in the division of the Phomas Holcomb estate, T.F.Nullis’ corner, on Barnard's line; thence with Barnagd's line south 72 west 111 poles to a stake on the south bank of Hunting Creek, and ReLeTomlin's line; thence up said creek with the south bank thereof nearly west 79 poles to a large rock,corner of J.W.Holcomb et al; thence with the line of J.G.Holcomb et al , north 7% east 121 poles to 4 small black gun, T.F.Mullis' corner; thence with his line south 65-2/5 east 7» poles to the beginning, containing 54 actes, more or less, and being lot #2 allotted to John W.Holeomy in the division of the Thomas Holcomb Estate. SECOND TRACT:= An undivided one-fourth interest in the followinf de- seribed tract of land adjoining the tract above descrived, and bound- ed as follows, viz: Beginning at a small black gum,Levi Trivettes corner, and running thence with his line North 9# west 61 poles to a white oak, Trivette's corner in W.I. Holcomb's line, the Same de- ing the line of lot # 3 in the division of the Thomas Holcomb Lands;, and running thence with said Holcomb's line south 88 east 14¢ poles to a pine, said Holcomb's corner; thence with his line south 25 east 24% poles to a pine, his corner; thence with said Holcomb's line S. 51 esst 60 poles to a stone in Hohn W. Holcomb's line; thence with said Holcomb's line south 73 west 31 poles to 4 large rock on the sou south bank of Hunting Creek; thence up the said creek with the south bank thereof about 81 poles to a pine, Brank York's corner; thence with said York's line south 2 west 17 poles to the beginning, contain- ing 15 acres, more or less. Holcomb, is entitled to dower in the undivided 1/16 interest in said land belonging to the said R.B.Holcomb or the proceeds of a Sale thereof, and the 1/16 interest therein owned jointly by Doro- thy Holcomb and Eleanor Holcomb; that she is years old andde- sires to have her said dowér interest ascertained under the mortu- ary tables of North Caroline and paid to her in cash in l1tif of dower, and to that end sne oins in this proceeding: that the pet- itioner, lrs. Saphrona’ W of said W.H.Holcomb, subject to the dower rights of Mrs. Emma Holcomb, is entitled to dower in the 1/16 undivided interest in the said land owned jointly by Dorothy Hol- comb and Eleanor Holcomb or the proceeds of a sale thereof; that she is years old and desires to have her interest therein a- scertained under the mortuary tables of North Carolina and paid to her in cash in lieu of dower, and to that end she joins in this pro- ceeding. (6) That the petitioners and defendants are seized in fee simple and are tenants in common as herein above set forth, of the lands hereinabove described, and that the said petitioners desire to nold their interests in said lands or the proceeds of a sale thereof in severalfy, and that an actual partition of the lands themselves can- not be made without injury to the parties interested owing to the small number of acres to which each would be entitled by a division thereof, and that a sale thereof would be more advantageous to all parties interested than would an actual division thereof. Wherefore, the petitioners pray that the Court will appoint some competent person to sell said lands after due advertisement, to the highest bidder for cash, and report iis vroceedings in regard thereto into the office of the Clerk of Superior Court within ten deys after such sale. C., adjoining the lands of J, A. White, and fronting 100 feet on Front Street in the of Statesville, N. C., and known as the "Holder Lot", and described by metes and bounds in a deed executed by J. nite to his daughter, Mrs. Sallie Holder, now deceased, reference being made to said deed from said White to lirs. Hold- er for more certainty of description, the same being duly reg- istered in the office of the Register of Deeds in Iredell County. Ssecond:- That the interests of the said petitioners in said land as individuais is as follows: The said Sallie Holder died Seized of the above described tract of land, leaving the above named children and heirs-at-law, who inherited the same from her, to with, one-sxith part thereof, each; that Leila Holder- Patterson, one of the children and heirs-at-law of Mrs. Sallie ~older, died without issue, seized of a one-sixth undivided interest in said lot of land, which interest descended to her brothers and sisters above set forth; that J. A. White bought the full interest of Eepey Holder in said tract of land after the death of his sister, Mrs. Patterson, and has a deed in fee Simple therefor; that said White also purchased the full inter- est of Mrs. Matie Holder-Adderholdt in said lot of land after the death of her sister, and has a deed in fee simple therefor; that the said J, A, White also purchased the interest of Arthur H, Holder in said lot after the death of his mother, to-wit, an undivided one-sixth interest therein, but the said Arthur A. Fifth: - That an actual partition of said lot cannot be made w= without injury to the parties interested owing to the small Size of said lot, and the number of those interested therein, Sixth: - That a sale of said lands would be more advantageous to all the parties interested than an actual partition thereof, Seventh:- That J, A, White, who is the owner of the greater portion of said lot, is willing to pay $750.00 for the whole of said lot; that said sum is a full and fair price therefor, and is more than the same would bring by public sale: Vherefore, the petitioners respectfully pray the Court thatit will appoint some competent person to sell Said land, and that the Court will authorize a sale thereof by private sale to the said J. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the ey and deficiency to be paid by the personal representative.
