Edwards Holland, and Nellie V. Holland, and Ada Edwards Holland was therefore, only entitled to one-third there- of, or the sum of $633.33, which is reported above. Ada Edwards Holland did not own any farm machinery, motor vehicles, and did not have any life insurance, and as far as the undersigned Executors have been able to ascertain, the personal property and real estate, set forth herein, is all of the property that she owned at the time of her death. Inheritance tax and estate tax inventory. 2. Check in the sum of $67.38 in payment of the tax due I have gone over the value of the real estate fully with the heirs, and I believe that we have placed the fair market value on all of the property. You will notice that the tax valuation for 1964 was $11,870.00, and that the sound value placed on the land by the Iredell County tax appraisers was $15,828.00. Therefore, the valuation that we have used is more than twice the tax valuation, and about 60% more than the sound value of the tax appraisers. I hope that this report can be approved at the earliest possible time, as we desire to file a final settlement, but cannot do so until the inheritance tax report has been approved. I am sending Mr. C. G. Smith, Clerk of the Superior Court, a copy of this letter so that he will know that the inheritance tax report has been filed. Please send the waivers and releases to me. She was the widow of William Walter Holland, often called and known as W. W. Holland. 2. Notice to Creditors was duly published in the Statesville Record once a week, for four consecutive weeks, commencing with the issue of August 5, 1964, and said notice required creditors to file their claims on, or before, February 15, 1965, which was more than six months after the appointment of the Executors, on August 3, 1964. 3. All debts of which the Executors had any knowledge, and all claimg of any and every kind, which were filed with them, or of which they had any know- ledge, and all cost of administration, have been paid in full. 4. An Inheritance Tax Return was filed with the North Carolina Dept - | artment of Revenue, the tax paid thereon, and the same has duly been approved. >» Mrs. Ada Edwards Holland did not have any life insurance, did not/| own any automobile, and did not own any farming equipment, or machinery, or any livestock. 6. There was a Savings Certificate at the First Savings & Loan Association, Statesville, N. C., in the sum of $2,000.00, issued in the name of Mrs. Ada Edwards Holland, Nellie V. The money in the estate was not sufficient to pay the debts and cost of administration, and therefore, Nellie V. Mrs. Ada Edwards Holland left a last will and testament which is i \| | iH | 1 | duly recorded in Will Book » page » in the office of the Clerk of | Superior Court of Iredell County, North Carolina. | Under Item II of the aforementioned will, Mrs. Ada Edwards Holland devised a tract of land containing 4.8 acres, in Olin Township, Iredell County, North Carolina, and which contained the family residence, to her three daughters, Nellie Virginia Holland, Mary Pearl Holland, and Annie Sue Holland St. Clair, and/or the survivors of them, together with all improvements thereon, as a common | home during their lives, and of the lives of any survivor of them, and then has certain provisions about marriage. In the Inheritance Tax Return, a value of $9,000.00 was placed on thig tract of land. In the same item of her will, Mrs. Ada Edwards Holland directed that i all of the household and kitchen furniture, and personal property in the dwelling | house, remain there intact, to be used jointly by her daughters, as the occupiers | of the home. A value of $200.00 was placed on this personal property. Upon the death of the last surviving daughter, Mrs. Ada Edwards Holland, provided by Item III of the will, that all of the household and kitchen furniture, furnishings, and personal property therein, and the 4.8 acre tract of land, be equally divided among her six sons, John Edwards Holland, Nesbit Rickert Holland, Locke Holland, William Walter Holland II, Henry Harvey Holland, and Leon! I had overlooked the fact that the Inheritance Tax Return for Mrs. Vora Holland Estate had not been completed. I had worked on it some, ard had asked the North Carolina Reverme Agent to assist me, and he was supposed to do it several weeks ago, but did not come. When I was talking Redmond, I completely overlooked this. it is of course, mandatory that this return be approved by the North Carolina Department of Revere before the Clerk can approve the settle ment. Mr. Smith will not approve Final Settlement and distetbution te the heirs until the inberitance tax report has been approved by the North Caro- lina Department of Revenue, Raleigh, North Carolina. I am exceedingly sorry that I had overlooked the fact that the ‘verse Agent had not returned to assist me in completing this return, and ai*nc.gn i de not feel it is entirely all my fault, I an willing to take eli of the responsibility, I am asking that the Reveme Agent contact me at once so that ‘nis report can be completed. (Etta) Holland, and makes a final report and accounting of all the funds which have come into his hands as Administrator of the estate; that the administrator was appointed by the Clerk of this Court on January 25, 1955, and he immediately qualified and entered upon the discharging of his duties; that he advertised and sold all the personal property of the estate at a public sale, and since there were insufficient funds from the personal estate to pay and discharge all the claims against the estate and costs of administration, it was necessary for him to institute a special proceeding in the Superior Court of Iredell County 7, 1955 for the purpose of selling the real estate of Mrs. J. W. (Etta) Holland to create assets to pay the debts and costs of administration; that no answer or other pleadings were filed by any of the defendants raising contro- verted issues, and a commissioner was appoint to sell the real estate; that the commissioner advertised the property and held one sale of the property on September 17, 1955; that before the sale could be completed, a last Will and Testament of Mrs. J. W. (Etta) Holland, the deceased, was found and it was neces- sary, under the order i J © suspend any further proceedings in the matter; that thereafter, the last Will and Testament of Mrs. J. W. Baggarly on January 25, 1955; that the personal property of the Estate of Mrs. J. W. (Etta) Holland was not sufficient to fully pay and discharge the indebtedness and cost of administration; that F. F. Baggarly, the Administrator, instituted a special proceeding on June 27, 1955 for the purpose of selling the land of which Mrs. Holland died siezed and possess- ed, for the purpose of creating assets to pay the indebtedness and cost of ad- ministration; that Mrs. J. W. (Etta) Holland died leaving a number of heirs at law, some of whom reside out of the state of North Carolina; that after getting service on ali state residents, and service by publication on all out of state heirs, an order was entered by the Clerk of the Court directing an appointment of a commissioner to sell the real estate; that the property was advertised, as re- quired by law, and a sale of the property was held on September 17, 1955 at the courthouse door at Statesville; that a report of the sale was made to the Clerk of the Court by the commissioner, which the commissioner deemed inadequate, and re- quested the sale not to be confirmed; before the expiration of the ten day period in which to file increased bids, a Last Will and Testament executed by the decedent was found; that a supplemental report was thereupon filed with the Court setting forth these facts, and upon which the Clerk entered an order permitting the petitioners to take a voluntary nonsuit in the special proceeding; that thereafter a final report was made by F. F. Baggarly, the Administrator, which was approved by the Clerk on January 16, 1956, when C. H. Dearman was appointed Administrator c.t.a. of the estate. II That in the final settlement of F. F. Baggarly as the Administrator, no fees were paid to C. H. Dearman as attorney for the administrator because of the insufficiency of assets; that the above charge of Four Hundred ($400.00) Dollars to C., H. Dearman is for his services as attorney for F. F. Baggarly, Administrator, and for his services in bringing the special proceeding for the Administrator. en g ‘p u e l j o H Ss 6 l aa That inasmuch as all of the receipts coming into the hands of C. H. Dearman, Administrator c.t.a., were advancements and funds derived from a loan, the Administrator c.t.a. did not ask to receive full commissions of five (5%) per cent on all the receipts and disbursements, but in lieu thereof is willing to accept the sum of One Hundred ($100.00) for all services performed by him as Administrator c.t.a. in the final settlement of the estate. IV That an inheritance tax report was made to the North Carolina Department of Internal Revenue, and all inheritance taxes were paid. V That all claims filed and approved by the Administrator have been paid in full; that this was made possible because of the advancements of Russell E, White, only child and heir of Mrs. Robena B. White, and funds secured from a loan to the guardian of Mrs. Robena B. White; that because of these advances it was not necessary to sell the real property to create assets to pay the indebtedness and cost of administration of the estate. VI That in addition to the receipts listed by the Administrator c.t.a., there remains the following uncollectable assets: 1. Ome note dated May 1, 1951 in the amount of Two Hundred and Fifty ($250.00) Dollars due twelve months after date with interest at the rate of six per cent (6%) per annum, executed by R. E. Levan and wife, Mrs. R. E. Levan, upon which twelve, Ten Dollar ($10.00) payments have been made at various dates. One note dated Ju:y 1, 1951 in the amount of One Hundred Sixty-five ($165.00) Dollars due one year after date with interest at the rate of six (6%) per cent per annum, executed by R. E. Levan and wife, Mrs. R. E. Levan. One note dated August 6, 1951 in the amount of One Hundred ($100.00) Dollars due twelve months after date with interest at the rate of six (6%) per cent per annum, executed by R. E. Levan and wife, Mrs. R. E. Levan. The above three notes were transferred and assigned to C. H. Dearman, Guardian for Mrs. Robena B. White, Incompetent, the sole devisee under the will of Mrs. J. W.
