On the night of May 15,1959,a four-hour conference with Mr.Lowery and Miss Helms from White Oak Acres,Inc.,Monroe,N.C., and Mrs.Hollifield and her son,David Hollifield.The status and condition of the estate was discussed,and the indebtedness was discussed. I was of the opinion that operation of the busi- ness should not be continued,and so advised,and told all parties that actually under the law,the Administratrix had no power and authority to con- tinue the operation without a court order and I was satisfied that the court would not grant an order for such operation. It seemed that the people from White Oak Acres, Inc.wanted to encourage the operation feeling that it wuld be a means of paying off the in- debtedness due to them. Therefore,the operation continued for about seven months,and during that time there were numerous conferences with Mrs.Hollifield and with her son, who was actually engaged in operating the business. During the operation of the business,there were numerous telephone calls and conferences with the people from White Oak Acres,their attorney,Mr. Frank Griffin,other creditors of the estate,and attorneys representing other creditors. In December,1960,there was a conference lasting around three hours in the office of C.B.Winberry, with attorneys and creditors of the estate from Monroe,N.C.,Albemarle,N.C.,Dobson,N.C., Statesville,N.C.,Sumter,S.C.,in regard to doing something about settlement of the claims and debts in the estate. The attorneys representing creditors of approximately $21,000.00 agreed in May,1961,that they would accept a deed to Rk.A.Collier,Sr.,W.R.Battley, C.B.Winberry,Trustees for the creditors,convey- ing the real estate owned by Mrs.Hollifield in Troutman,N.C. This deed to the Trustees was prepared,but Mrs. Hollifield decided not to go through with it. The attorney informed Mrs.Hollifield and her son that since the operation was carried on without any lawful authority,that Mrs.Hollifield and her son both could be liable,individually,and that the surety bond which Mrs.Hollifield had given would be liable for the indebtedness incurred in the operation, After June,1961,there were several more conferences with attorneys and creditors from Monroe,N.C.,Albe- marle,N.C.,Dobson,N.C.,Sumter,S.C.,and States- ville,N.C.,in regard to the claims and debts and what could be done to make e settlement thereof;and C.B.Win- berry,Attorney,made two trips to Monroe,N.C.,in re- gard to the matters and made numerous telephone calls. TOTAL RECEIPTS (Brought Forward):$16,185.15>. DISBURSEMENTS (Continued): il.At the time of the death of Mr.Cecil L.Hollifield,the claims and debts were around $15,000.00. However,when the operation ceased,the debtsandliabilitieshadgrowntoapproximately $30,000.00,including those that were in existence when Mr.Hollifield died. In June,1961,the unpaid debts and claims whichwereknownaboutamountedto$21,022.23,and were to the creditors shown under Item 26 of this Final Settlement. Because the creditors were insisting that something be done,C.B,Winberry began further negotiations with the creditors and their attorneys. There were several bad checks outstanding which had been given during the operation of the business. The Southeastern Turkey Ranch,Sumter,S.C.,was threatening to bring a criminal action against the son who had been actually carrying on the operation, White Oak Acres,Inc.was threatening to begin suit immediately against the individuals and the Adminis- tratrix and against the bonding company,and others were also threatening suit and criminal actions on checks. After a lot of negotiations,the creditors agreed to accept 35%of their claims in full settlement, and Mrs.Hollifield arrangeqdto obtain sufficient money to make this compromise and settlement. The claims,debts and worthless checks shown in Item 26,amounting to $21,022.23,were settled for $8,021.75,thus knocking off,or saving from the total amount the sum of $13,000.48. The attorney prepared agreements and releases for all of the creditors in Item 26 to sign,accepting the 35%compromise settlement and releasing all persons of liability,and payment and settlement of the claims were handled by C.B.Winberry,Attorney. Preparing Petition and Order of Court for private sale of trucks,equipment and other personal pro- perty to Robert L.Hambright and J.A.Johnson in 1960,for $2,058.44. Preparing and filing this Final Settlement in the Estate. Considering all of the time involved in the matters herein, the conferences,the matters that were worked out,and the compromise settlement which resulted in a saving of $13,000.00, the attorney feels that $1750.00 would be a minimum fee and would be a fair and reasonable fee for the time,services and results herein;however under all the circumstances and because of the financial condition,the attorney waives the sum of $500.00,and includes herein for the matters in the estate as set forth herein,and other matters arising which may not have been enumerated herein,the sum of $1,250.00 Total Disbursements $16,185.15 16,185.15 Balance None FURTHER INFORMATION 1.Notice to Creditors was duly published in the Statesville Record once a week for six consecutive weeks,commencing with the issue of May 1,1959. 2.The Inheritance Tax Report was filed with the North Carolina Department of Reverme,but there was no tax due. 3e The Inventory in the estate was duly filed with the Clerk of Superior Court of Iredell County. 4e Cecil L.Hollifield was engaged in selling and delivering by truck,frozen poultry,and carried on his business operations in Iredell County, Surry County,Cabarrus County,Rowan County,and other counties in the State of North Carolina. 5e The Administratrix through and by the help of her son,David Hollifield,contirmmed the operation of the business carried on by her husband, Cecil L.Hollifield,for some six or seven months after she was appointed Adminis-~ tratrix.e 6 The household and kitchen furniture belonged to the widow. 7e Life insurance in the amount of $6,150.00 was payable to the 8.After the Administratrix and her son discontimed the operation of the business,negotiations were commenced,trying to compromise and settle the claims set forth in Item 26 herein;after a period of negotiations lasting for eight months or more,an agreement was reached under which the claims set forth in tem 26 amounting to $21,022.23 were settled by the payment of 35%thereof,or by paying a total of $8,021.75;and this was a difference or savings on these claims of $13,000.48;however,the assets in the estate were not sufficient to do this, and Mrse Betty R.Hollifield had to obtain a loan on her home in Troutman,North Carolina,and advance some of her insurance money. That as far as the Administratrix knows,all debts,claims,and cost of administration have been fully and completely discharged by payment in full,or by compromise and settlement as herein set forth,concerning those in Item 26 of this Final Settlement. All debts and claims of which the Executor had any knowledge or 36 information,or which have been filed with him in any way or manner,have been paid in full. 4e The Executor made and filed an inheritance tax return with the North Carolina Department of Revenue,but there was no tax due thereon. 5.There was no income in the estate during the period of administra- tion,and there was no necessity to file an income tax return. 6.The only real estate was the home and lot in the Town of Troutman, North Carolina,and this was deeded to E.W.Hollifield and wife,Bessie Holli- field by deed recorded in Deed Book 214,page 7,Iredell County Registry,and was owned as an estate by the entirety,and under the laws of the State of North Caro- lina,became the property of the widow,Bessie Hollifield,in fee simple,upon her being the survivor. 7,There was a joint savings account in the Merchants and Farmers Bank of Statesville,Inc.,!routman Branch,in the name of Mr.or Mrs.E.We Hollifield,and by written instrument attached hereto,irs.Ee W.Hollifield (Mrs.Bessie Hollifield)transferred and assigned said account in full to the Executor for the purpose of paying the debts and cost of administration in the estate;and the aforesaid account,which was in the amount of $1,311.68,in- cluding accrued interest,was used for the purpose of paying the debts and cost of administration,except the sum of $127.94,which was used to pay certain items and things for the benefit and use of Mrs,Bessie Hollifield,and this is shown in this report;and this transfer and written assignment is attached hereto marked Exhibit "A". “A M “A PI P U H I O H 9S 6 1 8.Commissions which the law allows to the Executor would amount to approximately $130.00;however,it will be noted that the Executor has only taken as commissions $9.79;and the Executor agrees that his commissions are waived, and the money that would go to him as commissions was used herein to pay items for the use and benefit of Mrs.Bessie Hollifield in the sum of $127.94 as shown herein. 9.The household and kitchen furniture in the estate belong to the widow,Bessie Hollifield. 10.The deceased did not have any life insurance and did not own any bonds,shares of stock,and neither did he own an automobile.All property which the deceased owned has been referred to herein and accounted for.No per- sonal effects,such as watches and things of that nature,came into the hands of the Executor,and he understands that before he qualified as Executor,these items were distributed among the children. ll,There was no money or property in the estate with which to place a monument of any kind to the grave of E.W.Hollifield;however,the children are now contemplating the purchase of a monument,and when same is purchased, they will individually pay for the same.
