Holstead died on the 30th day of January, 1962 leaving surviving as her only heirs at law, Lula P. Rodgers, a sister, and three (3) children of a deceased sister, namely, W. Bonner Knox, Eva Knox Mitchon, and Louise Knox Morse. Lula P. Rodgers died after the death of Neill P. Holstead. All personal property in this estate was sold in order for a satisfactory distribution to be made. The above distributees now own an undivided interest in a house and lot on North Broad Street in the Town of Mooresville, North Carolina, formerly owned by Neill P. Holstead. tii. That before making said distribution the undersigned paid all debts of the deceased presented to him or of which he had knowledge, paid all inheritance and estate taxes and all costs of administration. Notwithstending the limitetion over at her death, I do hereby declare that it is my intention by this will to expressly authorize and empower my said wife, during her lifetime, in the event that, in her sole discretion, it should seem necessary for her to do so, to sell any or all of the above property and by instruments, to convey the absolute title and ownership of the personal property end the fee simple title as to real estate and to use and con- sume, if necessary, for her comfort and care, hospitalization and medical care, in her lifetime, the proceeds of any such sales, without accounta- bility, but if she does not elect to dispose of the fee in said property during her lifetime for the purposes aforesaid, then at her death what- ever remains is to ve divided as herein set out.’ The recital by my said wife in a deed or bill of sale that it is necessary and advisable for her to sell the property therein referred to for the purpose of providing "for her comfort and support, hospitalizgtion and medical care" shall be sufficient and adequate in law to assure to any purchaser in such deed the fee simple title as to real estate or the absolute ownership as to any personal property thereby conveyed.
