That in order to carry out the wishes of the late Eunice Moose Hoover, her six children and only heirs at law executed deeds among themselves to the real estate owned by the late Eunice Moose Hoover on the Airport Road in order that Gordon Hoover receive the nine (9) acres referred to in Item 4 of the Last Will and Testament of Eunice Moose Hoover and Hilda Hoover Deal would receive the seven (7) acres nin Paragraph 3, and the other four children receive the balance of the real estate. VI That before making said distributions, the undersigned Executor paid all debts of the deceased presented to him of which he had any knowledge; filed an inheritance tax return and paid all inheritance tax shown thereon to be due the North Carolina Department of Revenue and paid all other charges against said estate. He shall also return to the clerk. on oath within three months after each sale made by him, a full and itemized account thereof. which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42. Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court. an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit. He must produce vouchers for all payments. The clerk may examine, on oath, such ac- counting party, or any other person, concerning the receipts, disbursements, or any other matters relating to the estate; and having carefully revised and audited such account, if he approve the same, he must endorse his approval thereon. which shall be deemed prima facie evidence of correctness. TO C.G.SMITH, CLERK OF SUPERIOR COURT OF IREDELL COUNTY: The undersigned Executors of the Estate of J.I.Hoover respectfully show to the Court: l. That they have completed all matters in the administration of the aforesaid estate except there is in the estate a note executed by Z.V.Johnston and Kate Hoover Johnston, upon which there is a balance due of between $300.00 and $400.°9; that Kate Hoover Johnston is dead and her estate is insolvent, and Z.V.Johnston does not have sufficient property out of which the note can be collected; that they are attempting to work out a compromise with Z.V.Johnston on the aforesaid note. 2. That the debts have been paid and there will be nothing to distribute to the heirs. 3. That unless they can get a compromise settlement on the aforesaid note the attorneys will not receive but very little compensation for their serviees, and the Executors will but very little. Wherefore the undersigned Executors of J.I.Hoover pray the Court to grant them an extension of time in which to file their final settlement, and pray that they be granted until October 15th, 1938.
