JUNE 7, 2005
The Iredell County Board of Commissioners met in Regular Session on
Tuesday, June 7, 2005, at 7:00 p.m., in the Iredell County Government Center
(Commissioners' Meeting Room), 200 South Center Street, Statesville, NC.
Present were:

Vice Chairman Williams declared the meeting to be in a public hearing.
Comments Regarding the Proposed FY 2005-06 Iredell County Budget
Harry Tsumas, the Vice Chairman for the Greater Statesville Development
Corporation (GSDC), read a letter explaining a strategic planning project. The letter
indicated an assessment of the GSDC was planned to ensure that economic efforts were
being done in a thorough and complete manner. Tsumas said a key element in the
process would be to focus on existing industry assistance, along with (1) targeting
marketable areas (2) obtaining collateral marketing materials (3) achieving GIS
integration with the city and county networks, and (4) continuing with lobbying efforts
at the state level. Mr. Tsumas requested a one-time funding of $50,000 to provide
"seed" funds for the strategic plan.
Amy Eisele, spoke on behalf of the Exchange Club's Stop Child Abuse Now
(SCAN) Program. Eisele said the program had existed since 1987, and its purpose was
to work with families in an effort to stop child abuse. Mrs. Eisele said an additional
$1,000 had been recommended for the program during 05-06, but she was asking for an
extra $1,610 which would make SCAN's full appropriation at $5,000.
Gary Thomas, the Chairman of the Iredell Museums, Inc., said an
appropriation of $10,000 had been requested and $6,000 had been recommended.
Thomas said the former Children's Museum and the Arts and Science Museums had
merged to represent a "more centralized and efficient" program along with an effort to
raise funds for the arts. He said three sites (heritage site, children's museum, and the
Court Street Gallery) were open to the public. Thomas said 18,000 people, mostly
students, were served last year. He said Catawba County planned to give $1 per capita
to the arts. Thomas asked for the museum's appropriation to be increased to the
requested amount of $10,000.
Staff Sgt. George Campbell with the National Guard Armory requested
additional funding. He said there were plans to move the guard's headquarters from
Lincoln County to Iredell County. Campbell said the Statesville unit provided space,
when needed, for the social services department, the elections department, SCAN, and
the state department of transportation. He said the unit was a state facility; however, the
only items funded by the state were office supplies. Campbell asked for the unit's
annual appropriation to be increased from $1,000 to $2,000.
Commissioner Robertson said he was not aware of any requirements for the
county to fund the national guard.
County Manager Mashburn said there was a lengthy history in North Carolina of
funding being provided. He said that in 1988, when he first started work in Iredell
County, the local national guard unit was funded at $300 a year. Mashburn said Iredell
County currently funded the Statesville guard unit $1,000 and the Mooresville facility
$1,000 a year.
Campbell acknowledged the state maintained Statesville's facility, but he said
the local money would be used for "reaction" time. He said, at times, it took several
months before money was obtained from the state. Campbell said the increase from
$300 to $1,000 occurred in 2000, and it had not increased since then.
Staff Sgt. Kim Chambers said that if a disaster occurred in the county, for
example, a nursing home facility recently caught on fire, and the guard brought in a
generator and assisted with the patients, the guard's resources were used.
Donnie Perry, Chief of the Iredell County Rescue Squad, thanked the board
members for the proposed funding for FY 2005-06.
Beth Carter, Fort Dobbs Alliance Site Manager, said she and Chandler Bryan
(Chairman of the Alliance) were present to answer any questions about the requested
funding of $5,000 for the upcoming year.
Commissioner Robertson asked if there had been any new developments with
the state pertaining to land acquisitions.
Carter said the Alliance continued to pursue avenues of support for the land
acquisition. She said anonymous donors were being pursued as well as state grants.
No one else desired to speak, and Vice Chairman Williams adjourned the
hearing.
Commissioner Robertson asked Finance Director Blumenstein how much
additional funding would be needed for the two national guard units if the extra amount
were based on inflation. He said inflation had been running a little less than five
percent, and the guard's appropriation had not increased in five years.
Blumenstein said between $1,250 to $1,300.
OTION by Commissioner Robertson to appropriate $1,250 to the Statesville
National Guard Unit and $1,250 to the Mooresville National Guard Unit for FY 2005-
06.

Rezoning Request; Peggy Abernathy & Chris C. Cartner Property, Case
No. 0505-1 from R-20, Single Family Residential Zoning District to General
Business Zoning Location: Planning Supervisor Steve Warren explained the
following staff report for a rezoning request from Christopher Cartner and Peggy
Abernathy:

Directions: Highway 64 east, left on Old Mocksville Road, on the left.
REQUESTED ACTION AND CONDITIONS: Rezone the properties from R-
20, Single -Family Residential Zoning District to GB, General Business Zoning
District.
PROPOSED USE: Continue existing landscaping business and adding
automobile sales at 429 Old Mocksville Road. No proposed uses for 415 Old
Mocksville Road.
SIZE: The total acreage is 7.55 acres.
EXISTING LAND USE: Non -Conforming Commercial
SURROUNDING LAND USE: Residential, commercial, and vacant
WATERSHED REGULATIONS: The property is not located in a watershed.
TRAFFIC: The capacity for this stretch of Old Mocksville Road is 9,000
vehicles per day. In 2003, the estimated daily traffic count was 3,800 vehicles
per day. Rezoning the property would likely increase the traffic along this
stretch of Old Mocksville Road. However, the possible impacts would not
bring the road close to the maximum carrying capacity.
ZONING HISTORY: This property has been zoned R-20 since County -wide
zoning went into effect in 1990. On March 21, 2002, the Board of Adjustment
approved a change of non -conforming use to allow Mr. Cartner to operate his
landscaping business at this location. Later, Mr. Cartner decided he also wanted
to sell automobiles on this lot and requested a rezoning. At that time, staff
became aware of two buildings on the lot that were built without permits and in
violation of the County's setback and expansion of non -conforming use
requirements. Staff recommended that Mr. Cartner bring the buildings into
compliance before submitting a rezoning request. Mr. Cartner did not want to
move the buildings and applied for a variance so they could remain in place.
On May 20, 2004, the Board of Adjustment denied a variance on the setbacks
for the two buildings. The inclusion of the Abernathy property in the request
and the purchase of property to the north have brought the buildings into
compliance as far as setbacks. Rezoning the property will eliminate the
violation of the expansion of non -conforming use requirements as well.
STAFF COMMENTS: There seems to be a trend towards commercial uses in
the area. Rezoning the property will also eliminate a non -conforming use. The
County Land Use Plan recommends for transitional uses in this area, which
includes commercial and lower intensity light industrial uses. Therefore, staff
recommends in favor of this request.
PLANNING BOARD RECOMMENDATION: On May 4, 2005, the Planning
Board unanimously recommended in favor of this rezoning request, by a vote
of 9-0.

Rezoning Request; Fred E. Frye Heirs Property, Case No. 0505-2 from
Residential Agricultural to Residential Office Zoning District: Planning Supervisor
Steve Warren explained the following staff report presented on behalf of applicants

LOCATION: 1228 Turnersburg Highway, more specifically identified as
PIN# 4757-41-7954. Directions: 1-77 north to exit 54, turn right onto Highway
21 north/Turnersburg Highway, property on the right.
REQUESTED ACTION AND CONDITIONS: Rezone a portion of the
property from RA, Residential Agricultural Zoning District to RO, Residential
Office Zoning District.
PROPOSED USE: 5,000 to 8,000 square foot office building for Ryan
Newman Foundation Inc., Ryan Newman Motorsports Inc., and Ryan Newman
Transportation LLC.
SIZE: The total parcel is 126.9 acres. The portion requested to be rezoned is
21.41 acres.
EXISTING LAND USE: Residential
SURROUNDING LAND USE: Residential and vacant
WATERSHED REGULATIONS: The property is not located in a watershed
TRAFFIC: The capacity for this stretch of Turnersburg Highway is 7,000
vehicles per day. In 2003, the estimated daily traffic count was 10,500 vehicles
per day. Rezoning this property for the use as requested would not likely
increase the traffic along this stretch of Turnersburg Highway.
ZONING HISTORY: This property has been zoned RA since County -wide
zoning went into effect in 1990.
STAFF COMMENTS: There are other commercial uses close by, including the
regional Department of Transportation facility. A church is located across the
highway and another is in the process of construction on an adjacent property.
Rezoning this property to RO would create a transitional barrier between the
commercial uses and the church uses. The use requested will not generate a lot
of additional traffic in the area. The County Land Use Plan recommends for
residential uses, so the RO zoning still fits within the plan of development.
Therefore, staff recommends in favor of this request.

PLANNING BOARD RECOMMENDATION: On May 4, 2005, the Planning
Board unanimously recommended in favor of this rezoning request, by a vote
of 9-0.
Grant Miller with Southeast Commercial Real Estate, announced he was present
if anyone had questions.

MOTION by Commissioner Norman to approve the rezoning request of Case
No. 0505-2 (Fred E. Frye Heirs Property) from Residential Agricultural to Residential
Office Zoning District.

Vice Chairman Williams declared the meeting to be in a public hearing.
Proposed Amendment to the Iredell County Subdivision Ordinance -
Section 405.7.I, Curb & Gutter — Stormwater: Subdivision Administrator William
Allison said the commissioners, at the Winter Planning Session, had discussed
stormwater problems and related issues. He said since that time, the staff had studied
the issue and determined that a large portion of the problem was from curb & gutter
development and the water that funneled through them Mr. Allison said the staff had
tried to focus on what could be done to limit the water problems and the impact on
adjoining properties. He said that on May 4, 2005, the planning board voted (5-4) in
favor of an amendment to the subdivision ordinance to address the problem. Allison
said subdivisions having 25 or more lots having a topographical need would have to
comply with the ordinance. (Originally, the amendment had 50 lots.)
The proposed amendment is as follows:
Amend: Section 405.7.1 (Curb & Gutter)
1. Curb & Gutter
When a proposed subdivision exceeds -50 25 lots, where there is a topographic need (such as
steep slopes) and a public benefit will be realized, or where an adjoining subdivision already
has curb and gutter in place, the Committee may recommend to the Subdivision Administrator
where curb and gutter (designed in accordance with NCDOT specifications) shall be required.
This provision shall no! aff ly to any proposed subdivision that lies within any, one ofthe loea
water sapp4, watersheds as designated in the Iredell County- �,catenshed Proieetimi Ordinance
-i h .. etkw , s, r., .. .. ete.Curb and gutter development shall only, be permitted
when 50% or more of the stormwater run-off is discharged into an on-site perennial or annual
stream as determined by the most recent version of the US.G.S. topographic maps. No run-off
may directly discharge into Lake Norman, Lookout Shoals Lake, or the Catawba River. In
addition, the developer or his agent shall submit a surface water drainage plan, as drawn by a
design professional, containing topography and depicting the natural drainage of the property
prior to development.
No one else desired to speak and Vice Chairman Williams adjourned the
hearing. Mr. Williams announced that the board had chosen to delay action on the curb
and gutter/stormwater amendment until the June 21 meeting.
Request from the City of Statesville for the County to Pay $23,799 in
Conjunction with an Engineering Recommendation for the Statesville Regional Airport's
Sewer Line to be Increased from 12 to 15 inches in Diameter: Statesville City
Manager Rob Hiles said a 12 inch gravity line had been designed to carry sewer from a
lift station on Third Creek approximately 3,500 feet to a point where an 8 -inch line was
installed. He said the smaller line (8 inch) carried the sewer in/around the airport back

to the 15 -inch line. Rites said the 8 -inch line was also connected to a lift station on the
backside of the airport that served the back creek basin. He said through a combination
of topography and a force main, the back creek lift station was capable of carrying over
a million gallons a day and would service the entire Old Mountain Road area to the
interstate. Rites said that, in addition, the 3,500 linear foot section at 12 inches was
designed to handle not just the airport effluent of a million gallons, but also the
extension of Third Creek, which could, theoretically, carry gravity sewer all the way to
the Town of Taylorsville. He said several of the property owners had asked if the 3,500
section of 12 -inch line was large enough. He said W.K. Dickson, the engineering
company working on the project, at the request of the city, remodeled the entire basin
and evaluated the potential users. Rites said the engineers felt that expanding the line to
15 inches was advisable due to it then creating a two million a day flow. He said this
would allow one million gallons to flow all the way to Old Mountain Road and one
million to flow along the Third Creek Basin out to I-40. Rites said the enlargement
would open up a large area for economic development as well as to assist any residents
with failing sewer systems. He said it was less expensive, at this point in time, to
modify the project, and the Statesville council was recommending the change with the
city and county splitting the costs.
Commissioner Johnson said the project had changed several times in scope. He
encouraged the $23,799 expenditure due to the potential commercial and industrial
development (towards Highway 90).
Commissioner Norman asked if the county would see a good return on the sewer
investment.
Rites said the city council recently approved two leases with Dale Earnhardt, Jr.,
and Darrell Waltrip at the Statesville Airport for aircraft worth over ten million dollars.
He said the two aircraft hangars would be connected to the new sewer line.
Commissioner Robertson noted that this still could have occurred with the 12 -
inch line.
Rites said, "The whole county is a moving target, and when you deal with a
project that lasts one or two years, it shouldn't be surprising that requests are made for
changes." He said, "The county is experiencing growth, and change is the nature of the
world in which we live."
Commissioner Robertson emphasized that the area should be built up either in
commercial or industrial development since residential uses did not make that much of
an impact on the tax base.
Commissioner Johnson mentioned that major deals were being reported by the
media, but the $2 or $3 million projects were not receiving much press.
Rites said the Mooresville economic developer was marketing the Statesville
airport right along with the industrial sites in Mooresville.
OTION by Commissioner Johnson to approve Budget Amendment 450A in
the amount of $23,799 to be derived from contingency to pay one-half of the costs
associated with the enlargement of the Statesville Regional Airport's sewer line from 12
to 15 inches.

Request for a Discussion/Directive Regarding Medicaid Legislation in the
General Assembly: County Manager Mashburn said the 1997 allocation for Medicaid
was $2,546,803 compared to the proposed 2006 budget of $6,176,565. He said that
from 1997-2006 the county will have spent $35,266,842 in Medicaid, and
unfortunately, the county did not have any options in the matter -- the funds had to be

appropriated. Mashburn said there was a legislative (House) proposal to cap all
counties' cost at the 2004-05 levels, plus two percent.
Vice Chairman Williams said he felt the public was becoming more sympathetic
towards the counties regarding the Medicaid problem. He said North Carolina was the
only state that continued to force the counties to contribute to Medicaid, plus North
Carolina had some of the better benefits. Mr. Williams urged the board members to
lobby the legislators to seek Medicaid relief.
Commissioner Johnson said in 1997 dollars, the $35 million would have built one high
school, one middle school, and better than half of an elementary school.
Commissioner Robertson said no one had been able to explain to him why North
Carolina had some of the highest income taxes in the nation, but the state government had to
raid the counties' funds to balance its books.

2. Request from the Iredell-Statesville Board of Education for Approval of a
Resolution in Conjunction with the Financing/Refinancing of Mobile Classrooms:
During the briefing session, Iredell-Statesville Schools Finance Officer Kay Fulp and
Maintenance Director Dr. Kenny Miller requested approval of a resolution that was
needed to fulfill the requirements for a financing and refinancing of mobile classrooms.
Miller said the school system currently had 163 units, and the system wanted to
refinance 73 of them. He said the system owned 13 units, but only six were used for
classrooms. Dr. Miller said the others were used for storage.
The system submitted the following request for the transaction.

3. Request from the Sheriff's Department to Add Five Additional Vehicles to
the Law Enforcement Fleet: (see briefing minutes for explanation)
4. Request from the Sheriff's Department for Approval of Budget Amendment
#51 to Recognize Receipts ($18,000) from Federal Equity Sharing Funds and to
Appropriate for Additional Costs Relating to Fingerprint Equipment: Chief Deputy
Dowdle said during the five o'clock meeting that grant money was previously approved
to purchase fingerprint equipment. He said the equipment had been delayed; however, it
was now available and the $18,000 was needed for the $32,369 purchase.
5. Request for Approval of Budget Amendment #52 to Recognize Discretionary
Funds ($3,000) Received from the Department of Juvenile Justice and to
Appropriate the Funding (pass-through) to Project Challenge: Finance Director
Susan Blumenstein said during the briefing session that the state department of juvenile
justice had appropriated $3,000 in additional funding (pass-through) for the Project
Challenge restitution program. She said no funds were needed from the county.
6. Request for Approval of Budget Amendment #53 for $455,168.55 & to
Recognize Public School Building Capital Funds for a Mooresville Graded School
District Land Purchase: Finance Director Blumenstein said at the 5 o'clock meeting
that the Mooresville Schools desired to apply for $455,168.55 in public school building
capital funds as a reimbursement for part of the $2,504,981.17 purchase price for 100
acres of land. She said that once approved by the Department of Public Instruction, a
reimbursement check would be submitted to the Mooresville unit. Blumenstein said a
budget amendment was needed to recognize the grant and to forward the funds to the
school system.
7. Request for Approval of Bids for the Iredell County Revenue Center (Old
Library Bldg.) & Approval of an Amended Capital Project Fund for the
Renovations: Support Services Director Jim Vernon along with Architect Chuck
Goode said bids were opened on May 26, 2005 for renovations on the former library
building. Vernon said the low bid was from Granger Construction at $954,000.00, and
the staff recommended the awarding of the contract to this company. He said references
had been checked, and everything was in order for approval of the bids.
Goode said multi -prime bids could not be used. He said this was due to no
plumbing companies being interested in the project. The bids are as follows:

Section 3. This Capital Project Fund shall continue until the project is complete.
Section 4. Payments from this Capital Project Fund shall be authorized by the County
Manager or his designee.
Section 5. Any funds remaining at the completion of the renovation shall be returned to the
Capital Reserve Fund.
This Amended Project Ordinance is effective upon adoption.
8. Request for Approval of a Resolution Authorizing the Sale, by Public
Auction, of Surplus Personal Property: During the agenda briefing, Finance Director
Blumenstein requested approval of a resolution authorizing a surplus property sale on
June 25, 2005. The resolution is as follows:
WHEREAS, the County of Iredell has possession of the following items of
personal property which are surplus to its needs and desires to dispose of same.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of
Iredell County, that Dean A. Lail, Purchasing Agent, pursuant to the provisions of G.S.
160A -270(b), is hereby authorized to dispose of the listed personal property at public
auction for cash or good check, and said Purchasing Agent is further authorized and
directed to execute the necessary functions associated with this sale.

9. Request for Approval of a Resolution for the Purpose of Donating 50 Surplus
Computers to the Statesville Housing Authority for After -School and Summer
Programs: County Manager Mashburn explained during the briefing session that
Customer Development Coordinator Rudy Davis with the Statesville Housing Authority
had requested the donation of 50 surplus computers to be used for after-school and
summer programs in south Statesville.
The following resolution was approved for this request.
RESOLUTION AUTHORIZING THE TRANSFER OF
CERTAIN SURPL US PERSONAL PROPERTY
WHEREAS, the County of Iredell has possession of the .following items of personal
property which are surplus to its needs and desires to dispose of same.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Iredell
County that the listed items of personal property be transferred by donation to the Statesville
Housing Authority, a governmental agency, to be put to only public use and to support the
establishment of after-school and summer programs for youths. Dean A. Lail, purchasing Agent,
pursuant to the provisions of G.S. 160A-274 is hereby authorized to conduct any actions required
to convey this property.

APPROVAL OF FY 2005-2006 IREDELL COUNTY BUDGET: Commissioner
Johnson noted that the only changes occurring out of the budget's public hearing were the
increases for the two national guard units.
County Manager Mashburn said the proposed budget included a 20% increase for
Medicaid over last year. He said other notable increases were for the schools and emergency
services. He said 38 new positions were in the budget, there was funding for
reclassifications, and for a modified merit plan. Mashburn said the tax rate was
recommended to remain at $.435.
Finance Director Blumenstein mentioned that it was recommended for the Mt.
Mourne Fire tax rate to be increased from 3¢ to 3.5¢.
Vice Chairman Williams said the county was not raising the property tax, and the
board members in previous years had learned how to be conservative. Williams said he
could remember when there had to be a freeze on capital purchases. He said that during
those "lean" years, neighboring counties borrowed money to make the purchases, and one of
the counties now planned to raise taxes by ten cents. Williams said that particular county's
debt service was $23 million compared to Iredell's nine or ten million. Additionally, he said
the county he was talking about was concerned about raising taxes just to pay the fund
balance. Mr. Williams said that during FY 2005-06, the commissioners would be doing
more for the schools than at any other point in time since he had been on the board of
commissioners.
MOTTO by Commissioner Johnson to approve the FY 2005-06 budget as
presented by the staff along with the increases for the two national guard units.

Section 3. There is hereby levied a tax rate of $ .435 per One Hundred Dollars
Valuation of property listed for taxes as of January 1, 2004. Total property valuation

Section 8. In order to carry out their duties, copies of this Budget
Ordinance shall be furnished to the County Commissioners, the Finance Officer,
and the Clerk to the Board.
Section 9. The Budget Officer is hereby authorized to transfer
appropriations within a fund as contained herein under the following conditions:
(a) The Budget Officer may transfer amounts between objects of
expenditure within a department except that no transfers shall be

made into or out of salaries without approval by the Board of
County Commissioners.
(b) The Budget Officer may transfer amounts up to $10,000 between
departments of the same fund with an official report on such
transfer at the next regular meeting of the Board of Commissioners.
(c) The Budget Officer may transfer amounts into the salary accounts
of any department in order to effect merit increases from funds
appropriated for that purpose by the Board of Commissioners.
(d) The Budget Officer may transfer amounts between the departments
operated under the authority of the Sheriff of Iredell County.
(e) The Budget Officer may expend up to $100,000 for emergency
needs when the chairman has declared a state of emergency.
Section 10. Iredell County officials and employees will be reimbursed at
a rate equal to the IRS mileage reimbursement rate for authorized travel on
behalf of the county.
Section 11. The Board of County Commissioners hereby authorizes the
Iredell County Tax Collector to collect taxes for the City of Statesville, Town of
Mooresville, Mooresville Graded School District, Town of Harmony, Town of
Love Valley, and Town of Troutman, in compliance with contracts adopted by
the respective two governing boards. A charge of one and one-half (1 %)
percent of all taxes collected for the taxing districts will be payable to Iredell
County for the collection services.
Section 12. The 2005-2006 tax rates for the fire districts are levied as
follows:
Shepherds 5.00 cents per $100 of valuation
Mt. Mourne 3.50 cents per $100 of valuation
East Alexander 5.00 cents per $100 of valuation
County -wide 5.00 cents per $100 of valuation
The estimated collection rate for the four fire districts is as follows:
County -wide 95.41 %; East Alexander 92.42%; Mt. Mourne 98.11 %; Shepherds
95.72%.
Fiscal year 2005-2006 property valuations within the fire tax districts for

Section 14. The Board of Commissioners hereby agrees to contract with
existing volunteer fire departments in Iredell County to furnish fire protection to
the Shepherds, Mt. Mourne, Iredell, and East Alexander Fire Districts. The
County Finance Officer is instructed not to release funds to the departments
unless an executed contract is on file for each individual fire department.
Section 15. The 911 Emergency Telephone System Fund was
established as a self-supporting special revenue fund on July 1, 1991. Revenues
are provided to the fund from fees added to monthly telephone bills. The 2005-
2006 fee is established at $ .43 per telephone line. It is estimated the following
revenues will be available for the fiscal year beginning July 1, 2005 and ending
June 30, 2006.

Section 20. The Parks Reserve Special Revenue Fund is established to
accumulate funds for the purchase and development of land, construction of
parks, and purchase of equipment. Funds will be provided by operating
transfers from the General Fund, contributions, and interest on investments. The
operating transfers are subject to annual appropriation by the Iredell County
Board of Commissioners. All projects funded from this Special Revenue Fund
are subject to approval by the Board of Commissioners and will be accounted
for in a Capital Project Fund. The total accumulated in this Special Revenue
Fund will be divided equally between the four quadrants of the County for
recreation and parks projects. Up to $10,000 of each quadrant's share may be
used for planning costs.
