REGULAR MINUTES
JUNE 6, 2006
The Iredell County Board of Commissioners met in Regular Session on
Tuesday, June 6, 2006, at 7:00 P.M., in the Iredell County Government Center
(Commissioners' Meeting Room), 200 South Center Street, Statesville, NC.
Present were:

ADJUSTMENTS OF THE AGENDA: OTION by Chairman Tice to
approve the following agenda adjustment.
Deletion: Due to Retiree Jim Vernon being unable to attend the meeting, the
presentation of an appreciation plaque to him was postponed.

APPOINTMENT BEFORE THE BOARD
Presentation from Bill Brater Regarding the Donation of a Monument to be
Situated at the Hall of Justice in Commemoration of World War If Veterans:
Brater said monuments honoring veterans of WWI, and the Vietnam/Korean Conflicts
or Wars were located at the Hall of Justice; however, there wasn't a memorial for WWII
service personnel. Mr. Brater offered to donate a five -and -a -half foot, grey -granite
monument with the following inscription: "To Honor and Remember Those Who Gave
their lives in World War II." He said the names of the veterans would also be included.
MOTION by Commissioner Williams to (1) accept the donation from Mr.
Brater and (2) allow the placement of the monument at the Iredell County Hall of
Justice (front lawn) on the site as depicted in a sketch by the Support Services Director.
VOTING: Ayes — 5; Nays — 0.
PUBLIC HEARINGS
Chairman Tice declared the meeting to be in a public hearing.
Consideration of an Economic Development Incentive for BSI Balance
Systems: Greater Statesville Development Corporation Interim Director Terry Orell
said BSI Balance Systems, also known as the Amesbury Group, planned an expansion
with a total investment of $7,411,000 (equipment @ $1,211,000 & new building @
$6,200,000). Orell said the manufacturing company, located in the Keith Corporate
Park, across from the LazyBoy Company, was requesting an incentive of $128,951. He
said the company currently employed 220, and 50 new jobs would be created.
No one else desired to speak, and Chairman Tice adjourned the public hearing.
OTIO by Commissioner Johnson to grant the $128,951 incentive, over a five-
year period, based on the $7,411,000 investment by BSI Balance Systems.
VOTING: Ayes — 5; Nays — 0.

Consideration of an Economic Development Incentive for the Hexcel
Corporation: Greater Statesville Development Corporation Interim Director Terry Orell
said the Hexcel Corporation planned to expand by relocating a segment of its operation
from Georgia. He said Hexcel, the manufacturer of fiberglass boards for the electronics
industry, planned on creating 60 new jobs and the expansion investment would be $3.9
million. Orell said the company had requested a $67,860 incentive.
No one else desired to speak, and Chairman Tice closed the public hearing.
OTIO by Commissioner Robertson to grant the $67,860 incentive, over a
five-year period, based on the $3.9 million investment by the Hexcel Corporation.
VOTING: Ayes — 5; Nays — 0.

Consideration of an Economic Development Incentive for the JC Penney
Corporation: Greater Statesville Development Corporation Interim Director Terry
Orell said the JC Penney Corporation had initiated a nationwide search for the
relocation of another facility. He said Statesville had been chosen, due to the location
and performance of the existing plant, for an automatic conveyor sorting and coding
system. Orell said the company had asked for a $68,730 incentive based on a capital
investment of $3.95 million. He said the company employed over 1,000 people, but the
expansion would not add any new jobs.
No one else desired to speak, and Chairman Tice closed the public hearing.
MOTION by Commissioner Norman to grant the $68,730 incentive, over a
five-year period, based on the $3.95 million investment by the JC Penney Corporation.
VOTING: Ayes — 5; Nays — 0.

Consideration of an Economic Development Incentive for Merchant Metals:
Greater Statesville Development Corporation Interim Director Terry Orell said Merchant
Metals had been a manufacturing presence in Statesville for the past 24 years. He said
the chain link and wooden -fence company was planning a $2.8 million expansion. Orell
said the company presently employed 85 people, and 30 new jobs would be created. He
said the company was seeking an incentive of $48,720.
No one else desired to speak, and Chairman Tice closed the public hearing.
MOTION by Commissioner Williams to grant the $48,720 incentive, over a five-
year period, based on the $2.8 million investment by the Merchant Metals Company.
VOTING: Ayes — 5; Nays — 0.

Consideration of a Closeout Report on Iredell County's 2003 Community
Development Block Grant for Economic Development Associated with the Millard
Company Project: Deputy County Manager Susan Blumenstein said a closeout report
for the county's 2003 CDBG had been prepared for the Millard Refrigerated Services
Company project. She said $240,000 in grant monies had been received and expended,
and the funds were about 22% of the total project ($1,098,310). She said 30 jobs were
created, and at least 60% of them were being held by persons of low or moderate income.
No one else desired to speak, and Chairman Tice closed the public hearing.
MOTION by Commissioner Norman to approve the submittal of the certificate of
completion documents relating to the 2003 CDBG (Economic Development) project for
the Millard Refrigerated Services Company.
VOTING: Ayes — 5; Nays — 0.

Consideration of the Iredell County Fiscal Year 2006-2007 Budget: Five
persons spoke and they were as follows:
• Lorraine Hill, the director of The Counseling Center, thanked the board members for
the $26,885 appropriation in the proposed budget. She said "much upset" was occurring
in North Carolina mental health agencies; however, The Counseling Center had provided
continuous and stable care.
• Jay Lewis, representing the HealthReach Community Clinic (formerly the
Mooresville -South Iredell Health Assistance Program) said a $15,000 request had been
submitted for 2006-07, but the county had recommended an appropriation of $1,500.
Mr. Lewis asked for the full amount of $15,000. He said last year, the clinic had
provided medical, dental, or pharmacological services for over 1,600 people, and over
2,000 would probably be assisted in the new year.
• Harry Tsumas, Vice Chairman for the Greater Statesville Development Corporation
Board of Directors, thanked the commissioners for past and present financial support.
He said June 15 was the cutoff date to receive applications from candidates seeking the
Director of Economic Development position.
• Chandler Bryan, representing the Fort Dobbs Alliance, said past funding had been
used for educational programs. He said the Alliance had requested $10,000; however,
$5,500 had been recommended. Bryan asked for the full $10,000.00, and he said the
funds would again be used for school age educational programs. In addition, he said
professors with Wake Forest University were assisting with an archaeological
excavation, and on June 16, 2006, the public would be invited to participate in an artifact
"dig."
• Ken Jurney, a resident of the B & F Fire District, encouraged the board to increase
the fire tax by 1%. Jurney said the fire departments could use the additional funds to
become better equipped, and this would lower the insurance ratings along with
decreasing the homeowners' insurance costs. He said in his particular district, his
insurance costs could be lowered by $300 a year, if the fire department could achieve a 6
fire rating. Mr. Jurney said the time to act was now, or before the GIS was implemented
in fire management. He said the fire chiefs would be presenting six -mile insurance
districts, created with the GIS coordinates in the near future.
No one else desired to speak, and Chairman Tice adjourned the hearing.
MOTION by Commissioner Robertson to restore the full funding of $10,000 for
the Fort Dobbs Alliance in the FY 2006-07 budget.

MOTTO by Commissioner Norman to increase the HealthReach Community
Assistance Clinic's (formerly Mooresville -South Iredell Health Assistance Clinic)
appropriation by $3,500 for a total of $5,000 in the FY 2006-07 budget.

OTIO by Commissioner Norman to incorporate the two revisions into the FY
2006-07 Budget and to adopt the ordinance in its entirety as follows:

Section 3. There is hereby levied a tax rate of $ .465 per One Hundred Dollars
Valuation of property listed for taxes as of January 1, 2006. Total property valuation
for ad valorem tax purposes for the 2006-2007 fiscal year is estimated to be
$15,084,650. The tax collection rate for fiscal year 2006-2007 is estimated to be
96.94%.
Section 4. Schedule B taxes shall be levied in accordance with the North
Carolina Revenue Act.
Section 5. All ABC — 5 cents Bottle Tax Revenues received from Code 347-01
of the 2006-2007 General Fund Revenues are hereby designated to support the County's
2006-2007 appropriation to Crossroads Behavioral Healthcare designated for alcoholic
rehabilitation programs.

Iredell County Board of Commissioners hereby reserves $250,000 of
Undesignated Fund Balance of the General Fund for Mitchell Community College
Capital Outlay in addition to 2006-07 appropriations.
Section 8. In order to carry out their duties, copies of this Budget Ordinance
shall be furnished to the County Commissioners, the Finance Officer, and the Clerk to
the Board.
Section 9. The Budget Officer is hereby authorized to transfer appropriations
within a fund as contained herein under the following conditions:
a) The Budget Officer may transfer amounts between objects of expenditure within
a department except that no transfers shall be made into or out of salaries
without approval by the Board of County Commissioners.
b) The Budget Officer may transfer amounts up to $10,000 between departments of
the same fund with an official report on such transfer at the next regular meeting
of the Board of Commissioners.
c) The Budget Officer may transfer amounts into the salary accounts of any
department in order to affect merit increases and reclassifications from funds
appropriated for that purpose by the Board of Commissioners.
d) The Budget Officer may transfer amounts between the departments operated
under the authority of the Sheriff of Iredell County.

e) The Budget Officer may expend up to $100,000 for emergency needs when the
chairman has declared a state of emergency.
Section 10. Iredell County officials and employees will be reimbursed at a rate
equal to the IRS mileage reimbursement rate for authorized travel on behalf of the
county.
Section 11. The Board of County Commissioners hereby authorizes the Iredell
County Tax Collector to collect taxes for the City of Statesville, Town of Mooresville,
Mooresville Graded School District, Town of Harmony, Town of Love Valley, and
Town of Troutman, or any other municipality in compliance with contracts adopted by
the respective governing boards. A charge of one and one-half (1'/2) percent of all taxes
collected for the taxing districts will be payable to Iredell County for the collection
services.
Section 12. The 2006-2007 tax rates for the fire districts are levied as follows:
Shepherds 5.00 cents per $100 of valuation
Mt. Mourne 3.75 cents per $100 of valuation
East Alexander 5.00 cents per $100 of valuation
County -wide 5.00 cents per $100 of valuation
The estimated collection rate for the four fire districts is as follows: County-
wide 93.8%; East Alexander 93.58%; Mt. Mourne 95.50%; Shepherds 94.13%.

Section 14. The Board of Commissioners hereby agrees to contract with
existing volunteer fire departments in Iredell County to furnish fire protection to the
Shepherds, Mt. Mourne, Iredell, and East Alexander Fire Districts. The County Finance
Officer is instructed not to release funds to the departments unless an executed contract
is on file for each individual fire department.
Section 15. The 911 Emergency Telephone System Fund was established as a
self-supporting special revenue fund on July 1, 1991. Revenues are provided to the
fund from fees added to monthly telephone bills. The 2006-2007 fee is established at
$ .43 per telephone line. It is estimated the following revenues will be available for the
fiscal year beginning July 1, 2006 and ending June 30, 2007.

Section 16. The following amount is to be appropriated in the 911 Emergency
Telephone System Fund for the operation and maintenance of the 911 System for the
fiscal year 2006-2007.

1, 2004 to account for the grants and other special revenue received for the operation of
Iredell County Transportation Service and Iredell Community Transportation. It is

Section 19. Revenues of the Capital Reserve Special Revenue Fund are
provided by operating transfers from the General Fund, unspent Capital Project Funds,
and interest on investments. Operating transfers are subject to annual appropriation by
the Iredell County Board of Commissioners. Appropriations from this fund are
restricted to the purchase of land, water and sewer line construction, renovation of
buildings, purchase of furniture and equipment for newly constructed, purchased or
renovated facilities, renovation and construction of school facilities, or annual debt
service on those items heretofore mentioned.

Section 20. The Parks Reserve Special Revenue Fund is established to
accumulate funds for the purchase and development of land, construction of parks, and
purchase of equipment. Funds will be provided by operating transfers from the General
Fund, contributions, and interest on investments. The operating transfers are subject to
annual appropriation by the Iredell County Board of Commissioners. All projects
funded from this Special Revenue Fund are subject to approval by the Board of
Commissioners and will be accounted for in a Capital Project Fund. The total
accumulated in this Special Revenue Fund will be divided equally between the four
quadrants of the County for recreation and parks projects. Up to $10,000 of each
quadrant's share may be used for planning costs.
It is estimated the following revenues will be available for the fund during the
fiscal year beginning July 1, 2006 and ending June 30, 2007.

Update on the LeaWay Company Request for an Expansion of a Non -
Conforming Use: Planning Supervisor Steve Warren said that since the May 9, 2006
meeting, a letter had been received from Applicant Steve Lea requesting withdrawal of
the nonconforming use expansion request. Warren read the letter as follows:

In regards to our application for expansion o/ a nonconforming use.
Due to the extreme importance to Iredell County and agriculture in this matter, we respectfully withdraw
our application at this time.
This will allow us to collect information and documentation to properly address issues that were raised at
the last meeting that pertain to the board of commissioners. We will also gather information of licensing
and regulations required to operate this facility and are the responsibility of other government entities put
in place to police daily plant operations.

Chairman Tice explained to the audience that with the withdrawal, the issue or
request could be described as "dead."
Warren agreed. He said that if the applicants wanted to pursue the same type of
request they would have to start from "scratch" (apply to the planning department, place
signs in the affected area, publish legal notices, then the matter would be heard by the
planning board and the board of commissioners).
Chairman Tice declared the meeting to be in a public hearing.
Consideration of an Amendment to the Farmland Preservation Ordinance
(Section 502.1: ): Planning Supervisor Warren said the Farmland Preservation Board
unanimously recommended the following amendment to the farmland preservation
ordinance.
(502.1) An agricultural district shall initially consist of at least 25 or more
contiguous acres of qualifying farmland or be within 1 -mile (?fan already existing
district or at least two (2) or more qualifying farms, which collectively will create a
district. An agricultural district may be enlarged by adding qualifying, contiguous
farms.
Warren said the ordinance currently required at least 50 contiguous acres of
qualifying land or at least two or more qualifying farms. He said the amendment had
been created to increase farmland acreage in the program and to provide protection for
smaller farms such as poultry and tobacco farms. Additionally, he said the preservation
board wanted to lower the acreage requirement and to allow qualifying parcels within c-
one -mile area to join existing districts.
No one else desired to speak, and Chairman Tice adjourned the hearing.
MOTTO by Commissioner Johnson to grant the request of the Farmland
Preservation Board by allowing the ordinance amendment as presented by the planning
supervisor.

REQUESTED ACTION AND CONDITIONS: Rezone subject parcels from
RA, Residential Agricultural to GB -CUD, General Business Conditional Use
District with the following conditions:
• Underground utilities required;
• Roadway Protection Overlay District standards shall apply;

• Site development plan shall provide for shared parking with adjacent
parcels under same ownership; and
• Site development plan shall provide for future interconnectivity
between adjacent properties.
PROPOSED USE: GB uses, potentially including a family-owned heating and
air conditioning contractor facility, subject to specific site -development
conditions.
SIZE: 2.01 acres total.

WATERSHED REGULATIONS: The subject parcel is not located within a
Watershed area.
TRAFFIC: In 2004 there was an average daily traffic count of 11,000 vehicles
per day on this stretch of Highway 21, with an approximate carrying capacity of
10,500 according to the NCDOT Thoroughfare Plan.
ZONING HISTORY: The subject parcels have been zoned RA since
countywide zoning took effect in 1990.
STAFF COMMENTS: The applicants seek to rezone the subject parcels along
US 21 to accommodate future commercial growth. They have intentions of
locating a family-owned business at this location (Troutman Heating & Air).
The GB district itself is consistent with the objectives of the Exit -42 Small -
Area Plan, and the conditions proposed encourage the continuation of site-
specific development criteria along the Charlotte Highway corridor. Several
other parcels have been similarly rezoned GB -CUD along this stretch in recent
months and years, and these commercial zonings have involved these same
conditions. Because the proposed rezoning follows this pattern as well as the
intent of commercial growth near the Exit 42 interchange, staff recommends in
favor of this request.
PLANNING BOARD ACTION: On May 3, 2006 the Planning Board voted
unanimously to recommend in favor of this request and to advise that it is
consistent with the Exit 42 Small -Area Plan.
No one else desired to speak, and Chairman Tice adjourned the hearing

determining them to be in order, to approve the proposed amendment and to make a

REQUESTED ACTION & CONDITIONS: Rezone a portion of subject
parcel from RA, Residential Agricultural to HB -CUD, Highway

shops; tire dealers and service; printers and publishers; wireless
telecommunications towers and facilities.
PROPOSED USE: RV rental business.
SIZE: 7.738 acres requested for rezoning (parcel totals 14.14 acres).
EXISTING LAND USE: Vacant.
SURROUNDING LAND USE: Residential, Agricultural, and
Commercial (medical park, pharmacy, North Iredell Rescue Squad).
WATERSHED REGULATIONS: The subject parcel is located within
the WSIII — Balance (Hunting Creek).
TRAFFIC: This section of Memorial Highway had an average traffic
count of 3,200 vehicles per day in 2004 with a carrying -capacity of
9,000.
ZONING HISTORY: The subject parcel has been zoned RA since
countywide zoning took effect in 1990.
STAFF COMMENTS: The applicants seek to rezone the southern half
of the subject parcel. They own RentMeRVAmerica and wish to
relocate their business to this location; their proposed building would be
of an architectural style compatible with the rural nature of the area.
There is a commercial node at the intersection of 901 and Eagle Mills;
currently there is NB (Neighborhood Business) zoning in this vicinity

with a pharmacy, medical office park, and the North Iredell Rescue
Squad. The subject property is located approximately 400 feet from
Highway 901. When viewing the property from Houstonville Road,
there is a noticeable hill that blocks the view of the subject portion; this
natural berm would serve as an ideal buffer/boundary between the
zoning districts. In addition to this, if this request is approved there will
be the requirement for a screening device pursuant to the Zoning
Ordinance requirements (wherever HB adjoins RA district lines). The
result should be a clear separation of land -uses; staff feels that this is an
important consideration in this case in terms of how far the commercial
node should be expanded at this point in time. In addition to physical
characteristics of the property, the proposed conditions lessen the
intensity of the HB status on this parcel by restricting HB land -uses to
only those allowed in NB (Neighborhood Business). Because this
request only seeks to rezone the portion of this acreage closest to
Memorial Highway, the existence of a good natural boundary, and
proposed conditions that reduce the intensity of the HB classification at
this particular location, staff would recommend in favor.
PLANNING BOARD ACTION: On May 3, 2006, the Planning Board
voted unanimously (11-0) to recommend denial of this request.
Commissioner Johnson voiced concern about #4 in the findings of fact, even
though the planning staff had recommended approval of the HB/CUD request.
Brenda Hunter (opposition), the owner of 170 acres on Dare Road, presented a
petition with 70 signatures along with photographs of the community. Hunter requested
denial of the request due to (I) the rural nature of the area and (2) the belief that an RV
rental business was out of character for the area. Ms. Hunter said she represented
several others in the audience, and when asked, approximately 13 people stood up.
Ken Wilkinson (applicant) said the planning department had indicated the site
was "earmarked" for commercial businesses. He questioned what type of business
would fit in the area if the proposed RV rental business wasn't suitable. Wilkinson said
the business would "blend" into the rural setting, and he mentioned the possibility of
building a home on the property. He said about 90% of his RV business occurred
through the Internet. Mr. Wilkinson said there would be no sewage dumping; however,
Mr. Van Hoy, the owner of a nearby campground about a mile away, had given
approval for sewage disposal, if needed.
Eric Baggerly (opposition) said he lived within 500 feet of the property.
Baggerly expressed concerns about neighboring property owners experiencing an
increase in taxes if the site became commercial. He said the area wasn't suitable for
this type of business due to Eagle Mills Road being a small two-lane road. Baggerly
said the road would not be able to accommodate large RVs. Mr. Baggerly also shared
photos of the area and requested that the board deny the request.
OTION by Commissioner Williams to deny the proposed zoning map
amendment and to make a finding that denial was consistent with the adopted Future
Land -Use Plan and that said denial is reasonable and in the public interest due to its
consistency with the Future Land -Use Plan; as a result, said denial furthers the goals
and objectives of the Land -Use Plan.

NC): Planner Rebecca Harper said this 15.77 tract of land (PIN#4668-89-4044) was
adjacent to the Town towards the north, and Mooresville had already approved water
sewer extension. She said the county's land use plan designated the property for
industrial development, and the developer intended to construct offices on the site.
She said annexation would probably occur in June 2006, and due to the request meeting
all criteria, staff recommended approval.
2. Request for a Release of Zoning & Subdivision Jurisdiction (ETJ) for
Ronnie & Lee Smith to the Town of Mooresville (Cornelius Road, Mooresville,
NC): Planner Rebecca Harper said this release of zoning/subdivision request was for
55.62 acres out of an 89.5 acre tract (PIN#4648-93-5338). She said the parcel towards
the north was adjacent to the Town, and Mooresville had approved water sewer
extension. She said annexation had been requested, but it would not occur until June
2007. Harper said the property was designated for industrial development in the
county's land use plan, and the developer planned to construct Phase II of the Deerfield
Business Park. Mrs. Harper said the developer's intent was consistent with the county's
land use plan, and the staff recommended approval of the release request.
3. Request from the Sheriffs Department for Approval of a Resolution
Authorizing the Awarding of Badges and Sale of Sidearms to Retired Deputies
Gwen Marie Parks and Artis Felton Brown (Mr. Brown will retire on 06/30/06):

5. Request from the West Iredell Volunteer Fire Department for a Surplus
County Vehicle: County Manager Mashburn said a letter had been received from
Shane Bolick, the Chief of the West Iredell Fire Department, requesting the donation of a
surplus vehicle. Mashburn said that as soon as a specific vehicle was identified by the
fire department, the transfer would occur.
6. Request for Approval of the Records Disposition & Retention Schedule for
County Management Offices as Issued by the NC Department of Cultural
Resources/Government Records Branch: County Manager Mashburn said the state
updated the records retention/disposition schedule periodically and approval was
needed. He said once approved, the staff could start following the new guidelines.
7. Request for the Appointment of Susan Blumenstein as Acting County
Manager for a Period Extending from June 14, 2006 through July 26, 2006: Due
to the County Manager being on a leave of absence, Ms. Blumenstein was appointed
Acting County Manager from June 14 — July 26.

Request for a Release of Zoning & Subdivision Jurisdiction (ETJ) to the
Town of Troutman for Property (Perth Road, Troutman, NC) Owned by Crescent
Resources): Planner Rebecca Harper said Crescent Resources had requested the
zoning/subdivision release of 350 acres, out of a 505 acre tract (PIN#4730-76-7928) to
the Town of Troutman. She said 155 acres of the parcel were already within the
Town's extraterritorial jurisdiction. Mrs. Harper said the county's land use plan
designated the property for residential development, and Crescent desired to construct a
subdivision (Streamwood at Falls Cove) on the site. Additionally, Harper said
Troutman had approved water and sewer extension for the development, but annexation
needed to occur first. She said the request met the criteria for a release of jurisdiction,
and the planning staff recommended approval.
Commissioner Williams said the board last month agreed to scrutinize
subdivisions differently in the future. He said the 532 -unit development would "tax"
the schools system, the fire service and other services. Mr. Williams said that if the
request were denied, there would only be about a six-month delay, but at least it would
be sending a message.
Commissioner Robertson voiced concerns also, especially about Perth Road and
the lack of other roads for ingress and egress. He said eventually, the subdivision
would get built, and when this happened, citizens would start telephoning about the
congested road and their children being taught in mobile classrooms. Mr. Robertson
said the county needed time to address school needs.
Commissioner Johnson said a denial would basically be "symbolic." He
emphasized the county had no control over the roads, and he mentioned that much of
the Brawley School Road situation had been caused by the Town of Mooresville.
Johnson said that whatever action was taken, the board needed to be consistent.
Commissioner Norman said he, too, felt that the infrastructure should be in place
before any subdivisions of this magnitude were approved.
MOTTO by Commissioner Williams to deny Crescent Resources' request for
the release of 350 acres to the Town of Troutman's zoning/subdivision jurisdiction.
