HomeMy WebLinkAboutOctober_3_2006_Briefing_MinutesIREDELL COUNTY BOARD OF COMMISSIONERS BRIEFING MINUTES OCTOBER 3, 2006 The Iredell County Board of Commissioners met in Briefing Session on Tuesday, October 3, 2006, at 5:00 P.M., in the Iredell County Government Center (South Wing Conference Room), 200 South Center Street, Statesville, NC. Present were: Chairman Sara Haire Tice Vice Chairman Godfrey Williams Steve Johnson Marvin Norman Ken Robertson Staff present: County Manager Joel Mashburn, Mike Phillips (part-time office deputy with the Sheriffs Department), Deputy Planning Director Steve Warren, Solid Waste Director David Lambert, Purchasing Agent Dean Lail, Assistant Finance Officer Debra Alford, and Clerk to the Board Jean Moore. CALL TO ORDER by Chairman Tice. PLANNING/ZONING MATTERS: Deputy Planning Director Steve Warren explained the agenda requests from his department. Pertaining to the request for the release of zoning and subdivision jurisdiction to the Town of Mooresville from Chas. H. Sells, Inc., representing Victor A. Johnson Jr., and Brian R. Harwell, the board members did not place this matter on the consent agenda due to concerns voiced by Commissioner Williams. Williams said none of the 106 acres adjoined the town limits, and the growth that would occur from the proposed residential development would impact the Mooresville School System. Mr. Warren said another zoning jurisdiction release request needed to be discussed, but it had not been received in time for placement on the agenda. The board members agreed to add the request to the October 3 agenda, and details about the item are as follows: Request from Rick Howard of Langtree Properties for the Release of Zoning Jurisdiction of Two Parcels (PIN#s 4645545643 & 4645540923) to the Town of Mooresville (Owners are Jean H. Oliver & Bobby Lee Oliver Sr., and David A. Woodard & Shasta Woodard): Mr. Warren said the two tracts would be used as a buffer for the Langtree at the Lake project. He said the properties, located at Wades Way, near Alcove Road, had not been accepted by Mooresville for annexation/utilities, and any approval needed to be contingent upon this action by the Town. Attorney David Parker, representing the property owners, said there were houses on both sites but they would be removed. He said the properties were needed for buffer and green space requirements. Mooresville Town Commissioner Frank Rader informed the board that an application from the owners requesting annexation/utilities was in the Town's planning department, and it would be reviewed the first Monday in November. The board placed the release of zoning jurisdiction request (Rick Howard/Langtree Properties) on the consent agenda. REQUEST FOR A REVIEW OF THE SOLID WASTE TIPPING FEE WAIVER GUIDELINES AS THEY RELATE TO DEBRIS FROM THE DEMOLISHMENT OF DILAPIDATED MOBILE HOMES: Solid Waste Director David Lambert said recently the sheriffs department assisted area citizens with the removal of debris from abandoned or dilapidated mobile homes. He said the debris (5.80 tons) amounted to $127.60 in tipping fees, and this amount was charged to the sheriffs department. Lambert said the solid waste office did not have the authority to waive the cost for demolition materials. Commissioner Johnson said drugs were being sold out of the dilapidated structures, and this was causing problems in the neighborhood. He said an altruistic person bought the property to help resolve the problem, and he didn't feel the new owner should be charged for the debris disposal. Commissioner Robertson asked, assuming the fees were waived, how the board members would feel a months from now if the new owner sold the property, or placed something on it for financial gain. Commissioner Williams said some of the structures were health hazards, and some property owners couldn't afford to dispose of them. He asked Lambert the tipping fee amount. Solid Waste Director Lambert said the fee was $22 a ton, and the debris from a doublewide mobile home could cost up to $500. County Manager Mashburn said there were many dilapidated mobile homes throughout the county. He said, however, that in this particular case, the property value would probably increase with the removal of the abandoned mobile homes. Chairman Tice asked if Gordon Iron and Metal was equipped to demolish the structures, and if some of the building materials might have salvage value. Mashburn said the frames could only be used. Commissioner Robertson mentioned a mobile home disposal fee where the buyers paid a certain amount at the time of purchase. Lambert said, twice, the General Assembly had voted on disposal fee legislation, and each time the bills were defeated. He said there was a strong lobbyist group against mobile home disposal fees. Commissioner Johnson said individuals purchasing property with a mobile home should realize the removal cost was theirs, but that in this particular case, he felt the fee should be waived. Commissioner Williams said he felt the mobile home disposal issue should be addressed in a minimum housing ordinance. Lambert said that if a waiver occurred, a precedent would be set. Commissioner Johnson said a precedent would be set only if the sheriff assisted another neighborhood in similar fashion, and he didn't see these situations occurring that frequently. Commissioner Norman said a policy needed to be developed before any waivers were granted. Mashburn said the solid waste department had an unpaid fee, and the board was the only authority that could grant a waiver. He said that if a landowner benefited from the debris removal, then the landowner should be responsible for the tipping fee. Mr. Mashburn acknowledged, however, that sometimes the greater benefit needed to be studied. agenda.) (There was consensus from the board members to delete this request from the 2 REQUEST FROM THE MOORESVILLE-SOUTH IREDELL CHAMBER OF COMMERCE FOR FUTURE CONTRIBUTIONS EARMARKED FOR ECONOMIC DEVELOPMENT (SOUTHERN IREDELL COUNTY) TO BE SENT TO THE NEWLY -CREATED MOORESVILLE-SOUTH IREDELL ECONOMIC DEVELOPMENT CORPORATION: Joining the commissioners were Mooresville - South Iredell Chamber President Ben Goins and Chamber Vice President for Economic Development Mark Brady. Goins said the AngelouEconomics Strategic Plan recommended that a stand-alone economic development corporation be created. He said in the past, this type of function had occurred out of the Chamber building, but now it would be housed at 151 East Iredell Avenue (next door to the Chamber). Mr. Goins said the reason behind the separation was to allow the new corporation to seek funds from private investors to help expand the budget. He said Mooresville needed to remain competitive with other areas in industrial recruitment. Goins requested that future economic development funding be directed to the new corporation effective January 1, 2007. He said an annual audit would be performed. Mr. Brady said the Chamber would also retain an economic development committee. Chairman Tice said the AngelouEconomics Plan had also recommended that a project similar to Langtree at the Lake be recruited for the Mooresville area. (She mentioned this due to an earlier discussion about the new hotel/mixed development project/Langtree at the Lake). A letter from the two gentlemen said the new corporation would have a nine - member board consisting of the following: • Chairman of Iredell County Board of Commissioners or a designated County Commissioner; • Mayor of the Town of Mooresville or a designated Town Board member; • A designee from the South Iredell Community Development Corporation (SICDC); • A designee from the Mooresville -South Iredell Chamber of Commerce Executive Board; • A designee from the Mooresville Convention & Visitors Bureau; • A representative from the largest private sector investor (this investor must have invested at a level equal to or greater than the average of the town and county investment for five continuous years and be approved by the Board); • A representative elected from the private sector's major investor group; • The Executive Director of the Mooresville -South Iredell Chamber of Commerce (Ex - Officio member); and • The Executive Director of the Mooresville -South Iredell Economic Development Corporation (Ex -Officio member). All other agenda requests were then reviewed, and additional information about these items may be found in the regular minutes.
