Board Members Present Chairman Marvin Norman Vice Chairman Sara Haire Tice Steve Johnson Ken Robertson Godfrey Williams Staff present: County Manager Joel Mashburn, County Attorney Bill Pope, Deputy County Manager Susan Blumenstein, and Clerk to the Board Jean Moore. CALL TO ORDER by Chairman Norman. INVOCATION by Commissioner Johnson. PLEDGE OF ALLEGIANCE ADJUSTMENTS OF THE AGENDA: MOTION by Commissioner Johnson to approve the following agenda adjustment. Addition: Closed Session - G.S. 143-318.11(a) (5) — Property Acquisition VOTING: Ayes — 5; Nays — 0. PUBLIC HEARINGS Chairman Norman declared the meeting to be in a public hearing for three different items. In regards to Case No. 0705-1, a Rezoning/Conditional Use request for the Alexander Railroad Company, Attorney Pope administered the oaths to the people desiring to speak. Citizen Comments Regarding the FY 2007-2008 Iredell County Budget Health Reach Community Clinic: Jay Lewis, a board member of the clinic, asked for the full requested funding of $15,000. (The staff had cut $10,000 and recommended the same funding as FY 06-07 or $5,000. Mr. Lewis said the clinic needed $15,000 a month to operate, and the Town of Mooresville contributed this amount. He said the county should appropriate the same. Mr. Lewis said last year, 3,000 individuals were assisted on a total budget of $175,000. The Counseling Center of Iredell: Heather Bartley, the new Executive Director of the center introduced herself and thanked the board members for their financial support. Fire Services: John Dennis, on behalf of the Windemere Homeowners Association, thanked the board for allowing the Barringer & Fallstown Fire District referendum in the fall. He said the homeowners would benefit from improved insurance ratings. Ken Jumey thanked the board members for their vote of confidence in approving the performance based penny increase for fire protection. He said the taxpayers would be pleased with the annual returns on the investment. Terry Bibleheimer thanked the board members for their support of the fire departments and especially for the recent decision on the Troutman district. Jerry Rhyne (Griffin Insurance Company) thanked the board for the fire tax increase. He said the VFDs had worked hard in creating a business plan, and there was now an incentive for them to improve the insurance ratings. No one else desired to speak, and Chairman Norman adjourned this hearing. Citizen Comments Regarding a Possible Community Development Block Grant Application (Year 2006 Scattered Site Housing Funds up to $400,000) & Call for a Second (2") Public Hearing on June 19 Regarding the Same: County Manager Mashburn said the purpose of the hearing was to allow the public to speak about the county submitting an application for $400,000 in grant funding to assist low and moderate -income households with housing repairs. No one else desired to speak, and Chairman Norman adjourned this hearing. NOTE: The 2nd hearing, as approved by the board, will be held on June 19 at 7:00 p.m. Rezoning Request: Case No. 0705-1, Alexander Railroad Company Requests an Amendment to the Iredell County Land Use Plan & a Rezoning from Residential Agricultural to Light Manufacturing Conditional Use District (M-1 CUD): Deputy Planning Director Steve Warren provided the following staff report for this case. STAFF REPORT CASE NO. 0705-1 OWNER/APPLICANT: Alexander Railroad Company P.O. Box 277 Taylorsville, NC 28681 LOCATION: The property is located at 1795 Midway Road, in Stony Point, NC; more specifically identified as PIN# 3797-92-5790. Directions: Take Taylorsville Highway west from Statesville; tum right onto Midway Road and property is on the right after crossing railroad tracks. REQUESTED ACTION: Rezone subject parcel from RA, Residential Agricultural to M 1 -CUD, Light Manufacturing Conditional Use District; and Amend the Iredell County Land Use Plan. • All uses allowed EXCEPT for the following: Airports, transportation facilities, private building debris landfills, and private sanitary landfills. PROPOSED USE: Wood forests products, wholesale SIZE: 8.352 acres. EXISTING LAND USE: Vacant. SURROUNDING LAND USE: Residential uses are adjacent to the north, northwest, and east. Vacant residential land lies to the south and vacant commercial land lies to the west of the requested property. WATERSHED REGULATIONS: The subject parcel is not located within a watershed area. TRAFFIC: This section of Taylorsville Highway had an average of 2,600 vehicles per day in 2005 and Midway Road had an average of 1,300 vehicles per day in 2005. According to the 1993 Iredell County Thoroughfare Plan, this section of Taylorsville Highway has a carrying capacity of 10,500 vehicles per day and Midway Road has a carrying capacity of 8,000 vehicles per day. ZONING HISTORY: The subject parcel was zoned RA when countywide zoning took effect in 1990. Parcels along the south side of Taylorsville Highway from Midway Road west to the Alexander county line were zoned for Neighborhood Business at that time, as were two areas of General Business fronting Taylorsville Highway and Halyburton 2 Road. One rezoning case was approved across Midway Road for Heavy Manufacturing Conditional Use District for a wood processing/lumber operation in November of 1993. STAFF COMMENTS: The applicant has chosen the Ml -CUD classification, which allows for a range of light manufacturing uses and allows for many similar uses as nearby commercial properties. Although the Iredell County Land Use Plan identifies this area as suitable for future residential development; staff is recommending in favor of this rezoning request and the land use map amendment since the parcel is adjacent to an operating rail line, and lies in close proximity to NC 90 with an available water supply. An existing commercial and industrial node is identified on the Iredell County Land Use Plan map along NC 90 and Halyburton Road from the Alexander County line to the west side of Midway Road. The expansion of the industrial node along this corridor is a logical extension considering the local infrastructure in place and nearby heavy manufacturing wood operation. PLANNING BOARD ACTION: On May 2, 2007 the Planning Board voted 9-0 to recommend approval of the land use plan amendment and rezoning request. Warren said the proposed lumber distribution company desired to take advantage of a rail spur that would be built. He said the company would not manufacture, rather it would take advantage of a spur that would be built on the Alexander rail line. He said there would be approximately 10 to 12 rail cars unloaded and several tractor trailers would move in -and -out the site during the week -- Monday through Friday. Warren said that due to (1) the existing commercial node nearby (2) the company needing infrastructure (rail) which was already at the site, (3) the area was mixed-use (4) a rezoning occurred nearby in 1994 for a wood operation, and (5) other rezonings had occurred that expanded the commercial node, the staff felt the distribution was a good use of the property. He said that with the nearby residential area; however, a site plan would have to be reviewed by the county staff. Karole Clanton (opposition) distributed a petition against the request. The document read as follows: "We, the undersigned, heing the greater number of surrounding property owners, are in total opposition to the proposed rezoning, Case No 0705-1, which will amend the Iredell County Land Use Plan and rezone parcel ID#3797-92-5790 from RA, Residential Agricultural to MI -CUD, Light Manufacturing Conditional Use District. We feel this amendment, if adopted, will adversely affect and greatly undermine our community now and in the future. " Clanton also shared information stating the following: • A reasonable boundary already existed (Clanton said the "reasonable boundary" was Midway Road, and it was already the existing boundary between commercial and residential development.) • Spot zoning would occur if approved. • The new rail spur would be 100 ft. from her house or bedroom window. • There are concerns about the 30 ft. easement for ingress/egress to Hwy 90. • A new driveway out of her property would be useless, especially if a switch were placed there and a train blocked her property. • At least 20 days of the month, according to information from Alexander Railroad officials, a rail car would either be moving or sitting 100 ft. from her bedroom. (She said this was "industrial invasion.") • The county's "current zoning map was presumed to be sound in its present state and there is nojustification for capriciously altering it. All property owners are entitled to assume that a zoning pattern, once established, will continue until there is substantial proof that a change is required. The presence of a situation self-created by the applicant for rezoning is not a valid reason upon which to base a decision to rezone." (Source: Iredell County Land Use Plan) Clanton requested the commissioners to consider the residents over the financial gain of a single -property owner. She asked for the existing boundary to be preserved. Mike Smith (proponent) the Director of the Greater Statesville Development Corporation stated he was trying to retain 20 jobs that currently existed in the county by advocating for the request. He said a new distribution center would add to the county's tax base, and there were limited industrial/commercial rail sites available. Charley Lackey (opponent) said she owned 42 acres that joined the site. She asked if the new business would increase or decrease her property's value. Steve Issak mentioned a "battle" he had been experiencing with the Federal Railroad Administration, the North Carolina Department of Transportation, and the Norfolk Southern Railroad, because of the Alexander Railroad's lack of maintaining a crossing on West Front Street. He said since January 2006, letters and e-mails had been sent to all of the agencies. Issak recommended for the commissioners to be disinclined to provide any favors to the Alexander Railroad due to the company's failure to maintain the property. He said his interest in the rezoning case was merely due to Alexander Railroad's lack of concern for public safety. Barbara Haves (opponent) voiced concerns about the lumber products and the possibility of carcinogens. She asked about the tradeoff between the tax value of a new business versus the residential depreciation. Hayes said the rail company had not been a good neighbor, and as a matter of fact, the rail officials had indicated that they controlled the adjoining neighbors' properties. Benjamin Zachary (proponent — President of Alexander Railroad) said the crossing referred to by Mr. Issak was owned by Norfolk Southern Railroad. He said Alexander Rail had nothing to do with the crossing. Issak said Alexander Rail used the crossing. Zachary said Alexander's trains did not use the crossing. He said the company owned and operated 18 miles of track between the old Carnation Milk Plant and Taylorsville. Zachary said the track was built in 1887, and his company had operated since 1946. He said the company carried common rail carload freight with 20 customers on the right-of-way of Hwy. 90, Monday through Friday during daylight hours. Mr. Zachary said the company wasn't in the land development business "per se" but occasionally investments were made in strategically located parcels that might attract rail customers. He said the specific property was purchased in 1994 knowing that a rezoning would have to occur for an industrial/commercial use. Zachary said Cardinal Forest Products had contacted him about the property. Commissioner Williams asked about the 100 ft., and the rail setback required off the property line. Zachary said the 100 feet referred to the railroad right-of-way that was included in the railroad's charter. He said there was really no setback, "per se." Warren said there was a 30 -feet setback off the rear property line that was closest to Ms. Clanton's property. Commissioner Williams asked if the 100 ft. took the 30 ft. in consideration. Warren said the 100 feet had to do with the railroad's right-of-way -- there couldn't be any interference within the right-of-way. He said this was a private right -of- way. Warren said across the frontage there was a 50 ft. building setback along Midway Road. He said within the 30 ft. buffer that adjoined the residential district, there also had to be a screening device (fence or row of evergreen trees 90 percent opaque at least 6 ft. high). He said this would be reviewed at the time the applicant requested zoning clearance/permits as a part of the site plan process. Williams asked about the site plan. Warren said an official submittal had not occurred. Commissioner Robertson asked for further clarification on the 100 ft. right-of-way. 4 Warren said this wasn't a county requirement. Zachary said the 100 ft. was included in the railroad charter granted by the General Assembly in 1887. (The railroad has a railroad purpose easement 100 ft either side of the center of the track that may be used for rail purposes as needed.) Commissioner Robertson asked what happened if the 100 ft. crossed another owner's property. Zachary said the railroad could use the property, and there were two sets of property rights. He said the owner of the property had rights, but the railroad had easement rights. He said the "fee owner" had the right to use the property until such time as the railroad needed it. Mr. Zachary said he didn't see the 100 ft. as being an issue since the rail company owned the property in fee. Williams said the rail company had 400 feet on the northwest side. He asked about moving the switch. Zachary said the switch (where the spur leaves the main track) had to be located on a straight piece or tangent track. He said it wasn't safe to place a switch in a curve. Zachary said that once the spur left the main track, the angle that it left was subject to change. Williams said it wouldn't have to be parallel with the property line. Zachary said this was correct. Robertson asked the Cardinal Forest Products President about the spur's location. John Bryan (proponent — President/General Mgr. of Cardinal Forest Products) said annualized sales were just under $20 million for the company that provided wholesale lumber products. He said the company had leased property on Hwy. 70 for four years. Bryan said specialty wood products were provided for mostly interior areas of homes so they had to be void of contaminants. He said products were received by rail and tractor trailer, and they were shipped out by Conestoga truck. Bryan said that if the board approved the rezoning, an engineer would be hired to provide a site plan. He said the warehouse would, however, be located away from any existing adjacent housing. Mr. Bryan said he resided in Iredell County, as did the majority of his shareholders. Commissioner Williams said the drawing submitted by Mr. Bryan showed the facility to be about 50 feet off the property line. He asked if the facility would have to be located there. Bryan said the engineer would provide the site plan and determine where the switch needed to be placed. He said the best use of the property had to occur. Commissioner Williams said the tangent point would be the same location -- the curve would just be increased outward from the property line. Mr. Bryan said he felt this might be acceptable, but the engineer would have to address this. He said the company operated from both sides of the car. Robertson asked if the building was enclosed. Bryan said it would be enclosed. Robertson asked the hours of operation. Bryan said loading started start around 7:30 a.m. Robertson asked about the homeowner's concern about a blocked driveway. He asked if the homeowners would be blocked in. <s Zachary said the switch and spur would not cross the driveway. Robertson said without a site plan the board actually didn't know what was being approved. He asked if a right-of-way was being granted to the railroad over someone's property. Zachary said not in his opinion. He said this situation had already occurred. Robertson asked if the 100 ft. came into play with the spur. Bryan and Zachary said it was just the main track. Williams asked about safety, especially regarding children playing around the train cars. He asked if a condition for a chain-link fence could be imposed. Bryan said for the building's security this would be provided. He said the product was removed from the rail cars as soon as possible, and nothing was left outside. Johnson said the buffering between the residents and the property was a requirement of the ordinance, but specifications could be added. He asked if this was a correct understanding. Warren said latitude was in the text, and the applicant could use a fence, or evergreens, or even a combination. He said this was within the purview of the board -- the ordinance addressed only the minimum requirement (6 foot high fence or trees -- 90% opaque plus it would have to be within the 30 ft. buffer). Clanton said her drawing showed a 30 ft easement for a future driveway. She asked if the spur and switch would make it inaccessible. Issak said money had previously been spent for a Land Use Plan, and now the county was casting it aside. Chairman Norman asked Mr. Bryan to address Ms. Clanton's concerns. Mr. Bryan said the company would try to be a good neighbor. Chairman Norman asked if the company had any plans. Bryan said no. Chairman Norman adjourned the hearing. Commissioner Williams said the following conditions needed to be incorporated into any motions for approval: (1) The rail spur would be no closer than 50 feet from the property line (2) There would be a chain link fence across the property line (opaque fence along the eastside of the property) Commissioner Tice said the applicant had to agree to the conditions prior to a vote. Commissioner Robertson said the board wanted to help local businesses and the railroad company, but the property was purchased knowing the spur would have to be up near a residential area. He said there was a level of discomfort on his part about the rezoning. Commissioner Johnson asked Mr. Zachary if a 50 ft setback for the spur off the property line was workable. Zachary said it would be workable 50 ft. off the property line -- after it left the railroad's 100 ft. right-of-way. Williams said the curve would be within the railroad's right-of-way. 6 Johnson said he understood the railroad company might have to change the radius of the curve as it was on the right-of-way to get to the point where the straight part of the spur, going in, would be 50 ft. from the property line -- that this was workable. Zachary said yes sir. Johnson asked Mr. Bryan about the fencing where it abutted the residential property to the east. He asked Mr. Bryan if there was agreement to an opaque fence 90%. Bryan said yes. MOTION by Commissioner Johnson to amend the Land Use Plan. VOTING: Ayes — 4; Nays — 1 (Robertson) MOTION by Commissioner Johnson to approve the zoning map amendment and to make a finding that approval was consistent with the adopted Iredell County Land Use Plan and that said approval was reasonable and in the public interest due to its consistency with the Iredell County Land Use Plan; as a result, said approval furthers the goals and objectives of the Iredell County Land Use Plan. VOTING: Ayes — 4; Nays —1 (Robertson) Commissioner Johnson said Mr. Zachary could alter the radius of the curve (spur) that was in the railroad's right-of-way to arrive at a point that entry onto the subject property was in a manner that was parallel with the property line -- this could be done 50 ft. off the property line. Mr. Zachary agreed to this. Commissioner Johnson said Mr. Bryan had also agreed to opaque fencing along the eastside of the property. Johnson said these two conditions were included in the motion. MOTION by Commissioner Johnson to approve the conditional use findings of fact. VOTING: Ayes — 4; Nays — 1 (Robertson) ---------------------------------------------CONSENT MOTION by Commissioner Tice to approve the following 16 consent agenda items. VOTING: Ayes — 5; Nays — 0. (All requests were explained during the briefing session.) 1. Request for Approval of an Interlocal Agreement with the Town of Davidson for Iredell County to Collect Property Taxes for Properties Lying Within Iredell County's Boundary Lines: Tax Administrator Bill Doolittle said this agreement would allow Iredell County to collect the taxes for properties lying within the Town of Davidson. He said previously, only Ingersol Rand plus a few other parcels existed in the corporate limits, and Mecklenburg County collected the taxes. Doolittle said now, with the new homes and vehicles resulting from the Davidson Pointe subdivision, it was recommended for Iredell County to collect the taxes to lessen the confusion for the property owners. He said similar agreements were in use with other municipalities, and the tax department was prepared to collect the 2007 taxes. Note: A Town of Davidson Order of Collection was included in the agreement for Iredell County's Tax Collector in accordance with G.S. 105-321 (b). Request from the Recreation Department for Approval of a Fee Increase for the Ropes Challenge Course and an Adjustment to the Facilitator Pay Scale (both effective 07/01/07): Recreation Director Robert Woody requested Ropes Challenge Course fee increases as follows: $1 increase per youth participant; $2 increase for adult and non -profits, and $5 for corporate functions.
