SEPTEMBER 2, 2008
The Iredell County Board of Commissioners met in Regular Session on Tuesday,
September 2, 2008, at 7:00 P.M., in the Iredell County Government Center (Commissioners'
Meeting Room), 200 South Center Street, Statesville, NC.

PLEDGE OF ALLEGIANCE
WITHDRAWAL OF PLANNING CASE #0808-1: Request from the Pruitt
Development Corporation to Amend the Iredell County Land Use Plan & Rezone 11.23
Acres from Residential Agricultural Zoning District to Highway Business Conditional
District (Location: Corner of Charlotte Hwy/US 21 and Westmoreland Road in Mooresville, NC):
Planning & Development Director Ron Smith announced that Ernest Pruitt, the owner/applicant
for this property, had submitted a written request to withdraw the rezoning case. Smith said that
if the board accepted the withdrawal, the applicant would not be able to reapply until after six
months.
MOTION by Vice Chairman Tice to accept the withdrawal as requested by the applicant.
Commissioner Johnson, speaking to the planning director, requested the planning staff to
encourage all property owners, in this area, to delay any rezoning requests until after the Land
Use Plan had been completed.
VOTING: Ayes — 5; Nays — 0.
ADJUSTMENTS OF THE AGENDA: MOTION by Commissioner Johnson
to approve the following agenda adjustments.

APPOINTMENTS BEFORE THE BOARD
Presentation from Laura S. McClettie, from the U.S. Census Bureau Regarding the
2010 Census: Ms. McClettie said participation in the upcoming census was important to ensure
that Iredell County received its fair share of federal funding and to assure that North Carolina's
population count was accurate for Congressional seats. She said that due to the 2000 census,
another Congressional seat was allocated to North Carolina. McClettie said the census would
need 3,000 to 4,000 employees statewide, with actual hiring occurring now through 2010. She
distributed a packet of materials, and noted a fact sheet for elected officials. McClettie said a
liaison from Iredell County would need to be appointed to help in the creation of a Complete
Count Committee. She mentioned that long forms were sent out on a continual basis, and short
forms would be sent to residents in March 2010.

PUBLIC HEARINGS
Chairman Norman declared the meeting to be in a public hearing.
Consideration of an Economic Development Incentive for NGK Ceramics, Inc:
Mooresville -South Iredell Economic Development Director Russ Rogerson said NGK Ceramics
had existed in Mooresville since 1988, and the company was planning the 12°i expansion. He
said the business produced ceramic catalytic converters, and it had a payroll of $16 million with
475 full-time employees. Rogerson said the $33,128,000 expansion consisted of a new 42,000
s.f. facility utilizing a rail infrastructure system. He said the $33 million investment would make
the company eligible for a $707,610 incentive, over a six-year period, and 80 new employees
would be added for a total of 555 employees upon build -out enabling NGK to be the second
largest Japanese company in North Carolina.
No one else desired to speak, and Chairman Norman adjourned the public hearing.
MOTION by Vice Chairman Tice to approve the $707,610 incentive, over six years,
based on the NGK investment of $33,128,000.
VOTING: Ayes — 5; Nays — 0.

Consideration of an Economic Development Incentive for an Undisclosed Company
that may Locate in Iredell County Pending Approval of all Local & State Incentives:
County Manager Joel Mashburn said a new company was considering an industrial site in
Statesville and proposing a $120,000,000 investment consisting of two phases. He said the first
phase was the construction of a 250,000 s.f. facility with 56 employees, while the second phase
consisted of a 150,000 s.f. facility with 32 additional workers for a total workforce of 88.
Mashburn said the industry would be serviced by rail, and the company was seeking an Iredell
County incentive of $2,563,200 over a six-year period.
No one else desired to speak, and Chairman Norman adjourned the hearing.
MOTION by Commissioner Johnson to approve the $2,563,200 incentive, over a six-
year period, based on the $120,000,000 investment the undisclosed company planned in Iredell
County.
VOTING: Ayes — 5; Nays — 0.
(Note: Greater -Statesville Development Corporation Director Mike Smith had previously
provided the financial information for this company's request.)
Chairman Norman declared the meeting to be in a public hearing.
Consideration of an Application to the NC Department of Commerce for a
Community Development Block Grant (CDBG): County Manager Joel Mashburn said the
county was proposing to apply to the Department of Commerce for an economic development
CDBG. He said the CDBG program allowed many types of activities to create or retain
employment opportunities along with enhancing income levels, especially for citizens with low
to moderate incomes. Mashburn said no action was needed by the board, rather the hearing was
being held to allow for public input.
No one else desired to speak, and Chairman Norman adjourned the hearing.

Consideration of a Request from Dkota Investments, Inc., for the Release of
Zoning and Subdivision Jurisdiction for a 10 -Acre Site Located at Mooresville Boulevard
and Penske Way, Mooresville, NC: Planning & Development Director Ron Smith briefed the
board about with this request as follows:
The property is identified as parcel number 4668-77-7127 and currently zoned M-2 CUD. The
proposed use is industrial/office/flex space, and the property is located in one of the county's
largest industrial areas. The Town of Mooresville'3 Planning Department supports an exclusive
industrial development pattern for the area in keeping with the Town's Future Land Use Plan.
The subject property is identified as a transitional area in the County Land Use Plan, which
parallels the industrial development supported by the Town. The Town also has more stringent
guidelines with regard to design criteria, and a Traffic Impact Analysis, for developments
generating 500 trips per day or 100 trips during peak hour, will be needed.
Based on the industrial nature of the area, the willingness of the Town to take jurisdiction, and
the more stringent requirements of the Town, the staff supports this request and recommends
approval.
No one else desired to speak, and Chairman Norman adjourned the hearing.
MOTION by Commissioner Johnson to approve the release of zoning and subdivision
jurisdiction to the Town of Mooresville as requested by Dkota Investments.

Consideration of an Order to Close a Portion of First Street Situated between SR -
2451 Sigmon Road & SR -2355 Oak Grove Road (Applicants are Rachel York and Beverly
Kim & Barry Lynn Lippard): Planning & Development Director Ron Smith said on
August 5, 2008, a resolution of intent was approved for this road (portion) closure. Smith said
the road property would revert to the adjoining land owners, and it would be divided using the
center line of the road. He said all legal requirements had been met, and the staff recommended
approval.
Commissioner Williams asked if First Street was used for transportation.
Smith said it was used as a cut -through to other area roads.
Attorney John Lewis, representing the applicants, said First Street was not on the state
maintained list, and it was basically being used for ATVs or dirt bike riders. He said (1) the road
originated from an old plat with the Sigmon Road portion being 30 ft. of roadway while the Oak
Grove Road portion was 40 ft. due to being a newer subdivision (2) the applicants owned all the
property adjoining this portion of First Street, even though there were four lots/properties with
two lots being on each side (3) the closure would not cut anyone off from their own land and (4)
the owners had no plans to develop the road property.
Barry Lippard, one of the applicants/owner, said he mowed the grass along the roadway
as well as picked up trash and litter. He said the road wasn't large enough for two cars to pass
each other, and the area was a nuisance due to the litter, along with loud music at night. Mr.
Lippard said the area residents would still have three access roads available when the roadway
was closed.
Brad Busler, a resident of 150 Sigmon Road, Statesville, disagreed with the statement
that the area residents didn't use the road. He said SR 2451-Sigmon Road, another dirt road,
was in a poor condition. Busler said that if improvements were made to Sigmon Road, then he
would have no opposition to First Street's closure.

Ron Smith said the state maintained a portion of Sigmon Road, and the portion Mr.
Busler was referring to wasn't on the State Department of Transportation's maintenance list.
Smith said that if the First Street closure occurred, the roadway would automatically disappear.
Vice Chairman Tice said the residents on Sigmon Road would have to improve the
roadway up the state's requirements, at their own expense, in order to have it placed on the state -
maintained list.
David Crider, said the issue didn't affect him due to his house being on the corner, but
during bad weather, area residents used First Street and school buses did too.
Amos Trapper mentioned that he had resided in the area for 40 years. He agreed that
First Street was used as a cut -through. Trapper said he would have no problems with the request
if Sigmon Road had improvements.
Commissioner Johnson reminded the residents that the commissioners had no
authority to petition the state for the roadway improvements. He said the property owners
adjoining Sigmon Road would have to petition the state and absorb the improvement costs.
Commissioner Williams asked if a school bus route was on First Street.
Mr. Crider said he had seen school buses.
Mr. Lippard, one of the applicants, said First Street had never been used by school
buses. He mentioned that his in-laws had lived in the area for 50 years. Lippard said that if the
request were denied, he would need a reason. He said the road was narrow -- basically a path,
and there were three other access points or roads the neighbors could use.
No one else desired to speak, and Chairman Norman adjourned the hearing.
MOTION by Commissioner Johnson to approve the order to close or abandon First
Street as presented.

TO CLOSE
FIRST STREET
WHEREAS, on September 2, 2008 at 7:00 p.m., the Iredell County Board of Commissioners held
a public hearing as required by General Statute 153A-241; and
WHEREAS, after said public hearing, the Iredell County Board of Commissioners f6und no cause
to retain the portion of the right-of-way of First Street.
NOW, THEREFORE, BE IT ORDERED, by the Chairman and members of the Iredell County
Board of Commissioners, that a portion of First Street, is closed in accordance with the requirements of
N. C. General Statute 153A-241.

MOTION by Commissioner Williams to approve the following seven consent agenda
items.

1. Request from the Health Department for Approval of Budget Amendment #5 for
the Allocation of Women, Infants & Children (WIC) Revenue and the Increase of a WIC
Processing Assistant III's Work Time from .75 FTE to .80 FTE: Health Director Donna
Campbell said in July of this year, notification was received advising that the WIC participant
rate had increased by $.50 a person which would be an additional $23,673. She requested
permission to purchase supplies (LCD projector for trainings, replacement of 11 computers,
monitors/software, two desks, educational materials, computer network switch (replacement).

Campbell said $1,441 of the funding would be used to increase the hours for one Processing
Assistant III from .75 FTE to .80 FTE.

2. Request for Approval of a Resolution Declaring Certain Personal Property Items as
Surplus to the County's Needs & Authorization for the Purchasing Agent to Dispose of the
Same: Purchasing Agent Dean Lail submitted a list containing surplus vehicles and equipment.
Lail proposed that some of the property be disposed of on-line at GovDeals and to also hold a
public auction once an auctioneer had been secured. He said to enable the public to view the
items, a large space was needed. Lail said last year, the sale was held at Vehicle Services;
however, the fairgrounds were an option too.
The board members agreed to declare the items surplus and to use the following disposal
method:
1. The county staff will be allowed to review/inspect the surplus items for any continued
use.
2. Next, a public auction or sale through GovDeals will occur.
3. Then, outside agencies (VFDs, etc) will be allowed to obtain any remaining
surplus items.
Resolution Authorizing the Disposition of Certain Surplus Personal Property
WHEREAS, the County of Iredell has possession of an inventory of vehicles and other
certain personal property items that are surplus to its needs and desires to dispose of same.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Iredell
County that Dean A. Lail, Purchasing Agent, pursuant to the provisions of N.C.G.S. 160A-266, is
hereby authorized to dispose of the listed personal property by physical public auction, on-line
surplus auction site or another appropriate method allowed by North Carolina General Statutes
and most advantageous to the County for cash or good check, and that said Purchasing Agent is
hereby authorized to schedule, conduct and execute any actions required to convey title to this
property.
(A complete list of the surplus items is hereby incorporated into the minutes and may be
found on pages 10 - 20.)
3. Request for Approval of Budget Amendment #6 for the Recognition of Federal
Equity Sharing Funds & to Appropriate for the Purchase of 50 Portable 800 MHz Radios:
Chief Deputy Rick Dowdle requested permission to use seized funds of $154,913 to purchase
radios. He said the request was originally in the Sheriff's FY 08-09 budget; however, it was later
deleted. Dowdle said the radios would allow for interoperability with other agencies and the
VIPER (Voice Interoperability Plan for Emergency Responders) System.
Commissioner Williams asked if the department planned to switch or replace all of the
radios to the megahertz type.
Dowdle said yes. He said in the past, the county had considered being independent;
however, the VIPER System eliminated the need for towers which reduced the expense. Dowdle
said the state was now requiring interoperability to receive grants. He said the Town of
Mooreville was not on the VIPER System, rather it was independent due to obtaining the 800
MHz frequencies previously awarded to the county from the Federal Communications
Commission.
Commissioner Johnson asked if the system had enough channels for Animal Control.
Animal Control Manager Chris Royal said her department had two MHz radios already.
Dowdle said the VIPER System only allowed public safety departments to utilize the
program. He said EMS had one 800 MHz radio in each truck. Dowdle said currently, his
assigned vehicle had five radios, and three could be eliminated with one 800 MHz radio.
Commissioner Robertson asked the total number of radios the department needed.
Dowdle said at budget time, there was a need for 100 radios. He said the requested 50
would be allotted to the road deputies.
4. Request from the Sheriff's Department for Approval of Budget Amendment #7 for
the Recognition of Federal Equity Sharing Funds along with the Appropriation of $89,965
for an Information Tech (IT) Consultant Position: Chief Deputy Dowdle requested a new IT
position with the funding being obtained from seized funds through the remainder of this fiscal
year. He said the computer data workload was becoming too burdensome for one person,
especially with offices in Statesville and Mooresville.
Commissioner Robertson noted that the county would have to absorb the costs at the end
of this fiscal year. Robertson asked about using the county's IT staff.
Dowdle said the county's core or IT staff was not familiar with the software programs.
Commissioner Williams questioned why the request was being made now and not during
the budget deliberations.
Dowdle was asked what was included in the $89,965.00, and he said the salary, benefits,
and a vehicle. He said the current IT person was a sworn officer.
Commissioner Williams said he would be more favorable about the request if the new
person wasn't a sworn officer.
County Manager Mashburn agreed that a sworn officer would be more expensive.
Commissioner Johnson said the sheriffs department could return to the board in the
future for permission to allow the person to attend Basic Law Enforcement Training, if needed.

6. Request for a Decision Regarding the Commissioners' Meeting Scheduled on
Tuesday, November 4, 2008 (Election Day): The board agreed to cancel the November 4
meeting and to hold only one meeting during the month -- Tuesday, November 18, 2008.

(Note: Following the meeting, the LNMC Executive Director Paul Mrzlak advised that an
appointee from Iredell County was not needed. Mrzlak indicated that it was actually Lincoln County's
time to appoint a second member due to the chairman being from that county during the upcoming year.)
COUNTY MANAGER'S REPORT: County Manager Mashburn updated the board on
Tropical Storm Hanna's predicted path. He said the storm should come ashore around
Charleston, SC, and the earliest time this area might be impacted would be Friday night.
Mashburn assured the board that Emergency Management was staying abreast of the storm.

Development - G.S. 143-318.11 (a) (4) and Property Acquisition - G.S. 143-318.11 (a) (5) to enter
into closed session at 8:00 P.M.

PURCHASE OF PROPERTY IN THE WEST FARM INDUSTRIAL PARK:
MOTION by Commissioner Johnson to authorize the Chairman to enter into a joint purchase
agreement with the City of Statesville to purchase 43 acres of industrial property, in the West
Farm Industrial Park, for $28,000 per acre. The County and City will share equally in the cost of
the purchase. The land is to be resold to a yet undisclosed manufacturing industry (Project
SAK). Repayment for the property will be made by the industry out of an economic
development incentive earned over the next six years. The County Attorney will work with the
City Attorney to develop all legal documents for this transaction and will submit to the board of
commissioners at the next meeting. In addition, this motion will include approval of a budget
amendment, with the funds being derived from fund balance in the amount of $602,000.00, plus
closing costs, for the economic development project.
