The Iredell County Board of Commissioners met on Tuesday, September 20, 2011, at
7:00 P.M., in the Iredell County Government Center (Commissioners' Meeting Room), 200
South Center Street, Statesville, NC.

Proclamation
Welcome Home: Creating Connections Between Residents and the Community
Whereas, there are more than 1.5 million individuals living in 16,000 nursing homes; and 1 million
individuals living in 50,000 board and care/assisted living facilities in the U.S.; and
Whereas, the federal Nursing Home Reform Act of 1987 guarantees residents their individual rights in
order to promote and maintain their dignity and autonomy; and
Whereas, all residents should be aware of their rights so they may be empowered to live with dignity and
self-determination; and
Whereas, we wish to honor and celebrate these citizens, to recognize their rich individuality, and reaffirm
their rights as community members and citizens, including the right to have a say in their care; and
Whereas, individuals and groups across the country will be celebrating Residents' Rights Month with the
theme -Welcome Home: Creating Connections Between Residents and the Community- to
emphasize the importance of affirming these rights through facility practices, public policy and
resident -centered decision-making that impacts quality of care and quality of life.
Now, therefore, the Iredell County Board of Commissioners hereby proclaims October 2011 as National
Long -Term Care Residents' Rights Month, in the County of Iredell, and encourages all citizens to
recognize this importance observance.
Consideration of a Request from the Shepherd's Volunteer Fire Department to Use
$75,000 of Fund Balance for Parking Lot Improvements and a Generator for Station 2:
Shepherds VFD Chief Kelly Robinson, along with Shepherds Board Chairman Brian Harwell,
explained the need for these two items. Robinson said there seemed to be more occurrences
where people needed to congregate due to storms and other emergencies, and for this reason, the
department wanted to purchase a generator for Station 2 on Dooley Road. He said in addition,
there was a need to concrete the main station's parking lot due to water damage. Robinson said
three bids had been received for the parking lot project, and the department wanted to use fund
balance for this work as well as for the generator. He said it was understood the department had
$160,000 in fund balance, and $75,000 was needed for the two items.
Commissioner Robertson asked about the parking lot's water issue.
Robinson said three years ago the asphalt became so thin it started sinking up. He said at
that time, concrete was poured near the front of the building to alleviate the problem. Robinson
said then, water started running off the concrete and going under the asphalt. He said the
property had never been properly graded, and re -grading was needed.
Robertson said concrete wouldn't help if the subsurface was not properly done. He asked
who designed the plan to correct the problems.
Robinson said J.C.'s Concrete off Judas Road had submitted a plan, and the Evolution
Development Company, from Mooresville, had looked at the site.
Robertson asked if the companies came up with the solution or did the VFD.
Robinson said the grading would have to occur in accordance with what the contractor
recommended.
Harwell said the contractors pointed out the re -grading needed to be done in order to drop
the catch basin. He said the state actually performed the asphalt paving that occurred in 1992,
and not much grading was done at that time.
Robertson asked about the state's asphalt paving program.
Harwell said the state previously had a program to assist VFDs, and asphalt was poured
for both Station 1 and 2 in 1992.
Vice Chairman Norman asked the generator's size.
Harwell said it was a 40 kilowatt, and two bids had been received. He said a natural gas
generator was being reviewed, and this would necessitate a line extension from Lake Norman
High School to the VFD. Harwell said the extension would cost $6,000.
MOTION by Chairman Johnson to grant the request for the concrete work and generator.

PUBLIC HEARING
Chairman Johnson declared the meeting to be in a public hearing.
Consideration of a Closeout Report on the 2008 Community Development Block
Grant/Economic Development for the Providencia USA Rail Spur Project: Finance
Director Susan Blumenstein said the grant used to build the Providencia rail spur had been
completed, and the project totaled $903,611 with the grant supplying $527,700. She said 56 jobs
were created with 39% of them going to low-income households.

No one else desired to speak, and Chairman Johnson adjourned the hearing.
OTIO by Commissioner Mitchell to approve the 2008 CDBG/ED closeout report for
the Providencia USA Rail Spur Project.

Request for the Appointment of Citizens to each Volunteer Fire Department's
Firemen's Relief Fund Board of Trustees as Recommended by the Volunteer Fire
Departments: Finance Director Susan Blumenstein said each year the county had to appoint
two members to each volunteer fire department's board of trustees for the firemen's relief fund.
She said this was a requirement in order for the VFDs to receive funds from the State Fire
Marshal's Office. Blumenstein said the VFDs had submitted a list of recommended candidates,
and once approved, the information would be submitted to the state.
OTIO by Commissioner Griffith to approve the recommendations of the fire
departments.

Request for Approval of a Proclamation Proclaiming October 9-15, 2011 as
National Fire Prevention Week in Iredell County: MOTION by Commissioner Mitchell to
approve the following proclamation for fire prevention week.

Proclamation Proclaiming
October 9-15, 2011 as Fire Prevention Week in Iredell County
WHEREAS, the County of Iredell is committed to ensuring the safety and security of all those living in
and visiting our County; and
WHEREAS, fire is a serious public safety concern both locally and nationally, and homes are the locations
where people are at greatest risk from fire; and
WHEREAS, home fires killed more than 2,500 people in the United States in 2009, according to the latest
research from the nonprofit National Fire Protection Association (NFPA), and fire departments in the United States
responded to more than 360,000 home fires; and

WHEREAS, cooking equipment is the leading cause of home structure fires and associated injuries, and
the third leading cause of home fire deaths; and
WHEREAS, heating and electrical equipment and smoking materials are among the leading causes of all
reported home fires; and
WHEREAS, home candle fires are reported to a US fire department every 30 minutes, on average; and
WHEREAS, the risk of dying in a home structure fire caused by smoking materials rises with age; and
WHEREAS, working smoke alarms cut the risk of dying in reported home fires in half; and
WHEREAS, automatic fire sprinkler systems cut the risk of dying in a home fire by about 80%; and
WHEREAS, Iredell County first responders are dedicated to reducing the occurrence of home fires and
home fire injuries through prevention and protection education; and
WHEREAS, Iredell County residents are responsive to public education measures and are able to take
personal steps to increase their safety from fire, especially in their homes; and
WHEREAS, residents who have planned and practiced a home fire escape plan are more prepared and
will therefore be more likely to survive a fire; and
WHEREAS, the 2011 Fire Prevention Week theme, "It's Fire Prevention Week. Protect your Family from
Fire!" effectively serves to remind us all of the simple actions we can take to keep our homes and families safe from
fire during Fire Prevention Week and year-round.
NOW, THEREFORE BE IT RESOLVED, that the Iredell County Board of Commissioners hereby
proclaims October 9-15, 2011 as Fire Prevention Week throughout Iredell County and urges all citizens to protect
their homes and families by heeding the potentially life-saving messages of Fire Prevention Week 2011 and to
support the many activities and efforts of hedell County's fire and emergency services.
Request from the Juvenile Crime Prevention Council for Endorsement of Applications
Submitted by Appropriate Punishment Options, Barium Springs Home for Children, & Piedmont
Mediation for Level II JCPC Funding: Finance Director Susan Blumenstein said the Department of
Juvenile Justice and Delinquency Prevention had previously announced that $1.5 million was available
statewide for local Level 11 Dispositional Alternatives Programs. She said the juvenile probation officers
had supplied information on the services needed, but not currently being offered. Blumenstein said the
JCPC had endorsed the following programs:

Barium Springs Home for Children $ 103,231.36 — Family Counseling — Parent/Family Skill Building

Blumenstein said no county funds would be used.

Request from the Emergency Management Department for County Manager
Authorization to Sign an Agreement to Participate in the North Carolina Emergency
Management Western Branch Regionalization Initiative and to Seek Grant Funding for a
Regional Hazard Mitigation Plan to Include Iredell and Rowan Counties: Emergency
Management Director David Martin said the state was requesting for counties to join together in
regionalizing Hazard Mitigation Plans. He said there was a proposal for Iredell County to be
coupled with Rowan County, and approval was needed to authorize the county manager to sign
an agreement to participate in a regional plan, should funding be granted. Martin said Iredell's
next plan would not be due until 2015, but it was believed the state would not fund a single
jurisdiction or county. He said a regional plan could be completed by 2014, and it would
extend through 2019.

Request from the Emergency Management Department for Approval to Apply for
$15,000 from the North Carolina Emergency Management Office for an Emergency
Response Exercise: Emergency Management Director David Martin said various local
agencies had made requests for assistance in developing an exercise to show the strengths and
weaknesses of emergency responses, and the North Carolina Emergency Management Office
was contacted about the availability of planning, equipment, supplies, and overtime
reimbursement funds. Martin requested permission to apply for $15,000 from the NC
Emergency Management Office to conduct an exercise. He said Iredell Memorial Hospital had
expressed an interest in participating in the exercise.
OTION by Commissioner Griffith to approve the request by allowing the emergency
management director to apply for the $15,000 in exercise funding.

Request from the Sheriffs Office for Approval of Budget Amendment #9 for the
Appropriation of Funds Awarded in the 2011 Justice Assistance Grant from the U.S.
Department of Justice for an Athletic Program and for Crime Lab Accreditation: Captain
Mike Phillips said the sheriff's office had been awarded $20,749 from a Justice Assistance
Grant, and the funds would be used to assist in obtaining accreditation for the crime lab and for a
youth athletic program.
OTION by Vice Chairman Norman to approve Budget Amendment #9.

Request from the Sheriff's Office for Approval of Budget Amendment #11 in the
Amount of $66,875 for 13 Vehicles to be Converted to Propane along with the Purchase of
a Computer, a Concrete Pad for a Fueling Station, and Wiring Costs: Captain
Mike Phillips requested permission to move $66,875 in seized funds to (1) convert 13 patrol cars
to propane (2) purchase a computer (3) obtain a concrete pad for a fueling station and (4) pay the
necessary wiring costs.

Request for Approval of a Resolution Recognizing October 2011 as National
Disability Employment Awareness Month: OTIO by Commissioner Griffith to approve a
resolution for National Disability Employment Awareness Month.

RESOLUTION
RECOGNIZING
OCTOBER 2011 AS
NATIONAL DISABILITY EMPLOYMENT AWARENESS MONTH
WHEREAS, Congress in 1945 designated the first week in October as National Disability Employment
Awareness Week; and
WHEREAS, Congress in 1988 amended its earlier designation and declared the entire month of October as
National Disability Employment Awareness Month; and
WHEREAS, United States Secretary of Labor Hilda L. Solis has announced that this year's theme will be
"Profit by Investing in Workers with Disabilities" and
WHEREAS. Americans with disabilities provide many needed talents and abilities to our nation's labor
pool; and
WHEREAS, Americans with disabilities are an integral and vital component of our nation's workforce;
and
WHEREAS, Americans with disabilities should be recognized for their job readiness and the many
contributions they provide to our community and country.
NOW, THEREFORE BE IT RESOLVED, that the Iredell County Board of Commissioners calls upon
all people in Iredell County to observe October as National Disability Employment Awareness Month.
BE IT FURTHER RESOLVED, that the Iredell County Board of Commissioners extends appreciation to
all Americans with disabilities for their invaluable services and skills that are being provided to the workplaces in
Iredell County and across the nation.

Chairman Johnson then announced that Mr. Lancaster would serve on the marine
commission. He mentioned that Lancaster had experience due to previously being a member as
well as serving as the marine commission chairman.

Juvenile Crime Prevention Council: Commissioner Griffith nominated Anthony
Turman.
MOTIO by Chairman Johnson to close the nominations and appoint Turman by

UNFINISHED BUSINESS
Update on the Sheriff's Crime Lab: Chief Dowdle said accreditation for the crime lab
would be demanding for the staff. He submitted a 12 -page report which included bar graphs
showing the number of cases received from 2010 to 2012 (projected), the number of cases
submitted by Iredell County vs. outside agencies, the number of cases submitted by each agency,
total fees received from 2010 to 2012 (projected), the amount of fees received from each county
from 2010 to 2012 (projected), a chart depicting the maximum amount of fees that could be

collected for each case at 100% return, and a chart showing the potential growth in fees for the
next five years.
Dowdle said that in 2010, about 600 cases involved lab tests, compared to 1300 at the
present time. He said cases from within the county would drop in 2012 while there would be an
increase from outside agencies. Dowdle said the lower caseload from within Iredell County was
due to no longer receiving misdemeanor marijuana cases in the lab. He said this was in
accordance with a request from the district attorney in May of this year, and the restriction did
not apply to other counties.
Chairman Johnson asked if there was any other reason for the decline in Iredell cases.
Dowdle said the primary reason was due to the misdemeanor marijuana cases.
Commissioner Griffith asked why the district attorney had made the request.
Captain Mike Phillips said the district attorney had requested for the misdemeanor
marijuana cases to not be tested unless they were going to trial or superior court. He said then,
the evidence could be tested.
Commissioner Griffith said it was understood that one case could involve the testing of
ten or more substances. She said it should be understood that a "case" didn't necessarily mean
one substance was being analyzed.
Chairman Johnson asked what was being tested.
Phillips said the mass spec could test about anything, for example, narcotics and paper.
Dowdle said the fees had climbed from over $10,000 in 2010 to a projection of
approximately $60,000 in 2012. He said the chemist was instructing the clerks of court
throughout the state about sending the fees to the Iredell County Sheriff's Office.
Griffith asked whether or not the state returned the fees to Iredell County if they were
erroneously sent to Raleigh.
Dowdle said he had not received any reimbursements from the state. He said probably
some paperwork had slipped through the cracks, but the revenues were now coming to the
county lab.
Griffith said she understood it sometimes took a couple of years before a person was tried
in court and began making payments.
Dowdle said it wasn't unusual for a case to take three years which delayed the fee
reimbursement. He said the county would be reimbursed if a judge made this stipulation.
Dowdle said the office had to rely on the district attorney to request the reimbursement, and then
the judge would have to agree.
Johnson asked if there had been any difficulty in getting judges to order the payment.
Dowdle said there had been some "discrepancies."
Phillips said that when the statute for the fee was initially written, it was $300 for a test,
but in 2010, the cost increased to $600. He said the only problem was that the statute's
language indicated a judge "may" impose the fee, and it would be better if this were changed to
"shall" impose the fee. He said the change would require legislative action, and the board's
assistance in getting the language revised would help.
Commissioner Robertson said most of the report indicated how the office was getting
more money, and there was a 2012 projection that a little less than $60,000 would be received.
He asked the cost to operate the lab, and what would be the deficit.
Dowdle said the employees' cost was known, and this had been offset with seized money.

Robertson said using the seized funds could only occur for three years.
Dowdle said an exact amount to operate the lab couldn't be provided at this time due to
utility costs. He said these costs would have to be obtained.
Robertson said the board needed to find the gap between the revenues and expenses to
determine the breakeven point. He said the board needed to find out if the lab would be
operating in the red and not realizing a profit as was once indicated. Robertson said he would
like to see these figures. Additionally he asked: How much additional capacity was at the lab to
provide more testing? Did some tests bring in more revenue than others, and if so, could the
county be selective? Robertson said that just because the lab might be able to provide more
testing, it didn't necessarily mean more revenue.
Dowdle said the drug test fees were the revenue generators, but other tests were being
conducted, such as fingerprints and the shooting chamber. He said if a citizen's residence was
broken into and items were stolen, then DNA could be retrieved to help solve the case. He said a
monetary amount on this type of benefit or assistance could not be determined.
Robertson asked if these types of cases were being taken from other agencies or counties.
Dowdle said not many, but there were some. He said some latent print lifting had
occurred for other counties.
Griffith said the lab would soon provide blood alcohol testing, and this would generate
revenue.
Dowdle said this was in the process, and there was a machinist.
Griffith asked if by 2013, fees for 2010 would start surfacing.
Dowdle said yes --that fees for tests occurring now might be returned to the county five
years from now. He said it couldn't be predicted if the lab would breakeven at this point in time.
Dowdle said 25% was a "pretty good" return for what was occurring at the lab. He said that in
the next two or three years, the county would be pleased with the results.
Chairman Johnson said that when the customer base expanded and there were enough
cases in the "pipeline," the revenues should level off. Johnson said it was indicated at a budget
session that it would cost $300,000 a year to operate the lab. He said the board had been told,
when the lab was originally proposed, that it would either breakeven or generate revenue.
Johnson said it would be difficult for the board to require for the lab to pay for itself, as it was
previously mentioned that if a case could be solved, especially before an offender left the county,
then the service was beneficial to the public. He said it appeared the staff was trying to mitigate
the $300,000 as much as possible, but he would encourage the sheriff's office to try and do more
in the effort.
Commissioner Mitchell asked why Catawba County was not sending cases, plus
Commissioner Robertson said Alexander County was not listed on the report either.
Dowdle said the sheriff in Catawba County had expressed an interest. In reference to
Alexander County, he said there weren't that many cases.
Mitchell encouraged the sheriff's office to work with Catawba County.
Robertson asked if the lab had capacity to provide additional tests or lab functions.
Dowdle said yes. He said accreditation would have to occur and this would slow the
process.
PUBLIC COMMENT PERIOD: An opportunity to speak was provided to the public,
but no one accepted.

COUNTY MANAGER'S REPORT
County Manager Smith mentioned the following items:
Household Hazardous Waste Dav: This will be held Saturday, September 24 from
12:30 to 5 P.M. at the Solid Waste Facility on Twin Oaks Road.
Appreciation Expressed to Facility Services & the Cooperative Extension Office:
Due to the death of former Cooperative Extension Director Ken Vaughn, there was much
apprehension about the Annual Fair; however, the extension and facility services staff made sure
all the details were worked out and provided a good job.
CLOSED SESSION: OTIO by Chairman Johnson at 7:55 P.M. to enter into closed
session pursuant to G.S. 143-318.11 (a) (3) — Legal and G.S. 143-318.11 (a) 4 — Economic
Development.
