CALL TO ORDER by Chairman Steve Johnson INVOCATION by Commissioner Gene Houpe PLEDGE OF ALLEGIANCE led by Chairman Johnson ADJUSTMENTS OF THE AGENDA: No one from the staff or the Board asked for adjustments to the agenda. OTION by Vice Chairman Marvin Norman to adopt the agenda as presented. VOTING: Ayes — 4; Nays — 0 PRESENTATION OF SPECIAL RECOGNITIONS & AWARDS (None) APPOINTMENTS BEFORE THE BOARD (None) PUBLIC HEARINGS Chairman Steve Johnson declared the meeting to be in a Public Hearing. Request from the Fire Marshal's Office in Regards to the Expansion of the Troutman Fire Department/B&F Fire District: Fire Marshal Garland Cloer stated details were discussed at the last meeting and the public hearing is to allow citizens an opportunity to make any comments. He asked, if there are no comments, the Board to accept this request which will then be sent to Raleigh for approval. October 21. 2014 No one from the public wished to speak. Chairman Johnson closed the public hearing. MOTION by Commissioner Renee Griffith to approve. VOTING: Ayes — 4; Nays — 0 Chairman Johnson declared the meeting into a public hearing. Request from ICATS to Seek Input Concerning ICATS's Application for North Carolina Department of Transportation (NCDOT) Rural Operating Assistance Program (ROAP) Grant: ICATS Director Ben Stikeleather stated the hearing is for the ROAP Grant totaling $260,273.00. The request is to approve, apply and accept the funds if they are granted. No one from the public wished to speak. Chairman Johnson closed the public hearing. MOTION by Commissioner Gene Houpe to approve. VOTING: Ayes — 4; Nays — 0 ADMINISTRATIVE MATTERS Request from Administration for Approval of Budget Amendment #13 to Appropriate Funds to Lease Additional Space for NC Department of Public Safety, Division of Adult Probations: Deputy County Manager Beth Dirks stated Iredell County is responsible for providing space for the adult probations' program. Their staff is increasing by 5 employees and, therefore, have outgrown their office space. The request is for budget amendment #13 for $9,000 for the remainder of the lease for this fiscal year. The space to be leased is at the City Center. The monthly lease is $1,125.00 which includes janitorial and utilities. Commissioner Gene Houpe asked Dirks to ask the property owners for an agreement to automatically renew the lease at the same price for up to two years. Dirks said she would ask. VOTING: Ayes — 4; Nays — 0 11 October 21. 2014 Request from the Public Safety Director for Approval to Release Capital Equipment Funds to Iredell Rescue Squad for Purchase of Equipment: Public Safety Director David Saleeby said Iredell County Rescue Squad has applied for a 50150 matching grant with the North Carolina Department of Insurance EMS and Rescue Fund for assistance in purchasing equipment. The total of the grant is $48,273.06 which means Iredell Rescue's portion will be $24,136.53. Earlier this year South Iredell and Mount Mourne also purchased equipment for their newly formed districts. The request is to approve $24,136.53 to Iredell County Rescue Squad to purchase equipment through the matching grant process. Chairman Johnson stated it was expressed during the briefing session to take this amount from the County fund balance rather than deplete Iredell Rescue's funds. This would leave them funds for unforeseen issues. The money will be taken from the fund balance until a funding formula is created for capital projects. MOTION by Commissioner Gene Houpe to approve additional funding from the fund balance for $24,136.53 if the grant is approved and any additional rescue appropriations will only be considered if there is a matching grant for rescue. A public hearing was held on October 7, 2014. Miller said the next request is to approve and adopt the Present -Use Value Final Uniform Schedules of Values, Standards, and Rules to be used in the 2015 reappraisal. OTION by Commissioner Renee Griffith to approve VOTING: Ayes — 4; Nays — 0 Miller said the next request is to approve the individual orders adopting the Final Uniform Schedules that were just approved. MOTION by Commissioner Gene Houpe to approve. VOTING: Ayes — 4; Nays — 0 Miller stated the next request is to issue the orders adopting the final Uniform Schedules for Market Value and Present Use Value. OTION by Commissioner Gene Houpe to approve VOTING: Ayes — 4; Nays — 0 Miller said the final request is to approve the Notice of Order adopting the final Uniform Schedules which will be published in the local newspaper beginning October 26, 2014 and ending November 16, 2014. UNIFORM SCHEDULES OF VALUES, STANDARDS, AND RULES FOR 2015 GENERAL REAPPRAISAL (MARKET VALUE SCHEDULE) WHEREAS, pursuant to G.S. 105-286, Iredell County will reappraise all real property in accordance with the provisions of G.S. 105-283 and G.S. 105-317; and WHEREAS, pursuant to the provisions of G.S. 105-317, the Tax Assessor for Iredell County has submitted proposed uniform schedules of values, standards and rules to the Iredell County Board of Commissioners; and WHEREAS, the Board has caused to be published in a newspaper having general circulation in Iredell County a notice stating that the proposed uniform schedules, standards and rules have been submitted to the Board of Commissioners and indicating the time and place of a public hearing on the proposed uniform schedules, standards and rules; and 4 October 21. 2014 WHEREAS, a public hearing was held at the appointed time and place; and WHEREAS, the Board of Commissioners now desires to adopt the final schedules pursuant to the provisions of G.S. 105-317. NOW, THEREFORE, IT IS ORDERED that the final uniform schedules of values, standards and rules attached to this Order are hereby adopted and approved for use in appraising real property at its true value as of January 1, 2015. A notice of the adoption of this Order shall be published once a week for four successive weeks in a newspaper having general circulation in Iredell County. Request from Chairman Steve Johnson to Adopt a Proclamation Opposing the Implementation of the Waters of the United States Rule: Chairman Johnson explained the EPA has regulations for ponds and streams on farmland. But the EPA and the Army Corp of Engineers wish to implement the Waters of United States rule which means they are redefining the definition of "water." The purposed rule would expand the definition of water to include dry stream beds, ephemeral waters, depressions, and many other landscape features, even those that may be only wet after a rain. This means an area that is only wet for a short period of time due to weather will be designated a wetland. The definition states if there is a bottom, a bank, and any indication there has been a high water mark it will be declared as water. He feels they are attempting to regulate the use of land which will not benefit farmers. People in residential and economic development areas will fall under these rules as well. The House of Representatives has legislation to block the implementation of the Waters of the United States rule. The Senate refuses to take it. If the election brings a change in leadership in the Senate, it will be passed but the President has vowed to veto any attempt to implement this rule. Commissioner Gene Houpe asked to add "and support of House Rule HR 5078." October 21. 2014 Proclamation WHEREAS, agriculture is an absolutely necessary sector of our economy and the source of our daily nourishment, and WHEREAS, an affordable and abundant food supply has been largely responsible for health and prosperity, and WHEREAS. the Environmental Protection Agency with the Army Corps of Engineers wish to impose the WOTUS, Waters of the United States rule. and WHEREAS, the WOTUS rule would require farmers to obtain federal permits on land when they are not currently required, and WHEREAS, the WOTUS rule defines portions of farmers' property to be water and regulates it under the federal Clean Water Act and defines water for beyond what is currently required under federal law, and WHEREAS, the proposed rule would expand the definition of water to include dry stream beds, ephemeral waters, depressions, and many other landscape features, even those that may be only wet after a rain, and WHEREAS, the rule affects man made features such as ponds and ditches where water does not have to be present continuously for the land to be designated as water and regulated by these new and onerous rules, and WHEREAS, farmers will incur considerable expense to obtain permits to conduct farming activities in these newly defined areas as water, and WHEREAS, these regulations will place burdensome new regulations on farmers and other industries as well. NOW, THEREFORE BE IT PROCLAIMED that the Iredell County Board of Commissioners strongly oppose the implementation of the Waters of the United States rule and call upon our congressional delegation to oppose its implementations and support of House Rule HR5078. In addition we call upon our fellow commissioners, home builders, economic developers. North Carolina Governor Pat McCrory and North Carolina Secretary of Commerce Sharon Decker to exercise all authority invested in them to protect our citizens from the devastating results of this rule. Adopted this 21st day of October. 2014. 2. Request from ICATS to Approve BA #11 to Increase the ROAP Repayment Expenditure Line Item by $63,313: ICATS Director Ben Stikeleather stated this is a budget amendment to take $63,313 from fund balance and put into a fund to repay ROAP funds that were not spent in the previous fiscal year. ROAP funds are given at the beginning year, the money is spent and reported back at the end of the year. Anything that is not spent must be returned. ICATS is trying to focus more on contract revenue which is more stable. Therefore, the ROAP funds were not all spent. He feels it is forward thinking not to depend totally on ROAP. Last year ROAP funds were decreased by $55,000. 6 October 21. 2014 3. Request from ICATS to Approve BA #12 to Recognize Revenue From the Sale of Surplus Vehicles in the Amount of $11,858: ICATS Director Ben Stikeleather stated this request is to move funds that came from the surplus of vans. The funds will be used to purchase tablets for the vans. The computing devices currently used in the vans are called Rangers which cost approximately $3,000 to replace. Tablets can be purchased for about 5250. Once approved they will begin replacing the Rangers when needed. This grant can only be used in the rural areas as designated by the census. 5. Request from ICATS to Call for a Public Hearing on November 18 to Seek Input Concerning ICATS's Application for FTS 5311 (Admin & Capital) Grant: ICATS Ben Stikeleather said this request is to call for a public hearing on November 18 for a 5311 federal government grant for capital purchases and administrative money. The amount will be $672,760 which is larger than the current fiscal year due to replacing seven vans next year. 6. Request from the Library to Approve the Application for NC Cardinal Migration Grant: Library Director Steve Messick said this is a state-wide network of 29 public libraries that share a computer system. It has a catalog of books for searching and check-out. The present system from SirsiDynix has been in use since 2005 and runs on two servers at the main library. These servers need to be replaced by FY 16. The quote from SirsiDynix to replace and update is $29,000. In addition, there is an annual software maintenance fee projected to be $22,000 for FY16, but automatically increases each year and will be $30,000 by FYI 8. Over a three year period, the cost will be over $110,000 to SirsiDynix. NC Cardinal will replace all of that. This is a shared on-line system. There would be no equipment in Iredell County. It would be accessed via the internet. It would be accessed via the internet. N October 21. 2014 Presently there are 29 county libraries using the system. If the Library is approved for the grant, sometime in FYI 6, NC Cardinal would migrate the data from the current system over to the new system. There is no cost for NC Cardinal the first year. The grant covers all cost for NC Cardinal for the second year. In the third year, when the grant period ends, then there would be an annual fee. NC Cardinal bases the fee on two factors — 1) the total number of physical locations and 2) the total number of books owned. Iredell County's annual fee will be approximately $8,000 per year. Therefore, it is estimated over the next 3 -years, to move to NC Cardinal, would be about $30,000 which is a savings of approximately $80,000. Plus the annual fee to NC Cardinal will be $8,000 as opposed to the increasing fee to SirsiDynix. Another advantage of NC Cardinal is the catalog. Because it is a shared system all books from the 29 libraries will be available to everyone. A citizen could request a book from another county and it could be shipped to the Iredell County Library at no cost. 7. Request from Solid Waste to Approve an Application for NCDENR Air Quality for Diesel Emission Reduction Grant: Solid Waste Director David Lambert requested permission to apply for a Diesel Emission Grant from North Carolina Air Quality. They need a new roll -off truck and this grant can potentially pay up to 25% of the cost. Lambert has talked with Air Quality and feels the chances are good to receive the grant. 8. Request from Parks & Recreation for Approval of Facility Reservation and Special Events Applications: Parks/Recreation Assistant Director Michelle Hepler stated the request is to approve facility reservation and special permit applications, including the associated fees. These forms will help streamline the reservation process and sets fees across the board for all parks. They have been reviewed by Risk Manager Jean Haun and by the County Attorney's office. Alcohol consumption is required to be in a designated area and requires extra permits that must be approved by the Board of Commissioners. 9. Request from the Finance Department to Approve BA #14 to Appropriate Funds to Reimburse Public Schools for Permit Fees: Finance Director Susan Robertson said the Board approved a motion that would allow reimbursement to Iredell-Statesville Schools, Mooresville Graded Schools and Mitchell Community College for permit fees for their in-house construction projects. This request is to reimburse $4,675.78 to ISS and $345.05 to MGSD for costs incurred. Request from the Planning Division to Review the Proposed Municipal Growth Overlay Boundary: Planning Division Director Matthew Todd stated this is a review of the MGO that was discussed in the joint meeting with the Town of Mooresville. All previous suggestions were added and the request is to make a clear understanding to move forward. The MGO must October 21. 2014 first go before the Planning Board for a recommendation. Each involved property owner will receive notice of the meetings. 11. Request from the Planning Division to Call for a Public Hearing on November 18 Concerning a Request from William Fanjoy to Release Zoning to the City of Statesville: Planning Division Director Matthew Todd said this is to call for a public hearing to release zoning and subdivision jurisdiction to the City of Statesville. This property is 184 acres which will most likely be an industrial site. 12. Request from the Planning Division to Call for a Public Hearing on November 18 Concerning a Request from the Town of Mooresville for a Release of Zoning: Planning Division Director Matthew Todd said this is to call for a public hearing to release zoning and subdivision jurisdiction to the Town of Mooresville. This property is along the connector road between Mazeppa Road and Cornelius Road. 13. Request from the Planning Division to Call for a Public Hearing on November 18 Concerning a Request from Jeffrey Cernuto to Release Zoning to the Town of Mooresville: Planning Division Director Matthew Todd said this is to call for a public hearing to release zoning and subdivision jurisdiction to the Town of Mooresville. The property is a purposed subdivision at two units per acre with 27 additional lots. Normandy Road is the only access to this property. 14. Request from the Planning Division to Call for a Public Hearing on November 18 Concerning a Request from Langtree Plantation South to Release Zoning to the Town of Mooresville: Planning Division Director Matthew Todd said this is to call for a public hearing to release zoning and subdivision jurisdiction to the Town of Mooresville. This property is on Langtree with an additional six lots over the County's allowance. They will be tying -in to Bridgeport Subdivision sewer and are proposing two units per acre. 15. Request from Mooresville -South Iredell Economic Development Commission to Call for a Public Hearing for Project WARM: County Manager Ron Smith said this request to call for a public hearing for Project WARM. This was previously discussed in closed session. The incentive requested is $58,200 over a five year period based on a $3 million investment in Iredell County. 16. Request from Tax Administration for Approval of Refunds and Releases: The refunds and releases are for the month of September and are all in order.
