The Iredell County Board of Commissioners met in pre -agenda session on Tuesday,
October 20, 2015, at 5:30 PM, in the Iredell County Government Center (South Wing Conference
Room), 200 South Center Street, Statesville, NC.

PUBLIC HEARINGS
Public Hearing to Seek Input Concerning ICATS Application for FTA 5310 (Elderly
and Disabled) Grant: Former Director Ben Stikeleather introduced the new appointed ICATS
Director Brad Johnson. Stikeleather stated this is a 5310 Grant which is a rural grant, meaning it
must be used outside the urban area, primarily the western, eastern, and northern side of Statesville.
The request is for $160,000 with a 50% match. The ROPE funds and/or contracted revenue will
make up 80%. This grant serves anyone with a disability, signed by a doctor, and anyone aged 65
and over.
Public Hearing to Seek Input Concerning ICATS Application for FTA 5311
(Administrative and Capital) Grant: Former Director Ben Stikeleather said this grant pays for
capital and administrative cost. Admin cost have been reduced from the grant side and is covered
more through contracted revenue. Capital will be used to place six vehicles in the fleet. The match
will come from ROPE funds and ICATS' revenue.

Request from Administration for Approval of the Iredell County Smoke Free Policy:
Deputy County Manager Beth Jones stated this policy is intended to make county facilities,
grounds, and vehicles smoke free effective January 1, 2016. This is any facility that is occupied
by county employees. There will be two phases. Phase I, effective January 1, 2016, will be smoke
free within a 50 -foot radius, but vehicles and other county property where employees are not
present on a regular basis will automatically be smoke-free. Phase 11, effective January 1, 2017,
everything will be smoke-free. The 50 -foot radius will no longer be permissible. All county
property will be smoke-free. Several facilities are already smoke-free with a 50 -foot radius, such
as Development Services, Environmental Health, Health Department, and Government Center
South. This policy will expand to all properties including vehicles. In 2009, a policy was adopted
that stated no smoking in vehicles where more than one person was riding. Again, several
departments are already doing this, such as ICATS, Sheriffs Department, Animal Services, and
EMS.
Vice Chairman Marvin Norman stated his main concern was complaints he had received
about smoking at the entrance of the Library.
Jones said this would take care of the Library and all county property including parks. This
policy only addresses smoking and smoking alternative products that emit vapors or smoke that
effect other people. It does not include snuff or chewing tobacco.
Commissioner Steve Johnson expressed concerns of parking areas. He doesn't want the
public to have issues if they drive into a parking area while smoking in their vehicle. He suggested
to add a phrase at the end of the Park System definition. Also, there need to be plenty of signs.
Jones said the intention is to educate and create a good environment for everyone.
Commissioner Tommy Bowles asked about the 50 -foot radius.
Chairman Mallory reiterated the need for plenty of signs at all entrances and exits.
Commissioner Johnson agreed to make sure the signs states that this is county property and
there is no smoking beyond this point.
Jones said the Phase I radius is 50 feet from any structure where employees occupy on a
regular basis. This is in tandem with health insurance, health and well-being task force, and the
wellness program. This policy is for all employees and public.
Commissioner Johnson asked if the Board agreed to have all signs at the edge of the parking
lots.
The Board agreed and this item will be considered further during the regular meeting at
7:00 PM.
Request from the Finance Department to Approve Amendment to Official Payments
Services Agreement: Finance Director Susan Robertson said Official Payments is a third party
provider of internet or voice activated method to pay property taxes and ambulance bills. Central
Permitting would like to add this service. Last year over 8,800 transactions were processed through
EMS and the Tax Collector. Users pay a convenience fee to use this service. Central Permitting
would like to enter into a five year agreement with one year automatic renewals thereafter. There
is a 60 -day termination clause for either party. The fee is 2.6% of the total payment for permitting

and taxes, except vehicle taxes. EMS, SSD, and ambulance transport is a flat rate. They anticipate
about a $15,000 reduction in credit card processing fees in Central Permitting.

Request from the Public Safety Department for Approval to Release Capital
Equipment Funds to Mooresville Fire and Rescue Department: Public Safety Director David
Saleeby stated that as a result of the current rescue contracts and the newly adopted rescue funding
formula, a capital equipment fund is available for county funded rescue squads to purchase needed
equipment to maintain and improve their services within their assigned districts. Mooresville Fire
and Rescue is asking to use $18,398 to purchase additional rescue equipment. In 2014 South Iredell
Volunteer Fire Department and Mt. Mourne Fire Department used their capital equipment funds
to purchase needed rescue equipment. This request is to release $18,398 to Mooresville Fire and
Rescue Department.
Chief Curt Deaton said the X -Series camera is used in firefighting and rescue in land
searchers and hazmat. It can locate items that varies just one degree Fahrenheit such as gases or
bodies. The current cameras are ten years old.
Commissioner Johnson asked if it is understood that if another fire or rescue unit needs
assistance then this equipment is available for them to use.
Deaton said yes. There is an agreement, called a first alarm response, with all volunteers.
Commissioner Bowles asked what will happen to the old cameras.
Deaton said there was a small credit with trade in for departments that may not have funds
to purchase new. They will hold on to ones that still work.
Saleeby said Mooresville Fire was one of the first on scene at the North Iredell High School
incident.

Request from the Public Safety Department for Approval to Release Capital
Equipment Funds to Iredell Rescue Squad: Public Safety Director David Saleeby said this is a
similar request from Iredell County Rescue. This is a stand-alone rescue with no fire department
affiliation or funding. They have $39,604 in their capital equipment budget. They want to apply
for a 50150 matching grant to assist in purchasing rescue equipment. The Department of Insurance
will provide $22,890 with the reminder provided by the rescue squad. They asked for the same
grant last year but was not awarded the grant and therefore did not receive matching dollars from
the county.
Chief Donnie Perry said they were not awarded the grant last year. This year they are
requesting the match up -front to buy half of the equipment even if they don't receive the grant.
The funds will purchase protective equipment, turn -out gear, gloves, boots, helmets, etc. Current
gear is aged and needs replacing. The grant, with match, will allow the purchase of 20 sets. If the
grant is denied but the county contributes the match then they can purchase 10 sets at least.
Commissioner Bowles said he has worked with volunteers researching funding solutions.
They are aware many things are changing with grant writing. If this money is taken from the capital

equipment budget then that fund will be depleted. He asked where last year's funds would have
been taken.
Finance Director Robertson said last year the Board approved a fund balance appropriation
but it was not spent and was rolled into the County's fund balance on June 30. The budget
amendment will take the funds from Fund Balance.
Commissioner Bowles said things have greatly improved in emergency services by
consolidating and working together. He would like the Board to commit to funding the matching
grant and if the grant is not received then fund the entire amount but not take it from the capital
equipment budget.
Perry said they had hoped to maintain the capital equipment fund because of the need to
replace some trucks within the next two to three years. He said they have already submitted the
paperwork for the grant and it is usually awarded the first of December. The equipment can't be
purchased until the grant is awarded. The equipment will be custom fit so it may be May of 2016
before funds are actually needed.
Commissioner Bowles said if they don't get the grant, the need is still there.
Chairman Mallory clarified the request is to submit to the match for the grant from the
General Fund but if the grant is denied then the Board will reconsider the remainder.
Finance Director Robertson asked the Board to approve budget amendment #15 for the
match.

Request from the Finance Department to Approve the Bid Received for the North
Iredell Park: Purchase and Contracts Manager Dean Lail said the Board approved the sale of the
North Iredell property on September 1. All necessary activities for sealed bids were conducted.
The previous owner, who had the right of first refusal, was in attendance at the bid opening. One
bid was received by Ricky and Elizabeth Talley which was $312,001.00 and exceeded the
minimum set by the Board. The award must be made provisional to special conditions contained
in the General Warranty Deed which means as soon as the high bid is approved then the provisional
of "first right of refusal" must be given to the previous owner. If approved tonight the County
Attorney will begin the process and either close with the previous owners or the high bidder. The
recommendation is to approve the bid in the amount of $312,001 and award the purchase
provisional to Ricky and Elizabeth Talley, then allow staff and the County Attorney to close.

Request from the Finance Department to Approve the Bids Received for Properties
Acquired by Tax Foreclosure Sales: Purchase and Contracts Manager Dean Lail said a resolution
was previously adopted on August 18 to sell two properties that were acquired through tax
repossession. All bidding procedures were completed. Bids were received for both properties as
follows:
1428 Wilson Lee Boulevard $5,560.00 Taxes Owed: $4,476.00
504 Woodlawn Drive $10,356.00 Taxes Owed: $10,356.00
Bidders paid the full amount to GovDeals. If the bidder fails to close the sale, an amount
of 5% of their bid amount will be paid to the County and the remainder will be returned to the
bidder.

Report of No Bids Received Regarding Sale of 1370 Scotts Creek Road Property at
Sealed Bid: County Manager Ron Smith said this went through the same bid process with a set
minimum but no bids were received. The resolution previously adopted required a report to the
Board on this date. However, Smith suggested that staff return at a later date with another
recommendation on how to move forward. There were some issues and vandalism on the property
that needs to be addressed.

Request from Development Services, Planning Division, to Approve the Language
Access Plan: Planning Division Director Matthew Todd said this is part of a 2012 grant that was
received for $225,000. The Board approved the exact same policy in October of 2012 with a two
year life span. It now needs to be reapproved.

Request from Administration for Approval to Purchase 16.43 Acres at 400 Bristol
Drive for the Public Safety Complex: County Manager Ron Smith asked to move forward on the
purchase of 16.43 acres at 400 Bristol Drive to be used for the Public Safety Complex. The price
is $323,550. The due diligence period was completed successfully. The next step is the site plan
review by the City of Statesville.

Request from Iredell-Statesville Schools for Approval of Lottery Proceeds
Application and BA #16: Finance Director Susan Robertson said Iredell-Statesville Schools
wishes to submit applications to the State to draw down $490,000 to use toward the purchase of
land adjacent to South Iredell High School to extend the campus and meet watershed construction
requirements. The request is to approve the submission of the applications and budget amendment
#16 to pass the funds through finance.
Commissioner Bowles asked the percentage of lottery funds that are actually available.

Finance Director Robertson said it has dropped from 30% to 17%. Lottery funds at 100%
include higher education but the total lottery proceeds that are applicable to local schools is down
to 17%.

Chairman Mallory acknowledged the passing of Hal Franklin Dobson, Jr. who was a great
volunteer in emergency services. He spent 38 years in the Iredell County Rescue Squad and the
North Iredell Rescue Squad. He will be missed and sincere condolences are sent to his family.

which is federal funds that provide transportation to the elderly and disabled citizens in the rural
part of Iredell County. They will apply for $160,000 in funding. It is a 50% match with $80,000
coming from local funds that ICATS generates and ROPE funds.

5310 resolution and authorize the transportation director to apply for the 5310 grant funds.

Public Hearing to Seek Input Concerning ICATS Application for FTA 5311
(Administrative and Capital) Grant: Former ICATS Director Ben Stikeleather said this request
is the 5311 Grant which is federal funds that provides administrative and capital funding for
replacing buses. It is proposed to replace six vehicles this year. The administrative funds are
$206,580. All match will come from revenue generated by ICATS or state grant funds.

Request from Administration for Approval of the Iredell County Smoke -Free Policy:
Deputy County Manager Beth Jones said this a proposed policy for a smoke free campus in two
phases. The intent of the policy is to prohibit the use of any smoke or smoking alternative products
in or on county facilities, vehicles, grounds and park systems. The first phase will prohibit smoking
within 50 feet of all county facilities that house employees on a regular basis, effective January I,
2016. However, all county vehicles, grounds and park systems will be 100% smoke free. Phase II
will take effect January 1, 2017. Phase II will make all county facilities and property 100% smoke
free. The fifty foot zone will disappear and the entire property will be smoke free. This policy will
include all employees, visitors, volunteers, students, vendors, contractors, sub -contractors and
others in Iredell County facilities, Iredell County vehicles, Iredell County grounds, and in all
Iredell County Park Systems. There have been several questions concerning types of tobacco. This
policy does not include chewing tobacco, dip, etc. Smoking alternative products are defined as a
tobacco or non -tobacco substitute for the standard manufactured cigarettes, including electronic
cigarettes, tobacco free herbal cigarettes, etc. It does not refer to prescribed over the counter
nicotine replacement therapies, snuff, chewing tobacco, or devices that do not emit smoke or
vapor.
Commissioner Steve Johnson expressed concerns of the park property. According to the
ordinance a citizen who drives into the parking area of a park and has a lit cigarette they are

already in violation merely by driving their personal vehicle onto the property. He would like an
amendment to the definition of Parks System: Any tract of land or body of water comprising part
of the County's parks, playgrounds, natural area, recreation areas, trails and greenways and
streams or other bodies of water except for areas used for parking vehicles by the public. A sign
would be posted at the edge of the parking lot. He does not want to create a continuous situation,
if a citizen unknowingly exits a vehicle with a lit cigarette.
MOTIO by Vice Chairman Marvin Norman to approve the Smoke -Free Policy with the
changes mentioned.

IREDELL COUNTY
Smoke -Free Policy
Purpose:
Iredell County recognizes that smoking is a health, safety and environmental hazard for employees and visitors.
Encouraging a smoke-free environment helps to reduce exposure to toxic and cancer-causing chemicals that are
found in smoke and smoking alternative products. It is Iredell County's obligation to promote a healthy
environment, free from unwanted smoke and vapor for everyone within or on its facilities, vehicles, grounds and
park systems.
Iredell County recognizes that adopting a 100% smoke-free campus policy is an effective way to help protect its
employees and visitors from the harmful effects of smoke.
The purpose of this policy is to prohibit the use of any smoke and smoking alternative products in or on county
facilities, vehicles, grounds and park systems in a two stage approach. Effective January 1, 2016 Iredell County will
enforce a 50 -foot smoke-free zone around all county facilities that house employees on a regular basis. All County
vehicles, grounds and park systems will become 100% smoke-free. Effective January 1, 2017 Iredell County will
become a 100% smoke-free campus including all county facilities that house employees on a regular basis.
Application:
This policy applies to all persons, including employees (full-time, part-time and seasonal), visitors, volunteers,
students, vendors, contractors, subcontractors and others in Iredell County's facilities (leased or owned), in Iredell
County's vehicles (leased or owned), on Iredetl County's grounds (teased or owned) and in Iredelt County's park
systems (leased or owned). The facilities, vehicles, grounds and park systems referred to above will collectively be
referred to in this policy as "premises". The policy also applies to any County -sponsored events that may be "off-
site".
Policy:
Effective January 1, 2016: Use of smoke producing tobacco products in all forms and all smoking alternative
products is prohibited in Iredell County facilities which house employees on a regular basis and the area located
within 50 linear feet of that facility. Use of smoke producing tobacco in all forms and all smoking alternative
products is prohibited in all Iredell County vehicles, on Iredell County grounds and in Iredetl County park systems.
Effective January 1, 2017: Use of all smoke producing tobacco products in all forms and all smoking alternative
products is prohibited in all Iredell County facilities, vehicles, grounds and park systems.

• Iredell County Facility Services shall assure that signs are posted at all entrances and exits of county
facilities explaining the prohibition of smoking and the use of smoking alternative products.
• The signs must use clear and unambiguous language to convey the prohibition.
Ashtrays:
• All publicly available ashtrays shall be removed from any area where smoking is prohibited by
this policy by the owner, operator, manager or other person having control of the area.
Compliance:
• The building manager, department director, division managers, supervisors and security guards shall ensure
the Smoke -Free Zone Policy is enforced. This does not preclude employees from bringing violations to the
attention of their supervisor.
• Employees are responsible for complying with the Smoke -Free Zone Policy. Staff members that do not
follow the policy will be counseled by their supervisor and further incidences could lead to additional
disciplinary action as outlined in the county personnel policies.
• The building manager, department director, division managers, supervisors or the security guards that see
an individual (other than an employee) who is in violation of this policy must ask the individual to stop
using the product or to move beyond the 50 -foot Smokc-Free Free Zone. if the person refuses to stop using
the product or to move beyond the 50 -foot Smoke -Free Zone, the department director, building manager,
security guard or division managers shall ask the person to leave the premises.
• All employees are responsible for encouraging compliance by employees and visitors found violating the
Smoke -Free Environment Policy by courteously reminding them of this policy and suggesting that the
smoking material be extinguished.
Education & Cessation:
• Employees have access to education about Smoke -Free Living through the Iredell County Wellness
Program. Assistance, such as smoking cessation programs, will be provided to new employees and any
current full-time employees who wish to stop smoking.
• NC Tobacco Prevention & Control Branch.

• Employees have access to QuitlineNC (http://www.quitlinenc.com/) that provides free cessation services to
help quit using tobacco products. Quit coaching is available in different forms, which can be used
separately or together, to help any tobacco user give up tobacco. The QuitLineNC brochure is also
available in various locations of the Iredell County Health Department.
• The Iredell County Management Team will orient employees to this Smoke -Free Environment Policy.
Human Resources will also inform employment candidates of this policy during the interview and in the
general orientation process.
Definitions:
1. 50 -foot Smoke -Free Zone: applies to all county facilities which house employees on a regular basis and
area located within 50 linear feet of the facility.
2. Smoker: A person who is smoking.
3. Smoking: Smoking shall mean the inhaling, exhaling, burning or carrying of a lighted pipe, cigar,
cigarette or other combustible tobacco product or smoking alternative product.
4. Smoking Alternative Products: A tobacco or non -tobacco substitute for the standard manufactured
cigarette including electronic cigarettes, tobacco -free herbal cigarettes, etc. This does not refer to
prescribed or over the counter nicotine replacement therapies, snuff, chewing tobacco or devices that do not
emit smoke, vapor, etc.

5. County Facility: A building owned, leased as lessor, or the area leased as lessee and occupied by the
County.
6. Employee: A person who is employed by Iredell County (full-time, part-time and seasonal), or who
contracts with the County or a third person to perform services for the County or who otherwise performs
services for the County with or without compensation.
7. Grounds: An unenclosed area owned, leased to or otherwise occupied by the County.
8. Park System: Any tract of land or body of water comprising part of the County's parks, playgrounds,
natural area, recreation areas, trails and greenways and streams or other bodies of water except for areas
used for parking vehicles by the public.
9. Premises: All of Iredell County's owned and leased facilities, grounds, parking lots, park systems and all
Iredell County owned vehicles. Smoking is prohibited in personal or private vehicles if the vehicle is on
Iredell County's owned or leased properties.

Iredell-Statesville Schools Sale of Property at Woodland Heights: County Manager said
this item was discussed in Closed Session but it is necessary to make a motion of approval in Open
Session. Iredell Statesville Schools has been approached to sell five acres of the Woodland Heights
Property. The property is not suitable for any type of school function. A neighbor would like to
purchase the property to install a buffer between the school and his residence.
MOTIO by Commissioner Ken Robertson to allow Iredell Statesville Schools to sell five
acres at Woodland Heights Elementary to an adjoining property owner as discussed in Closed
Session on August 18, 2015.

PUBLIC COMMENT PERIOD
Bryan Shoemaker of 722 Dobson Farm Road, Statesville, addressed the Board and
presented a petition with 484 signatures to reinstate prayer prior to the Iredell County
Commissioners' meeting. They met in front of the building prior to tonight's meeting and will
continue to pray for the Board. The group will not back down and will be standing behind the
Board.
Chairman Mallory expressed his appreciation for the support of the community. The Board
has revisited the issue and members have agreed to continue to open with a moment of silence for
prayer or reflection.
